About this file

This is a Faithful Performance Bond template document issued by the County of Orange, California for use in contract performance guarantees. The bond is required for contractors performing work on County projects and ensures that the principal contractor will faithfully perform all covenants, conditions, and agreements specified in the underlying contract. The bond obligates the contractor and surety jointly and severally to indemnify, defend, and hold harmless the County, its officers, and agents. The bond remains in effect for any alterations, extensions of time, or modifications to the underlying contract terms, and the surety waives notice of such changes. Contract-specific details including the bond number, premium charged, contract date, contractor name and address, surety name and address, and penal sum amount are to be completed on the template.

The bond premium is calculated at a specified rate per thousand dollars of the contract price. The surety representative's signature must be notarized with a certificate of notarization attached to the document. Approval authority rests with the County's CEO/Risk Management office and the Office of the County Counsel. The bond obligates recovery of all costs, reasonable expenses, and fees incurred by the County in enforcing the bond obligation, which shall be taxed as costs and included in any judgment rendered. Corporation signatories must comply with California Corporations Code section 313 requirements, which mandate either two authorized officers signing or a single officer signing with supporting corporate resolution documentation demonstrating binding authority.
