About this file
This is a Performance Bond template document for the County of Orange, California, establishing the standard faithful performance bond requirements for contractors entering into service agreements with the County. The bond secures the contractor's obligation to perform all covenants, conditions, and agreements specified in the underlying contract, with the penal sum amount to be determined based on the contract price. The surety company must be authorized to transact business in California, and the bond must include a notarized signature from the surety's representative along with the typed or stamped name of the surety company. The document serves as a condition precedent for contract execution and remains in full force until the contractor satisfactorily completes all work and obligations as defined in the contract terms and specifications.
The bond premium is calculated at a specified rate per thousand dollars of the contract price, with the total premium amount to be inserted upon execution. The surety waives notice of any contract modifications, extensions of time, alterations, or additions to the work or specifications, ensuring the bond remains enforceable regardless of such changes. The County retains the right to recover all costs, reasonable expenses, and attorney fees incurred in enforcing the bond obligation, which shall be taxed as costs and included in any judgment rendered. Both the contractor and surety must execute the bond in accordance with California Corporations Code section 313 requirements, whereby either two authorized corporate officers or a single officer with written evidence of binding authority must sign the document, and the County's Chief Executive Officer or Risk Management division and Office of County Counsel must provide approval as to surety limits and legal form respectively.
