About this file

This is a Faithful Performance Bond document issued by the County of Orange, California, for use in securing contract performance obligations. The bond serves as a guarantee that the contractor will fulfill all terms, conditions, and agreements specified in the underlying contract between the County and the Principal contractor. The bond requires the contractor and a surety company authorized to conduct business in California to be jointly and severally liable for the penal sum amount specified in the document. The bond obligates the Principal to perform all covenants and work as specified in the contract within the time and manner prescribed, and to indemnify and defend the County and its officers and agents. The surety waives notice of any changes, extensions of time, alterations, or additions to the contract terms or specifications and agrees that such modifications will not affect its obligations under the bond.

The bond premium is calculated at a specified rate per thousand dollars of the contract price. The County reserves the right to recover all costs, reasonable expenses, and fees incurred in enforcing the bond obligation, which shall be taxed as costs and included in any judgment rendered. The surety's signature must be notarized with the certificate of notarization attached to the document. For corporate entities entering into the contract, California Corporations Code section 313 requirements apply, mandating either signatures from two designated corporate officers or a single officer authorized by corporate resolution. The bond requires approval by both the County's CEO/Risk Management and the Office of the County Counsel prior to execution.
