About this file

This is a Performance Bond document required by the County of Orange, California for a Narcotics & Narcotic Paraphernalia Onsite & Offsite Destruction contract. The bond serves as a faithful performance guarantee, binding the contractor and surety jointly and severally to the County for the successful completion of work as specified in the underlying contract. The bond requires the contractor to collect, transport, and destroy narcotics and narcotic paraphernalia, with an initial estimated destruction quantity of 20,000 pounds and quarterly estimates of 10,000 pounds. The contract is structured as a three-year agreement with options to renew for two additional one-year terms. The bid due date is November 25, 2025, at 4:00 pm through the County's online bidding system, with all questions requiring submission by November 19, 2025, before 4:00 pm.

The bond specifies that the surety company must be authorized to conduct business under California law, with the surety's representative signature requiring notarization and attachment of the notarization certificate to the document. The penal sum amount and premium rate are to be completed based on the contract price. The bond obligates the contractor to indemnify and defend the County and includes provisions for the County to recover all costs, reasonable expenses, and fees incurred in enforcing the bond obligation. California Corporations Code section 313 requirements apply, mandating either two authorized corporate officers or one officer with written evidence of binding authority to sign the contract. The solicitation offers preferences for Local Small Businesses (OCLSB) and Disabled Veteran Business Enterprises (DVBE), with potential 5% bid price reductions for qualified businesses.
