PERFORMANCE WORK STATEMENT (PWS)

IN SUPPORT OF

JW Nixon High School JCLC 6-11 May 2024

Part 1 General Information

1. General: This is a non-personnel services contract to provide services to support the JW Nixon High School JCLC during the period of performance 6-11 May 2024. The Government shall not exercise any supervision or control over the contract service providers performing the services. Such contract service providers shall be accountable solely to the Contractor who, in turn, is responsible to the Government.

1.1 Description of Services/Introduction: This is a non-personal service(s) contract to provide lodging facilities, training facilities, meals services, furniture, equipment, supplies, medical services, tools, management, and labor as specified herein, for JW Nixon High School JCLC during the period 6-11 May 2024. The contractor shall provide services in accordance with the terms, conditions and specifications set forth in this PWS. The contractor shall perform to the standards in this contract.

1.2 Background: JCLC is an annual requirement for all JROTC units. Camp required must have the proven capability to provide lodging accommodations, meal service, transportation, medical support with specialized facilities and activity areas required to support the JW Nixon High School JCLC.

1.3 Scope: The contractor shall furnish facilities, furniture, equipment, supplies, management, supervision, and labor to provide lodging accommodations, meal service, transportation, and medical support as specified herein, for the JW Nixon High School JCLC for 150 Cadets and 20 Cadre from ten schools, 6-11 May 2024.

1.4 Objectives: The objectives of this contract are:

Provide Cadets an opportunity to test their leadership skills in an unfamiliar environment.

Allow Cadets a chance to participate in citizenship building exercises.

Give Cadets the opportunity to experience living and interacting with their peers from other JROTC units.

Instruct leadership-type skills to Cadets in a “hands-on” military-type environment.

Provide an opportunity to participate in adventure training not normally available to

Cadets.

Provide meals, lodging, and training facilities as specified in this PWS to ensure event is successful for Cadets and Cadre.

1.5 General Information:

1.5.1 Quality Control Plan (QCP): The contractor’s existing quality assurance system shall be utilized in accordance with FAR 12.208.

1.5.2 Quality Assurance: The Government will evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the acceptable quality levels (performance thresholds).

1.5.3 Recognized Holidays: The following provides information on recognized holidays for the purpose of the PWS. If submittal of any documentation (e.g. deliverables, submittals, etc.)

deadlines fall on a holiday, the closest workday prior to the holiday will apply as the deadline for submittal.

1.5.3.1 U.S. Holidays: Work shall not be performed on U.S. federally recognized holidays occurring during the normal workweek unless otherwise directed by the Contracting Officer.

When a U.S. holiday occurs on a Saturday or a Sunday, the holiday is observed on the preceding Friday or following Monday, respectively.

1.5.4 Operating Hours: The Government facility office hours, facility operating hours, and the Contractor support hour requirements often coincide, however, they may differ. Please refer to the following.

1.5.4.1 Government Facility Office Hours: Reserved

1.5.4.3 Contractor Support Hours: The contractor is responsible for providing all services between the hours of 0600hrs to 1800hrs from 6-11 May 2024, while providing reduced services between the hours of 1801hrs to 0559hrs. These reduced services should be able to provide the dinner meal and any medical or lodging concerns. JROTC instructors will provide overwatch during reduced service timeframes to ensure cadet safety and discipline. The Contractor must, always, maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS for the period stated. Contractors shall keep in mind that the stability and continuity of the workforce are essential.

1.5.5 Training Holidays: Reserved

1.5.6 Place of Performance: The work to be performed under this contract will be performed at an encampment that should be no more than 150 miles from all the schools utilizing the camp as transportation will be provided by the various school district’s transportation services.

Schools in the cluster come from locations all along the Rio Grande Valley to include, Edinburg, Mission, and extend all the to Laredo, Texas.

1.6 Security Requirements: The following information is provided on security related matters. Contractor personnel performing work under this contract do not require security clearance.

1.6.1 Physical Security: The Contractor shall provide a hardstand building to secure JROTC automation equipment.

1.6.2 Operations Security (OPSEC) Requirements: Reserved

1.6.5 Physical Security: The Contractor shall safeguard all Government equipment, information, and property provided for Contractor use.

1.6.6 Operations Security (OPSEC) Requirements: Contractor personnel shall adhere to facility security policies and restrictions. The Contractor shall immediately report suspicious activities to security personnel.

1.7 Key Control: Reserved

1.8 Post Award Conference/Periodic Progress Meetings: The Contractor shall attend any post award conference convened by the contracting activity or contract administration office in accordance with FAR Subpart 42.5. The Contracting Officer, COR, and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings the Contracting Officer will apprise the Contractor of how the Government views the Contractor's performance and the Contractor shall apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the Government.

1.8.1 The Contractor shall attend, participate in, and furnish input to scheduled and unscheduled meetings, conferences, and briefings that relate to the functions and services herein as required by the Government to provide effective communication and impart necessary information. The Contract Manager or designated representative shall attend meetings as requested by the Government. Meeting attendees shall at times include Contractor managerial, supervisory, and other personnel knowledgeable of the subject matter. Meetings may start or end outside of regular duty hours.

1.9 Contracting Officer’s Representative (COR): Refer to Part 2 of this PWS for the definition of a COR. As determined by the Contracting Officer, a COR will be appointed and identified by letter of designation, a copy of which will be provided to the Contractor by the Contracting Officer. The designation letter states the responsibilities and limitations of the COR, especially regarding changes in cost or price, estimates, or changes in delivery dates.

The COR is not authorized to change any of the terms and conditions of the resulting order.

The COR monitors all technical aspects of the contract and assists in contract administration.

The COR is not authorized to obligate the Government. If the work is not written in the contract, the COR is not authorized to request new work. The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract, perform inspections necessary in connection with contract performance, maintain written and oral communications with the Contractor concerning technical aspects of the contract, issue written interpretations of technical requirements, including Government drawings, designs, specifications, monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies, coordinate availability of Government property, and coordinate site entry of Contractor personnel.

1.10 Key Personnel: The following personnel are considered key personnel by the government: Camp Director. The contractor shall provide a camp director who will be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent will be designated in writing to the contracting officer. The camp director or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The camp director or alternate shall be available between 0600-2000, Monday through Friday except federal holidays or when the government facility is closed for administrative reasons.

1.11 Identification of Contractor Employees: All Contractor personnel attending meetings, answering Government telephones, and working in other situations where their Contractor status is not obvious to third parties must identify themselves, to include proper marking of signature blocks in correspondence, to avoid creating an impression in the minds of members of the public that they are Government officials. The Contractor shall ensure that all documents or reports, produced by Contractors are suitably marked as Contractor products or that Contractor participation is appropriately disclosed.

1.12 Contractor Identification Badges: Contractor personnel shall be easily identifiable through the display of badges IAW Contractor Identification (AE Reg. 27-715). (For services at Child, Youth, and School Services where children are present, recommend personnel wear identification when children are present.)

DEFINITIONS & ACRONYMS

2. Definitions and Acronyms

2.1 Definitions: Although not inclusive of every term used within this PWS, the following provides a list of definitions used throughout this PWS and commonly used in the acquisition field.

Contracting Officer – means a person with the authority to enter, administer, and/or terminate contracts and make related determinations and findings on behalf of the Government. Note:

The only individual who can legally bind the Government.

Contracting Officer's Representative (COR) – As defined in DFARS 202.101, means an individual designated and authorized in writing by the Contracting Officer to perform specific technical or administrative functions. DoD Instruction (DoDI) 5000.72, Part II Definitions states the following when defining a COR: “Defined in subpart 202.101 of Reference (f). Any individual delegated responsibilities pursuant to subpart 1.602-2 of Reference (e), regardless of local terminology, must be certified in accordance with this instruction. For example, local terminology can be COR, Contracting Officer’s technical representative, technical point of contact, technical representative, alternate COR, administrative COR, assistant COR, line-item manager, task order manager, quality assurance personnel, quality assurance evaluator, or COR management.” In addition, Army Regulation 70-13, Chapter 2, paragraph 2-2g, states, in part, the following when providing other surveillance support personnel to assist the COR when needed, “…These other surveillance support personnel may serve as on-site representatives of the COR in performance of actual contract surveillance if they meet all COR requirements and have been appointed by the Contracting Officer as alternate CORs.”

Contractor – means a supplier or vendor awarded a contract to provide specific supplies or service to the Government. The term used in this contract refers to the prime.

Day – means, unless otherwise specified, a calendar day.

Defective Service – means a service output that does not meet the standard of performance associated with the Performance Work Statement.

Deliverable – means anything that can be physically delivered but may include non-manufactured things such as meeting minutes or reports.

Government-furnished Property – As reflected in FAR 52.245-1, Government-furnished Property “means property in the possession of, or directly acquired by, the Government and subsequently furnished to the Contractor for performance of a contract. Government-furnished property includes, but is not limited to, spares and property furnished for repair, maintenance, overhaul, or modification. Government-furnished property also includes contractor-acquired property if the contractor-acquired property is a- deliverable under a cost contract when accepted by the Government for continued use under the contract.

Government Property - means all property owned or leased by the Government. Government property includes both Government-furnished and Contractor-acquired property. Government property includes material, equipment, special tooling, special test equipment, and real property. Government property does not include intellectual property and software.

Property Administrator - means an authorized representative of the Contracting Officer appointed in accordance with agency procedures, responsible for administering the contract requirements and obligations relating to Government property in the possession of a Contractor.

Physical Security – means that part of security concerned with physical measures designed to safeguard personnel; to prevent unauthorized access to equipment, installations, material, and documents; and to safeguard against espionage, sabotage, damage, and theft.

Quality Assurance – (or Government contract quality assurance) means the various functions, including, inspection, performed by the Government to determine whether a Contractor has fulfilled the contract obligations pertaining to quality and quantity.

Quality Assurance Surveillance Plan (QASP) – means the key Government-developed surveillance process document and is applied to Performance-Based Service Contracting (PBSC). The QASP is used for managing Contractor performance assessment by ensuring that systematic quality assurance methods validate that Contractor quality control efforts are timely, effective, and are delivering the results specified in the contract or task order. The QASP directly corresponds to the performance objectives and standards (i.e., quality, quantity, timeliness) specified in the Performance Work Statement (PWS). It provides specific details on how the Government will survey, observe, test, sample, evaluate, and document Contractor performance results to determine if the Contractor has met the required standards for each objective in the PWS. The QASP, with very few if any exceptions, is an internal Government document.

Quality Control – means all necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

Statement – means the specific results-based activities required to satisfy HLOs. A statement contains a result, the context of the statement, and the required action(s). Statements focus on “what” is to be accomplished; however, they are not prescriptive in describing “how” the outcome is to be achieved. Each HLO may have several statements to flush out the areas necessary to meet the objective. Statements are like Level 3 in a Work Breakdown Structure.

Subcontractor – means one that enters a contract with a prime Contractor. The Government does not have privity of contract with the subcontractor.

Workday - The number of hours per day the Contractor provides services in accordance with the contract.

Work Week - Monday through Friday, unless otherwise specified.

CONTRACTOR FURNISHED ITEMS AND SERVICES

4. Contractor Furnished Property and Services

4.1 General: The Contractor shall furnish meals, training areas, training activities, services, equipment, supplies, management, supervision, medical staff, and labor as specified to perform work under this contract that are not listed under Part 3 of this PWS.

4.2 Materials: The Contractor shall provide all expendable, durable, and non-expendable supplies that support JCLC training objectives, food services, lodging, medical services, and cleaning items for the utilized facilities. Specific requirements are outlined in the sections below.

4.3 Vehicles and Equipment: The Contractor shall provide two (2) Golf Carts for logistics support during camp.

4.4 Security: The contractor shall ensure that camp safety control devices are in place and operational. This includes gate control, lighting, and video surveillance measures.

4.5 Background Checks: Not applicable.

PART 5

SPECIFIC TASKS

5.1 Basic Services: The contractor shall furnish facilities, furniture, equipment, supplies, management, supervision, and labor to provide lodging accommodations, food service, two golf carts for internal camp transportation and medical support as specified herein for 150 Cadets and 20 Cadre attending the JW Nixon High School JCLC. The contract shall provide services in accordance with the terms, conditions and specifications set forth in this PWS.

5.2 Tasks: The contractor shall provide permanent-structure facilities with electrical power for in-processing, camp operations center in concert with lodging for our staff and Headquarters element, a 24-hour on-site First Aid Station/Health Center, and dining facilities, to include adequate cleaning supplies. Tasks consist of the following:

5.2.1 Lodging Requirements and Specifications: The contractor’s facilities shall meet the following minimum standards:

5.2.1.1 The contractor shall provide fixed-facility, climate-controlled housing with running hot water, toilets, showers, sinks, and personal space for 150 Cadets and 20 Cadre participating in JW Nixon High School JCLC.

5.2.1.2 The contractor shall provide non-smoking sleeping facilities that are furnished solely based on one individual to a bed/room. The contractor shall provide pillows, sheets, blankets, desk, trashcans, and working air-conditioning to each room.

5.2.1.3 The contractor shall provide Cadre with dual occupancy lodging with males separated from the females and one individual per bed. The contractor shall provide one bed, pillow, blanket, and appropriate linen for each person. Common space which will include bathrooms, desks, and trashcans shall be shared by the Cadre.

5.2.1.4 Facility shall not be undergoing renovation or remodeling during the time of the event.

The camp shall not be located within an area not considered a high crime area or designated a high crime area as determined by local police statistics.

5.2.2 Meal Requirements: Contractor shall provide meals for 150 Cadets and 20 Cadre from 6-11 May 2024.

5.2.2.1 Contractor will provide all food and condiments for use at each meal.

5.2.2.2 All meals shall be served hot.

5.2.2.3 Contractor will provide serving equipment, chafing dishes, heating elements to maintain food temperature, serving utensils, disposable plates, cups, napkins, and utensils for each meal.

5.2.2.4 Contractor will wipe down and sanitize all tables at serving location as well food preparation area and equipment.

5.2.2.5 Contractor shall set-up all food and serving area, tables, chairs, and other equipment a minimum of 30 minutes prior to each meal start time as coordinated with the Government

POC.

5.2.2.6 The contractor shall deliver the dinner meal items on 10 May 2024, to a covered pavilion large enough to accommodate 170 people eating at once.

5.2.2.7 The contractor shall complete all site set-up and tear down before, during, and after all events. All events shall be prepared according to the objectives of the task 30 minutes prior to scheduled start times.

5.2.2.8 Contractor shall provide unlimited amount of drinking water during the JCLC. The contractor shall provide 12 ten-pound bags of ice each day from May 6-10. This ice shall be delivered daily, no later than, 0800 to a location determined by the Government POC. No ice will be needed on May 11 as it is the final day and units leave immediately following breakfast and the recovery of their equipment.

5.2.2.9 Mealtimes: The Contractor shall serve meals during the times indicated below:

5.2.2.10 Menus: The contractor shall provide a menu like the following for each meal. The menu shall be coordinated with the Government POC, which is the JW Nixon High School JCLC Camp Commander, a minimum of 10 calendar days prior to the event and any changes agreed upon at that time.

5.2.3 Training: Contractor shall provide training facilities with certified instructors for all training events to include tower operations and water sessions. Contractor shall provide appropriate, safe, and certified training facilities, areas, and personnel as follows:

5.2.3.1 The contractor shall provide one (1) safe and maintained swimming pool with both shallow and deep areas capable of accommodating 35-40 cadets at a time, all with diverse swimming skill levels as well as adequate, certified lifeguards.

5.2.3.2 The contractor shall provide a water course for canoeing with certified lifeguards.

5.2.3.3 The contractor shall provide an outdoor archery range large enough to accommodate 25 students on a rotational basis. The equipment to be used will be supplied by various schools attending the JCLC.

5.2.3.4 The contractor shall provide make every effort possible to allow the cadets to utilize the covered areas in the event of inclement weather.

5.2.3.5 The contractor shall provide an outdoor training area capable of accommodating 40 Cadets. This area shall include a pit designed for the creation of a survival fire to be used for lessons on survival training techniques.

5.2.3.6 The contractor shall provide an outdoor open field of at least 110 meters by 110 meters for land navigation training. This area can include wooded areas as that is emphasizes the importance of proper navigation techniques.

5.2.3.7 The contractor shall provide at least one softball field.

5.2.3.8 The contractor shall provide an outdoor group game infrastructure area for “ga-ga ball”, flag challenge”, and space for running relay-style competitive games.

5.2.3.9 The contractor shall provide “high ropes” and “low ropes” venues for Cadet leadership and confidence building. The contractor shall ensure all necessary equipment is available to complete the high and low rope training during the duration of the JCLC.

5.2.3.10 The aquatics, “high-ropes” venues, “low ropes” venues, and archery/marksmanship venue shall include contractor-provided safety/trainer personnel in adequate numbers to train approximately 150 Cadets in each respective event/activity.

5.2.3.11 Contractor shall provide two (2) portable latrines at each remote training location where permanent bathroom facilities are not readily accessible with toilet paper and cleaning services. Contractor shall coordinate with JCLC Camp Commander for placement. Examples of such training sites may include land navigation courses, marksmanship range, tower operations and water session areas.

5.2.4 Medical: The Contractor shall provide a 24-hour fully supplied, fixed, dedicated, climate-controlled health center/First Aid Center with full-time, on-site, contractor-provided registered nurse.

5.2.5 Shelter: The Contractor shall make the dining facility and equipment available from 6-11 May 2024. In the event of inclement weather, it will also be used as a shelter. Inclement weather equipment includes lightning protective shelters, dining facility, and other structures.

5.2.6 Security: The contractor shall ensure that all safety control measures are in place and functioning properly to include but not limited to gate control access points, lighting throughout the training area and sleeping quarters.

5.2.7 Courtesy: The contractor's employees shall be courteous to all persons served under this contract. Courtesy rendered shall be equal to that rendered to other customers of the establishment and equal to that expected of any public lodging facility. Services and consideration provided to other guests shall be provided to event participants.

5.2.8 Contractor Personnel Attire: Contractor personnel shall wear clothing that is clean and does not contain statements that may be offensive to others.

5.2.9 Miscellaneous Services: The contractor shall not be responsible for any miscellaneous charges incurred by the event participant. The contractor shall explain to the participant that miscellaneous services are not covered by this contract and are payable by the participant, such as personal telephone charges and meals more than the contract requirements, and other such services.

5.2.10 Contractor shall provide all cleaning supplies.

5.2.11 Taxes. The government is exempt from paying any sales taxes related to this contract.

Tax exemption forms will be provided to the contractor upon request.

5.2.12 Fire and Safety. The contractor’s facility shall comply with applicable fire and safety codes and regulations.

The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success.

PWS Para. 5.2 The contractor shall provide housing for 150 Cadets and 20 Cadre are participating in the JCLC 6-11 May 2024, Housing must include one bed/cot per individual. The contractor shall also make available 24-hr medical coverage facilities.

Billets provided with beds in separate bunk houses to accommodate females and males separately with all necessary hygiene facilities.

Is not undergoing renovation or remodeling during the time of the camp and not located within an area considered a high crime area or designated a high crime area as determined by local police statistics. The contractor’s facility shall comply with applicable fire and safety codes and regulations.

Meals served are nutritious, hot, filling, and of appropriate temperature in accordance with Oklahoma State Food Service standards.

The contractor shall set-up all food and serving equipment prior to each meal start time as coordinated with the Government POC a minimum of 30 minutes prior to each serving time. Meals shall be served on time. The contractor shall serve meals during the times indicated below.
