SECTION 00 73 00 SPECIAL CONTRACT REQUIREMENTS
PART 1 GENERAL
1.1 PURPOSE AND SCOPE
The purpose and scope of this indefinite-delivery, indefinite-quantity (IDIQ) contract is to provide all plant, labor, logistics, tools, equipment, and materials for various striping roads and streets at Joint Base Lewis-McChord (JBLM), and Yakima Training Center (YTC), Washington. Joint Base Lewis-McChord (JBLM) consists of JBLM-Main, JBLM-North, JBLM-McChord Field, and YTC. As requirements develop, Task Orders will be issued based on Technical Exhibit 1 (TE-1) and the Contractor’s coefficient. Task Orders will vary in size from $2,000.00 - $750,000.00 and will be issued by the Mission and Installation Contracting Command, Mission Contracting Office (MICC-MCO) JBLM, Washington.
1.2 PERIOD OF SERVICE
The base period of service will be one (1) year from the date of contract execution. The contract will include four (4) option periods (not-to-exceed one year each) in addition to the base year. The total contract period shall not exceed five (5) years and 6 months. The option years may be exercised in accordance with the Contract Clause entitled, “Option to Extend the Term of the Contract” FAR 52.217-9. Each extension shall be evidenced by modification to this contract. The maximum value of the contract's base year plus option years is $9,000,000.00. Notwithstanding the above, the ordering period shall automatically end upon the termination of this one base-year period absent an extension. The expiration or termination of the ordering period shall not affect any order issued during the effective period of this contract.
1.3 ORDER PROCESSING PROCEDURES
When the Government requires work to be ordered under this contract, the work will be ordered on a Task Order, DD Form 1155, that will authorize and list the location and specific project of work to be performed from scope of work and unit prices from TE-1. Only work designated on the Order for Supplies or Services is authorized to be performed. Oral Task Orders may be issued. Oral orders will be confirmed in writing by issuance of a DD Form 1155 five (5) working days from the date the oral order is placed.
1.3.1 Issuance of Orders
Orders for Services will be issued by the Contracting Officer (KO) at the MICC-MCO when work is required. All orders will be emailed to the Contractor. Failure to acknowledge receipt of orders does not relieve the Contractor from completing the work not later than the completion date specified in the order. The day of issuance of an order is not counted in the time allowed for completion of an order.
1.4 DAVIS-BACON GENERAL WAGE DECISIONS
The Davis-Bacon wage rates incorporated at time of award shall be utilized for all Task Orders issued under this contract for the base year.
1.5 INSPECTION AND ACCEPTANCE
1.5.1 OTHER INSPECTIONS
The Contractor shall be subject to inspections, audits and work interruptions by the Inspector General, United States Army Audit Agency (USAAA), and other Government agencies, such as the United States Army Criminal Investigation Command (CID). Such inspections, audits, and work interruptions will not unreasonably delay the work.
1.5.2 PERFORMANCE INSPECTIONS
a. The KO or his authorized representative will conduct necessary inspections during the daily hours of operation for the purpose of determining satisfactory performance.
b. At the KO's discretion, inspections may be conducted jointly with the Contractor's supervisor. Initial inspections will result in reports listing any existing unsatisfactory conditions found. A re-inspection(s) may be conducted to ensure that corrective action has been taken.
The Contractor or its representative will be informed of inspection results. If the Contractor desires, he may accompany the party during the re-inspection(s). All areas found to be unsatisfactory may be checked during any subsequent inspection or re-inspection for corrective action.

1.5.3 PRE-FINAL AND FINAL INSPECTION
a. The Contractor and Public Works Inspector will jointly conduct a pre-final inspection prior to the Contractor requesting a final inspection. Any discrepancies noted shall be corrected prior to any final inspection. The KO may schedule more than one pre-final inspection if he determines it necessary.
b. When the Contractor is ready for final inspection, he shall submit a request for final inspection in writing (email) to the KO. The final inspection shall normally be requested at least three (3) work days before the desired date.
c. The final inspection will be performed with the Contractor, subcontractors, Public Works Quality Assurance, representatives of the using activity, and the Contract Administrator. Any discrepancies noted shall be corrected within the time specified by the KO prior to final payment.
1.6 CONTRACT ADMINISTRATION
Contract administration will be performed by MICC-MCO JBLM. The AKO, Contract Administrator, Public Works representative and Public Works Quality Assurance Representative as applicable, will be the Government points of contact during the performance period.
Copies of appointment letters will be furnished to the Contractor after contract award.
1.7 CONTRACTING OFFICER'S AUTHORITY
a. The KO is the only person authorized to approve changes or modify any of the requirements under this contract, and notwithstanding anything contained elsewhere in this contract, the said authority remains solely with the KO. In the event the Contractor or contract employee effects any such change at the direction of any person other than the KO, the change will be considered to have been without authority, and no adjustment will be made in the contract price under the Changes clause or any other clause to cover any increase in costs incurred as a result thereof.
b. If the Contractor or contract employee believes technical direction involves a change in contractual requirements, he shall immediately notify the KO. Any modification of contract terms may only be accomplished in accordance with FAR 52.243-4.
1.8 CONTRACTOR PERFORMANCE EVALUATION
a. In compliance with FAR Subpart 42.15, Contractor Performance Information, an evaluation of Contractor performance will be conducted at contract completion. Interim performance evaluations will be conducted at least annually for contracts with a period of performance, including options, exceeding one year. As a minimum, the evaluation shall include the information in FAR 42.1501 "General."
b. Each completed evaluation will be provided to the Contractor. The Contractor will have a minimum of 60 calendar days to submit comments, rebutting statements, or additional information.
c. Disagreements between the parties regarding the evaluation will be handled in accordance with FAR 42.1503 (d).
d. Copies of the evaluation, Contractor response and review comments, if any, may be retained for up to three years after contract completion as part of the evaluation file.
e. Past performance information will be shared, as requested, with Governmental source selection officials to support award decisions and may be maintained in Government databases available to other Government personnel.
1.9 ALTERNATIVE DISPUTE RESOLUTION
a. In furtherance of Federal policy and the Administrative Dispute Resolution Act of 07 January 2011 (ADR Act), 5 USC section 571, et seq., the Contracting Officer will try to resolve all post award acquisition issues in controversy (including "protest to the agency" within the meaning of FAR 33.103 and a "claim" within the meaning of the Contract Disputes Act) by mutual agreement of the parties. See
FAR 33.214.
b. Interested parties are encouraged to use alternative dispute resolution procedures to the maximum extent practicable in accordance with the authority and the requirements of the ADR Act.
c. An interested party desiring to submit an issue(s) for resolution under the ADR procedures shall submit a written request to the Director of Contracting at the following address:

d. The request must be signed by an authorized representative of the interested party and must include the following:
(1) The interested party's name, address, and telephone number, including FAX number.
(2) The event or action involved, including a detailed statement of all factual grounds for the protest or dispute.
(3) A request for a ruling.
(4) A request for the desired relief.
e. The Director of Contracting will promptly notify the interested party whether ADR is appropriate for resolution of the issue(s) in controversy. This will usually be done within 10 work days after receipt of the request. After an ADR procedure has been agreed to by both the Director of Contracting and the interested party, every effort will be made to resolve the issue within 30 calendar days from the date of that agreement.
f. Each party will normally be responsible for the costs each incurs in using ADR procedures. This includes the costs of witness travel, affidavits, telephone calls, copying, and similar administrative costs.
g. When ADR procedures are used subsequent to the issuance of a Contracting Officer's final decision, its use does NOT alter any of the time limitations or procedural requirements for filing an appeal of the Contracting Officer's final decision and does NOT constitute a reconsideration of the final decision. See FAR 33.214(c).
h. The Director of Contracting may also request the use of ADR procedures.
i. Either the Director of Contracting or the interested party may terminate use of the ADR procedure at any time upon giving written notice to the other party.
1.10 DESIGNATION OF TECHNICAL REPRESENTATIVE
The Chief, Engineering Services Division, Public Works, or its authorized representative, is designated as the technical representative of the KO for the purpose of technical surveillance of workmanship and inspection of materials for work being performed under this contract. No technical representative is authorized to change any provisions of the specifications without written authorization of the KO, nor shall the presence or absence of a technical representative relieve the Contractor from any requirements of the contract.
1.11 RELATIONSHIP BETWEEN GOVERNMENT, CONTRACTOR, AND CONTRACTOR PERSONNEL
a. The Government and the Contractor understand and agree that the services to be delivered under this contract are non-personal services and that no employer-employee or master-servant relationship exists or will exist under the contract between the Government and the Contractor or between the Government and the Contractor's personnel. Further, the Contractor is not the Government's agent.
b. The Government will not exercise any supervision or control over Contractor personnel performing services under this contract.
Contractor personnel shall not become an integrated part of the Government organization in connection with performance under this contract.
c. The services to be performed under this contract do not require the Contractor or its employees to exercise personal judgment and discretion on behalf of the Government, but rather, the Contractor's employees shall act and exercise personal judgment and discretion on behalf of the Contractor.
d. Contractor personnel shall not be eligible, by virtue of performance under this contract, for payment by the Government of entitlements and benefits accorded federal employees. The entire consideration to the Contractor for performance of this contract is contained in the provisions for payment set forth in this contract.
1.12 SUBCONTRACTING OPPORTUNITIES
Offerors are encouraged, but not required, to advertise subcontracting opportunities in the FedBizOpps and other publications to obtain maximum competition in contracting opportunities. Announcements in accordance with FAR 5.206 and 5.207 may be submitted to http://www.fedbizopps.gov.
Announcements shall bear the heading: "Subcontracting Assistance Wanted".
1.13 WARRANTY
The Contractor shall stamp or mark the supplies delivered or otherwise furnish notice with the supplies of the existence of a warranty.
Markings shall include (1) a brief statement that a warranty exists, (2) the substance of the warranty, (3) its duration, and (4) who to notify if the supplies are found to be defective.
b. The prices during the short-term extension(s) shall be the prices applicable during immediately preceding contract period.
1.15 RELEASE OF INFORMATION
The Contractor shall not make news releases or otherwise provide information relative to the performance of this contract or information relative to any incident occurring on JBLM or YTC without prior approval of the KO.
1.17 RIGHT TO SET-OFF AMOUNTS DUE THE UNITED STATES
The KO specifically reserves the right to set-off any amounts due the United States under other contracts against amounts due the Contractor under this contract.
1.18 CONTRACT ACQUISITION
Funds are not presently available for this acquisition. No contract award will be made until or unless appropriated funds are made available from which payment for contract purposes can be made.
1.19 DEFAULT CONTRACTS WITH THE UNITED STATES
If the bidder or offeror, its officers, principle employees, affiliates, or subsidiaries have had a contract with the United States terminated for default within three years prior to the date of this bid or offer, for each such contract provide:
a. Contract Number;
b. Administering KO;
c. Address of the Contracting Office;
d. Telephone number of the Contracting Office.

SECTION 01 11 00 SUMMARY OF WORK
1.1 DESCRIPTION OF WORK
Provide all plant, labor, tools, equipment, and materials (except as indicated otherwise in the specifications) and perform all work in strict accordance with the specifications and plans required for individual Task Orders. The contract for the required work will be a construction IDIQ contract. The requirements cover a broad range of street, parking lot, and airfield striping at the locations listed in paragraph 1.1.1 below. During the contract period, the Government will identify specific jobs and issue individual Task Orders to the Contractor for job completion. The Contractor shall maintain a management office to receive Request for Proposals (RFP), signed Task Orders (TO), and Notices-to-Proceed (NTP); to receive and initiate contract correspondence; and to provide other engineering management services related to accomplishing individual Task Orders. Task Orders will vary in size, with the majority expected to be of a medium to large size. Task Orders will include tasks ranging from a variety of pavement, and airfield markings, layout, marking removal including environmental clean-up and rubber removal (incidental to the work).
1.1.1 Area Description:
The majority of the Task Orders issued will include various roads, streets, driveways, and parking lots on JBLM and YTC. Other areas of coverage will include active runway, taxiway, and parking ramps at Gray Army Airfield on JBLM-Main and McChord Airfield at JBLM-McChord Field. Individual Task Orders shall indicate the exact location of work. The types of surfaces to be marked are, but not limited to, Concrete and Asphalt.
1.1.2 Principal Items to be accomplished
a. Paint, repaint or restripe all pavement reflectorized and non-reflectorized markings, including existing center lines, traffic lines, fog lines, crosswalks, stop bars, hatching, arrows, Access Parking Space Symbols, and other miscellaneous markings. Pavement markings may also include newly paved roads, un-striped streets, runways, taxiways, aircraft parking ramps, and other airfield markings as required.
b. Apply thermoplastic to replace or repair reflectorized markings, including existing crosswalks, stop bars, hatching, arrows, and other miscellaneous markings. Pavement markings may also include newly paved roads, un-striped streets, runways, taxiways, aircraft parking ramps, and other airfield markings as required.
c. Install, replace or remove raised reflective markings in conjunction with traffic markings.
d. Paint parking lot stalls, stripes, arrows, stop bars, and miscellaneous markings.
e. Remove and/or replace existing markings in conjunction with traffic pattern alterations, or street extensions.
f. Provide certified traffic control personnel during construction adjacent to or on streets. Traffic control signs and equipment shall be used.
g. All work accomplished at Gray Army Airfield shall be conducted in strict accordance with Engineering and Construction Bulletin (ECB) 2012-28 Marking of Army Airfields and Heliports, UFC 3-260-05A, Marking of Army Airfield-Heliport Operational and Maintenance Facilities, AFI 32-1042, Standards for Airport Markings, AF ETL 04-02, Standard Airfield Pavement Marking Schemes, Federal Aviation Administration (FAA) Advisory Circular (AC) 150/5340-1J, Standards for Airport Markings, U.S. Department of Transportation, FAA AC 150-5370-2E Operation Safety on Airports During Construction.
h. All work accomplished at McChord Airfield shall be conducted in accordance with AFI 32-1042, Standards for Marking Airfields, UFC 3-260-01, Airfield and Heliport Planning and Design , UFC 3-535-01, Visual Air Navigation Facilities, ETL 04-2, Standard Airfield Pavement Marking Schemes, ETL 97-18, Guide Specification for Airfield and Roadway Marking, ETL 09-6, Landing Zone Dimensional, Marking and Lighting Criteria, FAA AC 150/5340-1J, Standards for Airport Markings, FAA AC 150-5370-2E Operation Safety on Airports During Construction.
1.1.3 Period of Performance
The period of performance is the period between the Task Order Notice-to-Proceed and the time when all work under the Task Order is completed. The Period of Performance will be negotiated for each Task Order. (Period of Performance shall include time to prepare and submit as-built drawings, specifications and other required documentation)
1.2 DRAWINGS
Drawings or maps applicable to all work performed under this contract shall be provided with individual Task Orders.
1.2.1 Plans and Specifications:
The contractor shall be provided one copy of the Statement of Work, specifications, drawings, and maps as applicable upon issuance of each Task Order. All further reproduction shall be at the Contractor's expense.
1.3 CONSTRUCTION PHASING
The following construction phasing related issues shall affect the work:
1.3.1 Interface with Others:
Government use in and around adjacent facilities is anticipated while the work under this contract is being performed. The work shall be planned and accomplished so that there will be a minimum of interference and inconvenience to traffic flow. Any blockage of building exits, driveways, roads, or vehicle traffic pattern must be coordinated in advance with the Quality Assurance Inspector (QA), and the Military Police Traffic Coordinator.
A. Gray Army Airfield Striping: Contractor shall accomplish airfield striping per specific instructions as identified in each Task Order and coordinated through the Gray Army Airfield Manager.
B. JBLM-McCord Field Controlled Access Area Striping: Contractor shall accomplish striping per specific instructions as identified in each Task Order and coordinated through the appropriate Security Manager to establish a “free-zone” and/or provide a government security escort.
1.3.2 Work Site Notification:
The notification signage shall be placed one week prior to the commencement of work, and located adjacent to the work area. Signage shall notify the using public as to the expected dates of work and or closure.
1.3.3 Work Site Conflicts:
In the event of a conflict between the Contractor and others, the KO shall decide the dispute and the KO's decision shall be final.
1.3.4 Construction Restrictions:
Construction restrictions shall be identified and required as indicated on individual Task Orders.
1.3.5 Temporary Construction Waiver/Security Free Zone Waiver McChord Field
a. The contractor shall provide to the PM at a minimum; map or drawing showing construction area, access route, special equipment, duration of on-site construction, method of identifying Free Zone area, any other information needed to clarify any security and airfield concerns. The PM will coordinate, through McChord Field Airfield Manager and DPTMS Waiver Technician, a Temporary Construction Waiver for any work on or near the McChord Field airfield. The PM will also coordinate, through McChord Field Airfield Manager and 627 Security Forces, a Security Free Zone waiver for work on or near the McChord Field airfield or in security sensitive areas. Allow a minimum of 35 calendar days (concurrent) to process each. The Contractor will not be allowed to start the on-site work until each waiver has been approved. The waivers will be initiated based on the Contractor's submitted Progress schedule.
b. Work in Security Free Zones may require continual escort/surveillance by Government personnel. The Contractor shall submit weekly, on Wednesday, the following week's work schedule in Security Free Zones so adequate escorts/surveillance can be arranged by
QAR.
c. The Contractor shall provide low profile barricades along the perimeter to delineate the Security Free Zone area, applicable only to paved areas. The Foreign Object Debris (FOD) barrier will suffice if a FOD barrier is required. Otherwise, the Contractor shall provide weighted, commercially produced white/orange sawhorses every 25' to include yellow flashers. A red rope shall be strung between the sawhorses.
1.4 ORDERING PROCEDURES
Ordering procedures are detailed in SECTION 00 73 00 SPECIAL CONTRACT REQUIREMENTS, Ordering Processing Procedures.
The Contractor shall have a representative to perform site visits, receive Requests for Proposals, provide Contractor proposals, negotiate final settlements, and bind the Contractor for negotiated work and receive Task Orders.
1.4.1 Multiple Orders
In the event of multiple Task Orders being issued, the periods of working days allowed for each Task Order will run concurrently with other Task Orders. In the case of multiple Task Orders that create conflict in priorities or completion dates, the Contractor shall notify the KO immediately of such conflicts. The KO, at his discretion, may make equitable changes in the completion dates to eliminate conflicts.
1.4.2 Coefficients
The Contractor’s coefficient shall include all Contractor costs in addition to the pre-priced unit prices in the Work Item Price List at Technical Exhibit 1 (TE-1) found in Section J – List of Documents, Exhibits and Other Attachments. The coefficient is a numerical factor that represents Contractor costs (indirect and direct costs) and profit in addition to prices at TE-1. The Contractor’s coefficients must contain all Contractor cost including, but not limited to, profit; sales tax; use tax; overhead (both home office and field overhead);
temporary lodging; labor burden; bonding costs; insurance; general and administrative expenses; all traffic controls; testing; testing equipment; subcontractor mark-up; geographical location of the work, Davis-Bacon Act; mobilization/demobilization; compliance with environmental laws; permits; preparation of reports, correspondence, submittals, and documentation required by law or the contract;
protection of and/or moving Government property; engineering services; interface with Government representatives; and coordination with occupants and other Contractors. As stated above, the coefficient must include any adjustments to the prices in TE-1. The prices in TE-1 are the prices the Government has determined it will pay for the listed work items. The Government does not guarantee or warrant that the Contractor can perform the work for the listed prices. If it costs the Contractor more than the prices in TE-1 to perform the work, the Contractor must include such additional costs in its coefficients.
EXAMPLE 1: Work item “X-1” has a unit price of $2.00 ea. To perform the required work at JBLM, the Contractor’s expected unit cost to do all work included in the work item plus profit and overhead adjustment to TE-1 unit price, and everything else to be included in the Contractor’s coefficient will be $2.58 ea. The coefficient for CLIN 0001 would be 1.29 (2.58 ÷ 2.00).
EXAMPLE 2: Work item “X-1” of TE-1 has a unit price of $2.00. To perform the required work at YTC, the Contractor’s expected unit cost to do all work include in the work item plus profit, overhead, adjustment to the TE-1 unit price, any price difference because the work is at YTC instead of JBLM, and everything else to be included in the Contractor’s coefficient will be $3.20 ea. The coefficient for CLIN 0002 would be 1.60 (3.20 ÷ 2.00).
COEFFICIENT FACTORS FOR OPTION YEARS
The Government will make adjustments to the base year coefficient factors for option years in accordance with the following formula:

The Construction Cost Index (CCI) Factor, f, will be computed according to the following equation:

CCI – B
Where: CCI-C is the Construction Cost Index for the month in which the option year is exercised for which f is computed as published by the ENR (formerly called the Engineering News Record).
CCI-B is . It is the base reference and is the CCI-C for beginning period of the base year. This figure will be added at date of award.
NOTE: If the ENR changes the index base year(s), the base reference used herein will be adjusted to accommodate the new CCI-C(s).
In computing f, the CCI-C may be located on the Market Trends page of the ENR current issue at the time that the option year is exercised. The CCI-B is the base reference for the month in which the basic contract is awarded.
If the CCI-C ceases to be published, the parties shall agree on substitute indices and the contract modified accordingly.
1.4.2.1 Task Order Pricing
Provisions have been made in the Bid Schedule for allowing different coefficients for differing geographical locations.
1.4.2.2 Non-Prepriced Work
Non-Prepriced work (i.e., work not priced in the TE-1) but within its scope and general intent and necessary to complete the requirements of a specific task order may be negotiated and incorporated into the task order by the Contracting Officer. Non-prepriced work shall be so noted on each task order and will not exceed 10% of the final negotiated amount. Proposed costs for non-prepriced items will be supported by three verifiable price quotes where possible.
a) 115% shall be applied to the quoted, verified and negotiated NPI costs to arrive at the total cost for any NPIs before inclusion in the total task order price.
b) To permit recurrent use, a non-prepriced line item must be incorporated by supplemental agreement into the TE-1. This may be done at any time during the contract period.
1.4.2.3 Adjustment of Compensation – Davis-Bacon Act Wages
If the Department of Labor publishes any new or amended wage decision pursuant to Section 1.5(b), Title 29 of the Code of Federal Regulations, the Wage Decision current on the date the Government exercises its option to extend the term of this contract shall be incorporated into the contract and the Contractor shall be obligated to pay any wage and fringe benefits increases applicable during the option period. No equitable price adjust shall be made for Davis-Bacon wage increases or decreases.
The KO or his authorized representative shall, until the expiration of three (3) years after final payment under the contract, have access to and the right to examine any directly pertinent books, documents, papers, and records of the Contractor.
1.4.2.4 State and Local Taxes
The Contractor shall provide the KO with written notice of tax assessments whenever immunity of the Government from the tax could be an issue. The notice shall be submitted in sufficient time to provide the Government a meaningful opportunity to participate in negotiations or litigation with the taxing authority concerning the applicability of the tax.
1.4.2.5 Permits and Licenses
Unless otherwise specified in this contract, the Contractor shall obtain any necessary licenses and permits, give all notices, and comply with any applicable Federal, State, County, and municipal laws, codes, and regulations in connection with this contract.
OTHER ADJUSTMENTS TO COEFFICIENTS
Coefficients shall not be adjusted for any other changes or circumstances encountered during the life of the contract.

SECTION 01 14 00 WORK RESTRICTIONS
1.1 SUBMITTALS
Government approval is required for submittals with a "G" designation; submittals not having a "G" designation are for information only.
When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. The following shall be submitted in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:

1.2 CONTRACTOR ACCESS AND USE OF PREMISES
1.2.1 Installation Regulations
Ensure that Contractor personnel employed on the Installation become familiar with and obey Installation regulations including safety, fire, traffic and security regulations. Keep within the limits of the work and avenues of ingress and egress. Wear hard hats in designated areas. Do not enter any restricted areas unless required to do so and until cleared for such entry. The Contractor's equipment shall be conspicuously marked for identification.
1.2.1.1 Subcontractors and Personnel Contacts
Furnish a list of contact personnel of the Contractor and subcontractors including company, driver's license, address, and telephone numbers for use in the event of an emergency. As changes occur and additional information becomes available, correct and change the information contained in previous lists.
1.2.1.2 Personnel Entry Approval
Failure to obtain entry approval will not affect the contract price or time of completion.
1.2.1.3 Commercial Vehicle Access to Joint Base Lewis-McChord a.
1.2.1.4 Commercial Vehicle Access to JBLM
a. These instructions apply for commercial vehicle access JBLM. Procedures for commercial vehicle access to JBLM are subject to change without prior notice. Current information concerning road conditions may be obtained by calling (253) 967-1733.
Commercial vehicle access to JBLM will be allowed only at location with Commercial Vehicle Inspection Point listed above. The gate hours are listed in previous paragraph. Gate hours are subject to change without notice. Current information on gate hours can be obtained from the Visitor Center at 967-4794. All commercial vehicles will be inspected. A visitor pass must be obtained. The Contractor should anticipate delays in getting commercial vehicles on post. The Contractor must also allow additional time for commercial vehicles to reach their destination by driving through JBLM.
If the commercial vehicle is carrying a load of cement or hot asphalt for delivery, the driver shall notify the gate guard as soon as possible and request that the vehicle be given priority for being searched; however, the Government does not guarantee that the vehicle will be given priority.
On weekends large vehicles (needing greater than 12'-5" clearance) will require a time stamped "searched" label to gain access.
"Searched" labels will be issued at the Commercial Vehicle Inspection Point, as appropriate. Drivers needing access must inform the gate guard that their vehicle is over 12'-5" in height and that they will require access. The driver will receive a briefing on proper procedures and a "searched" label. The Contractor shall ensure that its drivers, including drivers of subcontractors at any tier, comply with the procedures as explained to them for access.
This process may be changed without prior notification, but any long-term badge issued to Contractor employees will continue to be valid until its expiration date.
1.2.1.7 Vehicle Emission
Prior to initial issuance or renewal of an existing post decal, proof of current emission compliance must be shown when the vehicle is registered with the Provost Marshal Vehicle Registration Office.
The JBLM compliance program requires any motor vehicle that operates on the installation for more than 60 days per year to show proof of Washington State emission compliance, in accordance with the Washington Administrative Code (WAC) 173-422-030.
Companies with out-of-state registration and plates and with current emissions compliance certificate from that state will still be required to show proof of Washington State emission compliance in order to receive a post decal. Washington State does not recognize current emissions tests from any other state.
1.2.1.8 Commercial Vehicle Access to the Airfield Enclosure on JBLM-McChord Field
a. These instructions apply to vehicle access to the airfield enclosure on JBLM-McChord Field.
b. Access to the airfield enclosure at JBLM-McChord Field is limited according to Department of Defense Security regulations.
The Contracting Officer's Representative (COR) will brief the contractor and provide him/her with a copy of the briefing, outlining the contractor’s security responsibilities. As a minimum, this briefing will include information on vehicle decals, employee badge requirements and if applicable, describe free zones associated with the contractor’s performance and restricted controlled area entry requirements. Prior to initiating work, the contractor shall supply to the COR, as a minimum, each vehicle's type and license plate number (contractor's vehicles as well as employee's privately own vehicles) as well as each employee's name, driver's license number, and social security number to obtain vehicle passes and employee's base badge(s) for admittance to area(s) where employees will be tasked. The contractor’s company logo will be prominently displayed on their vehicle. The COR will submit the contractor's list(s) to the DES Badging Office located in Bldg. 100 on JBLM-McChord Field for mandatory background investigations and access authorization.
c. At any time during the contract period where changes occur in the contractor's vehicles or employees, the contractor shall notify the COR of changes immediately.
d. Rapid Gate Access Badges are not valid for access to the airfield enclosure at JBLM-McChord Field.
e. While on JBLM-McChord Field, the contractor's employees shall display their base badge, which shall be visible on the outside of their clothing whenever they are on the installation property. The contractor's employees shall ensure the badge is correct for that area or ensure a Government escort has been assigned and is present for that area.
f. f. Contractors requiring access to the airfield enclosure are required to enter at the Levitow Gate, which is internal to the JBLM-
McChord Field cantonment area. The Levitow Gate is located east of the intersection of Barnes Blvd and Levitow Blvd, and across the Clover Creek Bridge.
g. The Flight Line is a controlled area that contains restricted areas. Commercial vehicles are strictly prohibited from accessing these areas without an approved escort. The COR will coordinate with the Chief, Airfield Management (62 OSS/OSSA) for all contractors and their employees that are required to operate their vehicles on the flight line. The agency sponsoring the contractor and/or his employees into controlled or restricted areas will coordinate with DES/Security Access and Control at JBLM McChord Field.
h. Contractors and their employees will adhere to all applicable JBLM security and traffic laws.
1.2.2 Working Hours
Regular working hours shall consist of an 8-hour period, between 7:30 a.m. and 5:00 p.m., Monday through Friday, excluding Government holidays.
1.2.3 Government holidays

1.2.4 Work Outside Regular Hours
Work outside regular working hours requires KO approval. Make application 15 calendar days prior to such work to allow arrangements to be made by the Government for inspecting the work in progress, giving the specific dates, hours, location, type of work to be performed, contract number and project title. Based on the justification provided, the KO may approve work outside regular hours.
During periods of darkness, the different parts of the work shall be lighted in a manner approved by the KO.
1.2.5 Occupied and Existing Buildings
The Contractor will be working around existing buildings that are occupied.
1.2.6 Special Scheduling Requirements
Permission to interrupt any activity roads, railroads, and/or utility service shall be requested in writing a minimum of 15 calendar days prior to the desired date of interruption.
1.2.7 Cellular Telephone Use
Driving or being in physical control of a motor vehicle on a Government installation while operating a cellular phone or like device is prohibited unless the vehicle is safely parked or unless the driver of the vehicle is using a hands-free device. The wearing of any other portable headphones, earphones, or other listening devices (except for hands-free cellular phones) while operating a motor vehicle is prohibited. Civilians, Contractors, and visitors to the installation who fail to comply with this policy are subject to administrative action to include loss of driving privileges on government installation and removal and/or denial of re-entry to the installation.
1.2.8 Security Levels
Force Protection Conditions (FPCON): Security Forces may incorporate various FPCON levels which impact the ability of the Contractor to perform work. FPCON levels may vary from the least restrictive to most restrictive depending upon current base-wide potential security threat. Access onto the Base may be limited during increased FPCON levels, which may impact contract operations.
All prudent measures will be implemented by the KO to ensure continuity of Contractor operations during the establishment of increased FPCON levels.
1.2.9 Public Release of Information
1.2.9.1 Contractor and subcontractor personnel shall not publically (or privately) discuss or release information, photographs, or other documents concerning any aspects of the materials or services relating to this contract or its task orders without the express written approval of the Contracting Officer.
1.2.10 Relationship Between Government, Contractor, and Contractor Personnel
1.2.10.1 The Government and the contractor understand and agree that the services to be delivered under this contract are non-personal services and that no employer-employee or master-servant relationship exists or will exist under the contract between the Government and the contractor or between the Government and the contractor's personnel. Further, the contractor is not the Government's agent.
1.2.10.2 The Government will not exercise any supervision or control over contractor personnel performing services under this contract.
Contractor personnel shall not become an integrated part of the Government organization in connection with performance under this contract.
1.2.10.3 The work required under this contract does not require or authorize the contractor or his employees to exercise personal judgment and discretion on behalf of the Government, but rather, the contractor's employees shall act and exercise personal judgment and discretion on behalf of the contractor.
1.2.10.4 Contractor personnel shall not be eligible, by virtue of performance under this contract, for payment by the Government of entitlements and benefits accorded federal employees. The entire consideration to the contractor for performance of this contract is contained in the provisions for payment set forth in this contract.
SECTION 01 22 00.00 10 MEASUREMENT AND PAYMENT
1.1 GENERAL
The price for each contract line item shall constitute full compensation for furnishing all plant, labor, materials, appurtenances, and incidentals and performing all operations necessary to construct and complete the items in accordance with these specifications and the applicable drawings, including surveying performed by the Contractor. The bid schedule shall define the contract line items. Work paid under one contract line item will not be paid for under any other contract line item. No separate payment will be made for the work, services, or operations required by the Contractor, as specified in PART 1 GENERAL, to complete the project in accordance with these specifications; all costs thereof shall be considered as incidental to the work.
1.2 PAYMENT INVOICE
Requests for payment shall be submitted in accordance with Federal Acquisition Regulation (FAR) Subpart 32.9, entitled "PROMPT PAYMENT", and FAR clauses 52.232-5 and 52.232-27, entitled "Payments Under Fixed-Price Construction Contracts", and "Prompt Payment for Construction Contracts", respectively, as well as DFARS Clause 252.232-7003, entitled “ELECTRONIC SUBMISSION OF PAYMENT REQUESTS AND RECEIVING REPORTS.” . Requests for payments to be made by DFAS shall be submitted via WIDE AREA WORK FLOW (WAWF). Requests for payments to be made by paying offices other than DFAS shall be submitted in the number of copies and to the designated billing office as indicated in the Contract.
1.2.1 WIDE AREA WORK FLOW: See DFARS Clause 252.232-7003
1.2.2 Prior to submitting your payment invoice request, ensure you have completed the following:
1.2.3 All submittals required for the period of performance of the invoice must be submitted and approved by the government.
1.2.4 CQC Daily Reports have been submitted to the Task Order Quality Assurance Representative (QAR) through the period of performance indicated on each invoice. Billing percentages MUST match the daily reports. Daily reports are not to be revised due to billing percentages;
the approved daily reports establish the accepted percentages for billing.
1.2.5 SF 1413 submitted for all subcontractors to the Task Order Contract Administrator prior to the start of any work.
1.2.6 Contractors on-site report for the period of performance specified in the invoice submitted to the Task Order Contract Administrator.
1.2.7 All Certified Payrolls with applicable apprentice documents must be complete and submitted to the Task Order Contract Administrator in electronic .pdf format only. Certified payrolls are required to be submitted monthly for its company and any subcontractor. Detailed instructions and required nomenclature for certified payrolls are located in Appendix A
1.2.8 The payment invoice requests shall include the following in order to be considered complete. Incomplete invoice requests will be returned disapproved. All electronic pdf documents shall be legible. All pdf pages must be readable upon opening the document. The pages should be straight without having to rotate the page.
1.2.9 WAWF checklist.
1.2.10 Contractor Invoice in tabular form with a Schedule of Values (SOV) breakdown showing major elements of work from the approved project schedule.

1.2.13 Release of Claims (for final invoice)
1.2.14 The payment requests shall be emailed to the Task Order procurement tech with a CC to the MICC Contract Specialist. Specific nomenclature of the email will be provided after award. Upon approval from DPW and Contracting, the contractor is then required to use Wide Area Work Flow (WAWF) to electronically submit invoice payment requests. The contractor is also required to submit the Release of Claims in WAWF for final invoice payment requests.
1.2.15 For approved invoice forms, input the invoice information into WAWF and send a WAWF-generated e-mail to the Task Order Contract Administrator and Inspector (Task Order COR). Failure to notify the Contract Administrator and the Inspector by the WAWF email will result in the rejection of the WAWF invoice and will require resubmission. For disapproved invoice checklists, make the necessary corrections and submit a new Progress Report and Invoice Form.
SECTION 01 30 00 ADMINISTRATIVE REQUIREMENTS

1.2 CONTRACTOR PERSONNEL REQUIREMENTS
1.2.1 Subcontractors and Personnel

1.2.2 Identification Badges
Identification badges, if required, will be furnished without charge. Application for and use of badges will be as directed. Immediately report instances of lost or stolen badges to the KO.
1.3 SUPERVISION
Have at least one qualified supervisor capable of reading, writing, and conversing fluently in the English language on the job site during working hours. In addition, if a Quality Control (QC) Representative is required on the contract, then that individual shall have fluent English communication skills.
1.4 PRECONSTRUCTION CONFERENCE
After award of the contract but prior to commencement of any work at the site, meet with the KO to discuss and develop a mutual understanding relative to the administration of the value engineering and safety program, preparation of the schedule prices, shop drawings, and other submittals, scheduling programming, and prosecution of the work. Major subcontractors who will engage in the work shall also attend.
1.5 ELECTRONIC FILE FORMATS
The Contractor shall establish and maintain the capability to open, create, and send all documents, including contract submittals in Microsoft Office (EXCEL, WORD, PROJECT, etc.), Adobe Acrobat (.pdf), and other similar formats.
1.6 ELECTRONIC MAIL (E-MAIL) ADDRESS
The Contractor shall establish and maintain electronic mail (e-mail) capability along with the capability to open and send various electronic attachments in Microsoft, Adobe Acrobat, and other similar formats. Within 14 calendar days after contract award, the Contractor shall provide the KO a single (only one) e-mail address for electronic communications from the KO related to this contract including, but not limited to contract documents, invoice information, request for proposals, and other correspondence. The KO may also use e-mail to notify the Contractor of base access conditions when emergency conditions warrant, such as hurricanes, terrorist threats, etc. Multiple e-mail address will not be allowed.
It is the Contractor's responsibility to make timely distribution of all KO initiated e-mail within its own organization including field office(s). The Contractor shall promptly notify the KO, in writing, of any changes to this e-mail address.
SECTION 01 32 01.00 10 PROJECT SCHEDULE

3.1 GENERAL
Pursuant to the FAR 52.236-15 Schedules for Construction Contracts, a Project Schedule shall be prepared for all task orders with duration greater than 60 days. The scheduling of construction shall be the responsibility of the Contractor.
3.2 BASIS FOR PAYMENT
The schedule shall be the basis for measuring Contractor progress. Lack of an approved schedule or schedule updates will result in an inability of the KO to evaluate Contractor progress for the purposes of payment.
