(iii) Required Schedule: The re production facilities, OPSEC -Service Locations for 24 hours a week at each location for one year. The FSR is required to provide technical support that includes technical assistance and advice, technical data collection and reporting, troubleshooting, and repairing of engines.

(iv) Alternatives: In order to compete this requirement, new sources would have to be given sufficient time to submit and negotiate proposals in order to be awarded a competitive contract to perform the required FSR supporttechnical services. If competition was pursued, the amount of time before onsite FSR support would occur is estimated to be 12 months. The additional time can be attributed to the period associated with preparing and issuing a competitive contract. As a result, a competitive award would occur in 3rd Quarter 2021.

6. Efforts to Obtain and Increase Competition:

a. Effective competition: Due to the Unusual and Compelling Urgency of this requirement for immediate need for FSR technical support as described in Section 5, ACC-DT A no attempt has been made to obtain competition for this procurement. A notice will not be posted in accordance with FAR 6.302-2 (a)(b) due to the exception found in FAR 5.202 (a)(2).

b. Subcontracting competition: A Small Business Subcontracting Plan is not required for solicitations and contracts below $700,000 or when labor hour contracts are contemplated.

7. Actions to Increase Competition: Although no action to increase competition is contemplated at this time, the Government will continue to survey the marketplace and review our acquisition strategy should additional information be received. Any information received will be considered to determine if a competitive acquisition should be conducted or to determine potential future requirements. A formal RFI will be posted for these same services for future requirements.

8. Market Research: Due to the urgency of the requirement as described in Section 5, and considering the immediate need, it was determined to be in the best interest of the Government to urgently award this new contract to Cummins for FSR technical support.

Market Research was conducted within the past 12 months to include searching the GSA advantage website, conducting other web-based searches for FSR support on Cummins V903 engines, and discussions with Cummins Incorporated and their distributors. As a result, no other sources were found who could provide the same services in the urgent timeframe needed.

9. Interested Sources: To date, no other sources has expressed interest in this type of FSR technical support.

10. Other Facts:

a) Procurement History: No prior procurement for the V903 engine FSR technical support exists.

APPROVAL

Based on the foregoing justification, I hereby approve the procurement of Cummins V903 engine FSR technical support on an other than full and open competition basis pursuant to the authority of Title 10 U.S.C.2304(c)(1),as implemented by FAR 6.302-2, “Unusual and Compelling Urgency.” This approval is subject to availability of funds, and provided that the supplies and property herein described have otherwise been authorized for acquisition.
