About this file

This is a Performance Bond template document issued by the County of Orange, California for use in securing faithful performance of contracts with the County. The bond requires a contractor and surety company to guarantee performance of contract obligations in a penal sum specified by the County. The surety's signature must be notarized, and the surety company name must be typed or stamped above the signature line. The bond obligates the principal contractor and surety jointly and severally to indemnify, defend, and hold harmless the County, its officers, and agents in accordance with contract terms. The bond remains in effect regardless of any changes, extensions, alterations, or additions to the underlying contract, and the surety waives notice of such modifications. Approval of the bond requires sign-off from the County's CEO/Risk Management and the Office of the County Counsel. Corporate signatories must comply with California Corporations Code Section 313, requiring either two authorized officers (such as a chairman, president, vice president, and secretary or treasurer) or a single officer with written evidence of authority to bind the corporation.

The bond specifically relates to the County of Orange, Sheriff-Coroner Department's procurement for purchase, delivery, and maintenance of Digital Capture Station equipment. As stated in the related solicitation, the Performance Bond must have a face amount equal to or exceeding the total estimated contract value and must be provided prior to contract commencement on July 1, 2026. Additionally, a Labor and Material Payment Bond of equal value is required. The bond premium rate and specific penal sum are to be determined based on the awarded contract price. No other pricing terms, set-asides, or financial requirements are detailed within the Performance Bond template itself, as it serves as a standardized instrument for any County contract requiring faithful performance security.
