Pen Needles Questions and Answers Summary
This is a Questions and Answers document issued by the Commonwealth of Massachusetts Executive Office of Health and Human Services (EOHHS) addressing inquiries related to a Request for Applications (RFA) for rebate agreements on pen needle products. The RFA, issued February 6, 2026, seeks applications from manufacturers to provide rebated pen needles for distribution to MassHealth members and Health Safety Net patients through fee-for-service and managed care delivery systems. Manufacturers must submit completed responses including a signed State Rebate Agreement with specific rebate offers by National Drug Code (NDC) by March 27, 2026, at 5:00 PM via email to EOHHS-Procurement@mass.gov, directed to Kalinda Collins. The submission package must include a signed cover letter detailing the manufacturer's experience as a preferred pen needle manufacturer for state Medicaid programs within the past five years, clinical benefits information, and contact details for the primary representative. EOHHS anticipates awarding selected vendors by June 1, 2027, with an expected agreement effective date of January 1, 2027, and an initial contract term of 24 months through December 31, 2028, with potential extensions for up to three additional years at EOHHS's discretion.
Rebate offers must be stated as fixed per-unit Guaranteed Net Unit Price (GNUP) amounts for each NDC and designation tier, calculated from Wholesale Acquisition Cost (WAC) minus the rebate amount. There is no brand requirement, and EOHHS reserves the right to enter into agreements with one or more manufacturers based on best value evaluation criteria, which includes pricing, clinical benefits, prior Medicaid experience, and compliance with submission requirements. The evaluation committee will not consider price as the sole determinant in selection. Manufacturers are prohibited from redlining the agreement template upon submission; any amendments post-selection must be mutually agreed upon. Submissions must not be made through COMMBUYS despite references to that platform in the RFA sections; all materials, including evaluation criteria and pricing quotes, must be submitted via email only.
