About this file
This is a Faithful Performance Bond document issued by the County of Orange, California, required as a contractual obligation for the Yamaha 200 HP outboard engines procurement. The bond secures the contractor's performance of their contractual obligations to purchase and deliver two specified Yamaha outboard engines—one LF200XCA model with left-hand rotation and one F200XCA model with right-hand rotation—to the Orange County Sheriff's Department Harbor Patrol facility at 1901 Bayside Drive, Corona del Mar, California. The contractor must complete delivery Monday through Friday between 8:00 a.m. and 4:30 p.m., excluding holidays and weekends, with five business days' advance notice required. The contract term is one calendar year from full execution with no renewal option, and bids are due by April 17, 2026, at 3:00 p.m. through the County's eProcurement Portal. Award will be made to the lowest responsive, responsible bidder within 180 days of bid opening.
The performance bond requires a surety company authorized to transact business in California to guarantee faithful performance of the contract in a penal sum amount tied to the contract price. The surety's signature must be notarized with a certificate of notarization attached to the document, and the surety waives notice of any contract modifications, extensions, or alterations. The bond obligates the surety to indemnify and defend the County, with all enforcement costs and expenses to be taxed as costs and included in any judgment. Contractor compliance with California Corporations Code section 313 requirements is mandatory, requiring either two authorized corporate officers to sign or one officer with written evidence of binding authority, such as a corporate resolution. The County's Risk Management and Office of the County Counsel must approve the bond as to surety limits and form.
