About this file

This is a Faithful Performance Bond template for the County of Orange, California, designed to ensure contractor compliance with maintenance and repair services for steam and water boilers. The bond secures the principal contractor's obligation to perform all work according to contract specifications and timelines. The surety company executing the bond assumes joint and several liability with the contractor for faithful performance of the contracted services. The bond requires completion of blank fields for bond number, premium charges, contract date, contractor information, surety company details, and penal sum amount. The document must be executed with signatures from both the contractor and surety representative, with the surety signature requiring notarization and attachment of the notarization certificate. County approval is required from both the CEO/Risk Management office and the Office of the County Counsel prior to bond finalization.

The bond's penal sum amount and premium rate are to be determined based on the total contract price for the maintenance and repair services. The surety waives notice of any contract modifications, extensions, alterations, or additions and remains obligated regardless of such changes. The bond indemnifies and holds harmless the County, its officers, and agents while obligating the surety to defend the County with counsel approved in writing. Enforcement costs, reasonable expenses, and attorney fees incurred by the County in pursuing bond claims are recoverable and taxable as costs in any resulting judgment. Corporate signatories must comply with California Corporations Code Section 313 requirements, which mandate either dual signatures from specified officers or a single officer signature accompanied by written evidence of binding authority such as a corporate resolution.
