I. Contracting Activity.
(U) This document is a Justification for Other than Full and Open Competition under the authority of 10 U.S.C. 2304(c) (1), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements” as implemented by FAR 6.302-1. The contracting agency and organizational activity responsible for the proposed contracting action are identified below:

Nature and/or description of the action being processed.
This Justification and Approval document requests the approval Indefinite Delivery, Indefinite Quantity (IDIQ) contract incumbent contractor Gryphon Vallecitos Laboratory (GVL). The contract is required to obtain non-personal services for the processing and analyzing of particle for the Air Force Technical Applications Center (AFTAC) Trace Particle Analysis (TPA) mission. GVL has analyzed particle samples AFTAC for almost twenty (20) years
The period of performance 1 October 2020 through with an estimated cost of$48,5 .
(U) This contract will be a hybrid contract with Firm-Fixed-Price (FFP), Cost-Plus-Fixed-Fee (CPFF), and Cost Reimbursement (CR)/no fee Contract Line Item Numbers (CLINs) for particle analysis services.

10 U.S.C. 2304(c)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1, “Services are available from only one responsible source, and no other services will satisfy agency requirements ”
Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
Pursuant to FAR 6.302-1(a)(2)(iii), the services to be acquired are determined to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in substantial duplication of cost to the government that is not expected to be recovered through competition.
(U) The highly specialized services to be acquired are primarily concerned with separation, manipulation, analysis, and identification of particulate matter. Particle analysis requires the ability to: (a) be proficient in detection, isolation, and analysis of particles; (b) perform thermal ion mass spectrometry analysis; (c) perform nondestructive screening of particles; (d) perform elemental analysis; (e) maintain all processing areas and microscope clean rooms in accordance with the current General Services Administration standards for clean room and workstation requirements and maintain class 100 clean room techniques sufficient to ensure no cross-contamination between samples; (f) describe and characterize sample particle isotope information, morphologies, elemental and molecular compositions using all available analytical techniques; (g) maintain the capability to perform isotopic and elemental analyses via scanning techniques such as microscope and scanning electron microscope; and (h) maintain capability to process and analyze samples from surge of additional collections, as required. (U) This acquisition is for continued performance of highly specialized services. Only two contractors are known to be capable of performing the required services, GVL and McCrone Associates, Inc. (MAI).
The current contract workload of MAI maximizes their capacity, making them incapable of providing the services required in this acquisition. An increase in MAI's capacity can only be achieved by government or contractor investment in highly specialized, custom-built equipment that is not suitable for any other known sample analysis services, commercial or otherwise. MAI has not expressed the intent or desire to provide the required equipment in order to increase their capacity nor does the government intend to purchase any additional equipment to increase th capacity.
(U) AFTAC/SDBC believes that award to any other source would result in substantial duplication of cost to the government that cannot be expected to be recovered through competition and cause unacceptable delays in fulfilling the Air Force's requirements. When the additional laboratory was awarded to GVL as a result of the McClellan Central Laboratory (MCL) outsourcing, phase-in costs were $2.09M ($3.82M in current year dollars, escalated in accordance with Global Insight History from CY2000). Using this cost history to determine the anticipated costs if the current acquisition were to be competed is considered a valid estimating tool as the instrumentation required to be moved, and the laboratory facilities required for this effort would be the same as that required for the GVL competition. At the time the GVL competition was conducted, there was a work force of trained, experienced personnel who had performed the required services at MCL. With that workforce no longer available, additional costs for training would increase the costs substantially.
(U) In addition, the time to install and calibrate the special equipment would cause unacceptable delays in fulfilling AFTAC's mission requirements. Looking again to the GVL competition, because of the availability of trained, experienced personnel who had worked at MCL, the time involved in moving the in-house function from McClellan to GVL in 2000, approximately 12 months. If this effort was competed , the AFTAC program office estimates delay a new contractor trained personnel
(U) Accordingly, GVL is the only firm capable of providing services described in Section III above without the U.S.
Air Force experiencing substantial duplication of cost and unacceptable delays in fulfilling its mission requirements.
Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
(U) Small Business: Dynamic Small Business database search using NAICS code "541380" and " nuclear particle analysis services" did not produce any viable results.
(U) Based on the above , were determined to be capable of performing all the required services. Other searches resulted in educational institutions, libraries, foreign firms/universities, equipment manufacturers, and companies specializing in environmental pollution. None of these searches capability to perform nuclear particle analysis
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
(U)
Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
The market research was deemed sufficient accurate and valid to support a sole source acquisition for the analysis services. The market research concluded that no other qualified sources exist. See Section VI.
(U) As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition advis industry of the pending acquisition and solicit inquiries from interested parties.

The facility required to perform this contract must have and retain a DoD SECRET level facility security clearance.
Comm nication capabilities must be at the DoD SECRET level. All personnel, including technicians, must have a minimum DoD SECRET security clearance before commencing work on any portion of the requirement. Any new hire must be to the DoD SECRET level and such paperwork must be submitted immediately upon hir to be considered for work on the contract.
(U) The contractor must possess, or show the capability to obtain, a US Nuclear Regulatory Commission (NRC) Radioactive Materials License (or an agreement state license/permit, as applicable for the facility where work will be performed), prior to performance start.
(U) The contractor will be responsible for providing a suitable site totally dedicated to performance of contract requirements. Due to the potential of contaminating mission samples, analysis equipment and areas of any facility used for analysis services cannot be used for activities other than government work without the expressed written permission of the government program office and must be isolated f m other facilities doing nuclear work.

In order to perform this type of work, a contractor must possess or show capability to obtain a U.S. Nuclear Regulatory Commission (NRC) Materials license, prior to performance start.
