About this file
This is a Presolicitation notice for a two-phase design-build contract issued by the U.S. Army Corps of Engineers, Kansas City District. The project involves the design and construction of levee access manholes for the Fairfax-Jersey Creek Levee Unit on the Missouri River in Kansas City, Kansas. The contractor will be responsible for installing access manholes on existing seepage lines on the levee's landside slope and berm to facilitate regular inspection of the existing seepage collection system. Maximum hole depth is estimated at 25 feet, and all drilling and excavations must comply with USACE Engineering Regulation (ER) 1110-1-1807; invasive mass excavation methods such as trenching are prohibited, and only minimally invasive excavation methods are permitted to prevent levee destabilization. The estimated period of performance is 365 calendar days from notice to proceed, and the estimated contract magnitude ranges from $1,000,000 to $5,000,000.
The procurement will be conducted as a negotiated acquisition under RFO part 15 using two-phase design-build selection procedures. Phase 1 requires offerors to submit proposals demonstrating qualifications, with the government selecting the most highly qualified offerors to proceed to Phase 2. In Phase 2, selected offerors will submit technical and price proposals, and the government will award a single firm-fixed-price design-build construction contract to the offeror offering the best value using a tradeoff evaluation process. The NAICS code is 237990 for Other Heavy and Civil Engineering Construction. The solicitation will be available within 60 days of the notice, with Phase 1 proposals due at least 30 days after solicitation release. A site visit is planned with details to be included in the solicitation. Bid bonds of 20% of proposed price or $3,000,000, whichever is less, are required in Phase 2; payment and performance bonds of 100% are required before notice to proceed. Offerors must have active SAM registrations and register with the PIEE Solicitation Portal to submit proposals. No qualifications requirements under RFO subpart 9.2 apply, and all responsible sources may submit proposals.

Design and Construction of Levee Access Manholes for Fairfax-Jersey Creek Levee Unit (Kansas City, Kansas)
The U.S. Army Corps of Engineers, Kansas City District, intends to issue a two-phase design-build solicitation that will result in a firm-fixed-price construction contract for a requirement at the Fairfax- Jersey Creek Levee Unit on the Missouri River in Kansas City, Kansas.
This project will consist of design-build construction services to install access manholes on existing seepage lines on the levee. The contractor will be responsible for design and construction of manholes on the landside levee slope and berm. The access manholes are needed to facilitate regular inspection of the existing seepage collection system. Maximum hole depth is estimated to be 25 feet deep. The contractor will be required to conduct their own investigations and survey if they deem it necessary. Any drilling and/or excavations must be in accordance with USACE Engineering Regulation (ER) 1110-1-1807, Drilling and Invasive Activities at Dams and Levees. INVASIVE MASS EXCAVATION METHODS SUCH AS TRENCHING WILL NOT BE ALLOWED. Minimally invasive excavation methods are required, to minimize excavations left unattended for more than 24 hours, that would risk stability of the levee.
This acquisition will be conducted as a negotiated procurement in accordance with Revolutionary Federal Acquisition Regulation Overhaul (RFO) part 15, using two-phase design-build selection procedures as described in RFO 36.101-2 and other applicable authorities.
- In Phase 1 of the procurement, interested offerors will submit proposals demonstrating their qualifications to successfully execute the work. The Government will evaluate the offerors’ qualifications in accordance with the criteria described in the request for proposals (RFP) and will select the most highly qualified offerors to submit Phase 2 proposals.
- In Phase 2, a solicitation amendment will be issued only to the selected Phase 1 offerors, inviting them to submit a technical proposal and a price proposal. The Government will evaluate the proposals in accordance with the criteria described in the RFP. At the conclusion of Phase 2, the Government’s intent is to award a single firm-fixed-price design-build construction contract to the offeror whose proposal offers the best value to the Government using a tradeoff process considering the evaluation factors from both phases.
This procurement will be conducted using full and open competition. The applicable North American Industry Classification System (NAICS) Code is 237990 for Other Heavy and Civil Engineering Construction.
The estimated period of performance for completion of the awarded contract is 365 calendar days from the notice to proceed (NTP).
The estimated magnitude of this project, including all contract line items, is between $1,000,000 and $5,000,000.
The solicitation is expected to be available not less than 15 days of this notice, but within the next 60 days, and Phase 1 proposals are expected to be due at least 30 days after the solicitation release date unless solicitation amendments extend the due date and time. The due date and time will be specified in the solicitation. The due date and time for Phase 2 proposals will be specified in a subsequent amendment to the solicitation that will be issued only to the specific offerors who are selected for Phase 2.
There will be a site visit planned for this solicitation. The details to attend the site visit will be included in the solicitation.
Bid bonds will be required in Phase 2 in the amount of 20% of the offeror’s proposed price or $3,000,000.00, whichever is less. Payment and performance bonds will be required for the full amount (100%) of the awarded contract before NTP can be issued.
Contact information to submit technical inquiries and questions relating to the solicitation will be provided in the solicitation when it is made available.
Offerors must have an active registration in the System for Award Management (SAM) website prior to submitting proposals. Offerors may obtain information on registration and annual confirmation requirements at https://sam.gov. (Instructions for new registration can be found at the following link:
