About this file
This is a Performance Bond document issued by the County of Orange, California, for use in conjunction with the Crane Inspection, Testing, Repair and Certification Services contract. The bond serves as a faithful performance guarantee between the County (obligee), the contractor/principal (bidder), and a surety company. The performance bond requires the principal and surety to be jointly and severally liable to the County in a specified penal sum, ensuring the contractor will perform all covenants, conditions, and agreements outlined in the contract according to the specified terms and timeline. The bond obligates the contractor to indemnify and defend the County and its officers and agents as required by the contract terms. The surety waives notice of any changes, extensions, alterations, or additions to the contract terms, work specifications, or performance requirements.
The performance bond premium is calculated at a specified rate per thousand of the contract price, with the exact premium amount to be determined based on the final contract value. The bond requires notarization of the surety representative's signature, with the certificate of notarization attached to the document. The surety company name must be typed or stamped above the signature line. The bond must be approved by the County's CEO/Risk Management office as to surety and limits, and by the Office of the County Counsel as to form. Corporate signatories must comply with California Corporations Code section 313, requiring either two authorized officers (chairman/president/vice president and secretary/assistant secretary/CFO/assistant treasurer) or one officer with documented corporate authority to sign. Any successful enforcement by the County will result in the contractor bearing all associated costs, reasonable expenses, and fees, which will be taxed as costs and included in any resulting judgment.
