About this file

This is a Faithful Performance Bond template document for the County of Orange, California, required as part of a competitive bidding process for Bird Control Supplies. The bond serves as a guarantee that the awarded contractor will faithfully perform all obligations outlined in the contract. The document requires the contractor and surety company to be jointly and severally liable to the County for the penal sum specified in the bond, ensuring compliance with all covenants, conditions, and agreements of the underlying contract. The bond must be executed with proper notarization of the surety representative's signature, and the surety company name must be typed or stamped above the signature line. The document must be approved by both the County's CEO/Risk Management office as to surety and limits, and by the County Counsel's office as to form.

The bond premium amount and rate per thousand dollars of the contract price are to be inserted by the contractor. The surety waives notice of any changes, extensions, alterations, or additions to the contract terms, specifications, or work scope. The County reserves the right to recover all costs, reasonable expenses, and fees incurred in enforcing the bond obligation, which shall be taxed as costs and included in any judgment rendered. Execution of the bond by corporate entities must comply with California Corporations Code section 313, requiring either two authorized signatories with specified titles or a single officer with documented authority evidenced by corporate resolution. The bond obligates the surety to indemnify, defend with County-approved counsel, and hold harmless the County, its officers, and agents as stipulated in the underlying contract.
