Performance Work Statement (PWS)

HVAC Automated Logic Controls (ALS)

Fort Leavenworth, KS

1. Introduction. This is a non-personal services contract to provide the United States Army Military Installation Fort Leavenworth, Kansas with Heating, Ventilation and Air Conditioning (HVAC) Automated Logic Systems (ALS). The Government will not exercise any supervision or control over the contract service providers. The Contractor shall perform to the standards specified in this Performance Work Statement (PWS) using industry standard, best practices in order to provide a minimum common level of service showcasing best possible value to the Government.

Sub-Contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.1 Background. The HVAC Automated Logic Systems require updates, upgrades and data systems control software securely backed up on a monthly or more frequent basis as necessary to ensure the system is secure, working properly and can be recovered into the last stable state as needed to affect conservation of energy as appropriate, by design, and as directed by the Chief, Energy Division of the Directorate of Public Works (DPW). This system assists the Directorate of Public Works Energy Division, and the Operations & Maintenance Division (OMD), HVAC sections to effectively control heating and air conditioning while the individual facilities and buildings are both occupied and unoccupied, to leverage realized savings and a baseline working environment while preserving the facilities in proper working order and functionality. The systems are broken into two (2) groups separated by network for the purposes of this contract. Main Post Group, and MCC Group. The Main Post Group consists of all covered facilities that are located on the Fort Leavenworth installation excluding the MCC Group area of operations (AO) that is comprised of facilities numbered in the 11xx range.

1.1.1 Climate Conditions. The average annual rainfall is forty (40) inches. The average annual snowfall is thirteen (13) inches. The average annual maximum and minimum temperatures are approximately forty-two (42) and sixty-five (65) degrees Fahrenheit, respectively. Monthly normal temperatures ranged from a low of sixteen

(16) degrees in the month of January to a high of ninety-six (96) degrees in the month of August. Summer temperatures often reach ninety (90)+ degrees Fahrenheit, while sub-freezing (below 32 degrees F) weather is common during the winter months.

1.1.1.2 Description. The Contractor shall provide all personnel, equipment, supplies, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform Automated Logic Services (ALS) as defined in this Performance Work Statement (PWS), except for those items specified as government furnished property and services listed in paragraph 7.1 if applicable. The Contractor shall perform to the standards in this contract.

1.2 Objectives. Contractor shall keep and maintain the HVAC Controls Automated Logic System with updated programming, software system maintenance, creating and applying software corrections to the installed or operational systems which shall assist Fort Leavenworth in saving energy by way of controlling the HVAC systems in the facilities in such a manner as to maintain environmental heating and air conditioning accurately, with the intent to provide an acceptable working environment for employees while affecting reasonable conservation of energy and resources, in a manner consistent with applicable laws, regulations and policy.

1.3 Scope. Contractor shall provide at a minimum monthly, inspections, testing, and troubleshooting of all major software version updates, services packs, patches, hardware drivers and any other updates required to keep the Automated Logic system software and hardware up to date, current and fully operational. This service will include all the software and personnel required to update the system as required.

All updates or changes to the updates shall be scheduled in advance with the Directorate of Public Works (DPW) OMD, HVAC Section supervisors for both Groups.

The system shall be backed-up on the local web server in its entirety prior to any updates or changes to the systems using standard naming conventions that include the date/time of the backup. The contractor shall review all alarm and system logs and provide a report on all abnormalities, or readings that require, or are in need of attention or corrections. The system log shall also list all monthly updates and backups that were performed by date/time of, and a descriptive name of each entry and a summary of changes updates or errors encountered or applied.

1.4 Period of Performance. The performance period for this contract will be one (1) base year, with one (1) option years.

1.4.1 Federal Holidays. The contractor shall not regularly perform work on the following holidays except as provided under exceptions listed below (para 1.4.2).

The last weekday preceding or first weekday following a Federal Holiday may be designated by the local Commander with autonomous authority over their facilities as a “Training Holiday” and may result in limited or no available manpower to allow access to said facilities. It is incumbent upon the Contractor to be aware of the potential for no access issues on workdays adjacent to the Federal Holidays on “training Holiday” days, and schedule work appropriately. 1.4.2 Hours of Operation. The Contractor is responsible for conducting business between the hours of 0730-1630 hours Monday through Friday excluding Federal holidays, or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings.

The Contractor must always maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. All work anticipated to be performed outside of the above regular work hours must be accepted by the HVAC Section Supervisor/Chief in writing, in advance of the work being performed and if that out of work-hours work being performed would reasonably result in “after hours” fees or charges being levied against the government, the KO must approve such work in advance.

1.4.3 Place of Performance. The work to be performed under this contract shall be performed on Fort Leavenworth Kansas at facilities listed in TE 02 as appropriate.

1.5 Quality Control Program (QCP). The Contractor shall develop and maintain an effective QCP to ensure services are performed in accordance with (IAW) this PWS. The QCP must be forwarded to and accepted by the KO with a copy provided to the COR and the HVAC Section Supervisor. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of deficiencies. The Contractor’s QCP is the means by which the Contractor assures that the work complies with the requirement of the contract. The QCP is to be delivered within thirty (30) days after contract award. One electronic copy of a comprehensive written QCP shall be submitted to the KO and COR within five (5) working days when changes are made thereafter. After acceptance of the QCP the Contractor shall receive the KO’s acceptance in writing in advance of any proposed change to the QCP.

1.5.1 Quality Assurance Surveillance. Government surveillance of contractor performance is not limited to the Performance Objectives as outlined in this PWS. The Government reserves the right to conduct compliance surveillance of any contractual requirement at any location of this acquisition.

1.6 Installation and Facility Access. It is the Contractor’s sole responsibility to ensure their employees can qualify for, and maintaining credentialed access to the Fort Leavenworth military installation, and any facilities within the installation, should the Contractor need physical access to systems and/or facilities to perform work required within this contract’s execution. Not having properly cleared or badged personnel does not absolve the Contractor of any work or performance requirements, as required by this contract. The MCC Group facilities have additional security requirements for access to their secured facilities, see TE 01- Military Corrections Complex Security for details.

The appropriate HVAC Section Supervisor may assist the Contractor with issues regarding physical access as well as the COR upon request.

1.6.1 Key Control. Key & Access Control is the responsibility of the DPW HVAC Section chiefs or personnel assigned within the HVAC section to provide access to locked or restricted facilities or rooms covered under this contract.

1.7 Emergency Services. The Contractor shall have competent personnel capable of dealing with minor personnel injuries. The Contractor or their employees shall immediately notify their supervisor of any accident requiring emergency medical treatment. The Contractor shall, in turn, notify the KO or COR within 30 minutes of the incident, with pertinent details of the incident/injury (name of injured person(s), location of accident/injury occurring, type and severity of injury, actions taken and expected outcome), include a copy of the police/MP report if one was made, with personally identifiable information (PII) redacted (SSN, address, driver license. # Etc.). Emergency medical treatment and services for Contractor personnel is the sole responsibility of the Contractor.

The Contractor shall be solely responsible for the emergency medical treatment services for Contractor personnel.

2. Post Award Conference/Periodic Progress Meetings. The Contractor shall attend the post award conference convened by the contracting activity or contract administration office IAW FAR Subpart 42.5. The KO and COR/ACOR may meet quarterly, or more or less frequently as directed by the KO, with the Contractor to review the Contractor's performance. Written minutes of meetings will be recorded by the Government. The written minutes will be distributed within five (5) workdays after the meeting. If the Contractor does not concur with any portion of the minutes, recorded by the Government, the non-concurrence shall be provided in writing to the KO within two

(2) workdays following receipt of the minutes.

2.1 Contracting Officer (KO). The KO is the only person authorized to direct changes in any of the requirements under this contract, and, notwithstanding any provisions contained elsewhere in this contract, said authority remains solely with the KO. In the event the Contractor makes any change at the direction of any person other than the KO, the change shall be considered to have been made without authority and solely at the risk of the Contractor. All contract administration will be affected by the KO.

Communications pertaining to contractual administrative matters shall be addressed to the KO. No changes in or deviation from the terms and conditions shall be affected, without a written modification to the contract, executed by the KO authorizing such changes. The KO will approve all submittals and plans required in this PWS.

2.2 Contracting Officer’s Representative (COR). The KO will appoint a COR during the performance of this contract. Service Acquisitions. Other surveillance personnel may be designated as COR or ACOR, and shall be trained and appointed IAW DoDI 5000.72, DoD Standard for Contracting Officer’s Representative (COR) Certification and DFARS 201.602-2. The ACOR will serve as on-site representatives of the COR in performance of actual contract surveillance, if they meet all COR training, experience requirements, and are appointed by the KO as an ACOR. The COR/ACOR will aid in identification and resolution of problems, conflicts in priority, subtask requirement definitions, and other operations type problems. The COR/ACOR will perform IAW the responsibilities and duties identified in the appointment letter.

2.3 Contracting Officer’s Technical Representative (COTR). The KO will assign one or more COTR’s as necessary to provide the Contractor technical expertise regarding the subject of this contract work. The COTR does not have authority to change any aspect of this contract, or negotiate or change prices, times, schedules, or work. The COTR can provide technical answers or assist in locating, accessing/coordinating with facilities end-user’s as needed or requested by the Contractor. COTR(s) will be identified during the Post-Award meeting and may be changed at any time afterwards without notice. Questions regarding these may be directed to the KO or COR for clarification.

2.4 Identification of Contractor Employees. All contract personnel attending meetings, answering Government telephones, and working in other situations where their Contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by Contractors are suitably marked as Contractor products or that Contractor participation is appropriately disclosed. Contractors shall be required to wear company shirt, or a company provided badge clearly identifying themselves as contractors and the company they work for, always while performing work under this Contract on the Fort Leavenworth Kansas installation.

2.4.1 Contractor Personnel Conduct. Contractor personnel’s conduct shall not reflect discredit upon the Government. The Contractor shall ensure that all personnel present a professional appearance. The Contractor’s employees shall observe and comply with all local policies and procedures concerning fire, safety, environmental protection, sanitation, security, and possession of firearms or other lethal or illegal weapons or substance. The Contractor is responsible for ensuring that any contractor employees providing services under this contract conduct themselves and perform services in a professional, safe, and responsible manner. The Contractor shall remove from the job site any employee for reasons of misconduct or security. In accordance with DOD Directive 5500.7-R, “Joint Ethics Regulation”, Contractor employees must avoid improperly influenced in the execution of their duties under the contract.

Particular attention should be paid to acceptance of gifts/ gratuities, and on non-disclosure of sensitive or classified information. The Contractor shall ensure employee conduct complies with 41 U.S.C 423 relative to release of acquisition related information or actions or discussions which may prejudice future competitions. 2.4.2 Organizational Conflict of Interest (OCI). Contractor and subcontractor personnel performing work under this contract may receive, have access to, or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications, or work statements, etc.), or perform evaluation services which may create a current or subsequent OCI as defined in FAR Subpart 9.5. The Contractor shall notify the KO immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the KO to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the KO, and in the event the KO unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the KO may affect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.

2.4.3 Legal Status. All Contractor employees performing work under this Contract shall be legal U.S. residents. The Contractor shall immediately remove any employee that is not a legal U.S. resident. All Contractor personnel shall be able to communicate clearly in the English language.

2.4.4 Common Access Credential (CAC). All employees performing work under this Contract must apply for, be issued and maintain all required qualifications to be issued a CAC for the duration of this Contract’s Period of Performance (PoP). At the time of Contract award, and prior to work start, all Contractor employees performing work under this contract must present themselves in-person to the DPW, BOID, Operations Officer (913-684-8944) located in Building 85, 820 McClellan Ave, Fort Leavenworth, Kansas, to submit a request for issuance of a CAC, and apply for access to the NIPR Network (see TE 06A – System Access Request DD form 2875) with appropriate forms of identification and certification.

2.4.5 Motor Vehicles and Operator Requirements. Contractor’s personnel, whose tasks involve operation of any vehicles, shall possess a valid driver’s license, certificates, and permits applicable for the type and class of vehicle being operated. The Contractor shall register all Contractor-owned or operated vehicles and trailers operating on the installation within fifteen (15) working days of contract start date. The Contractor shall complete all applications with the Provost Marshal Vehicle Registration section located in the Visitor Control Center (VCC). Evidence of vehicle ownership and vehicle liability insurance must be presented upon application of vehicle registration and reported to the COR within two (2) workdays of completion.

2.5 Special Training Requirements. To affect a secure and safe environment on military installations, various authorities within the Department of Defense (DOD) and the Department of the Army (DA) have implemented requirements https://www.acquisition.gov/far/part-9#FAR_Subpart_9_5 for all Government Contractors to be briefed on, be presented, attend training, and achieve appropriate certifications as a condition of employment, Contract award or access to the installation, or facilities within the installation. These requirements are listed below and are subject to change without notice.

2.5.1 iWATCH. The Contractor shall brief the local iWATCH program (training standards provided by the RA’s Anti-Terrorism Officer (ATO)) as TE iW – iWatch Training for Contractors, to all the Contractor’s employees and associated subcontractors working under this Contract. This training is used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR/ACOR. The Contractor shall complete the training within thirty (30) calendar days of contract award and within five (5) calendar days of new employees commencing performance with the results reported to the COR/ACOR NLT thirty (30) calendar days after contract award.

2.5.2 Anti-Terrorist Level I (AT Level I). All contractor employees, to include subcontractor employees, requiring access Army installations, facilities and controlled access areas shall complete AT Level I awareness training within thirty (30) calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable and annually thereafter. The contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the COR or to the contracting officer, if a COR is not assigned, within five (5) calendar days after completion of training by all new employees and subcontractor personnel. 2.5.3 OPSEC. Per AR 530-1 Operations Security, the contractor employees must complete Level I OPSEC Awareness training. All employees must be trained within thirty (30) calendar days of their reporting for duty, or contract award, and annually thereafter. 2.5.4 Information Assurance (IA)/Information Technology (IT) Training. All contractor employees and associated sub-contractor employees must complete the DoD IA awareness training before issuance of network access and annually thereafter.

All contractor employees working IA/IT functions must comply with DoD and Army training requirements in DoDD 8570.01, DoD 8570.01-M and AR 25-2 within six months of employment.

2.5.4.1 Information Assurance (IA)/Information Technology (IT) Certification.

Per DoD 8570.01-M, DFARS 252.239.7001, and AR 25-2, the contractor employees supporting IA/IT functions shall be appropriately certified upon contract award. The baseline certification as stipulated in DoD 8570.01-M must be completed upon contract award.

3. Performance Requirements and Standards. This service Contract provides for the creation of, and all software version upgrades, service packs, patches, hardware drivers and any other updates minor or major required to keep the Automated Logic System Software and Hardware up to date and current on a monthly basis. This service includes the cost of the software and provides for the contracted personnel to update the system as required. Any updates that change or enhance the usability of the system will be scheduled with the government personnel in advance. The contractor will back up the Automated Logic System files and databases to the local web server as well as transfer a copy off site for storage at the Contractor’s facility. The contractor will provide a removable media device attached to Fort Leavenworth’s local web server that the backups will be stored on for recovery purposes, if a current remote back up does not already exist. The contractor will review the alarm and system logs and provide the government with a report on anything that is found to be abnormal or needing attention as well as a list of all monthly updates and backups that were performed.

3.1 Technical Phone Service (816) 600-5850. The contractor shall also provide technical phone service Monday – Friday from 0800-1700hrs. This service will provide troubleshooting support as well as assistance in configuring or setting up changes and answering questions about the system. If this does not fix the problem, a technician will be sent to resolve the issue during normal duty hours the next workday.

3.2 Emergency Technical Support Services. Technical support will be available 24 hours a day 7 days a week, however additional cost will be charged for any calls before 0800 and after 1700hrs, or on weekends and Federal Holidays as listed in paragraph 1.4.1 above and requirements for approval in paragraph 1.4.2.

3.3 Preventative Maintenance (PM). Contractor technicians shall be on-site monthly during normal duty hours performing hands on inspections of the control hardware and software for all facilities and systems under this contract, facilities listed in TE – 02 Facilities List. This will consist of testing or observing for abnormal conditions, alarms, and other ALC related issues and addressing those issues as detailed by the HVAC Section operators for that period. This Preventative Maintenance (PM) and deficiencies will be documented in detail in a logbook maintained on location at:

3.4 Troubleshooting. At any time during preventive maintenance, inspections, or notified by a stakeholder of an issue, as listed above, a discrepancy or abnormal result or behavior of the ALS is discovered, the technician shall make every effort to troubleshoot the issue in order to discover the root cause or condition that directly or indirectly resulted in the abnormal condition discovered and report the proposed solution or fix to the HVAC Section chief or representative, stakeholders and make appropriate annotations and notes in the HVAC logbook.

3.5 Reports. In addition to maintaining a comprehensive logbook regarding visits of inspections and PM, the technician making site visits shall upon completion of each site visit, and within five (5) work days of each visit, send an electronic summary (email) of findings that include at a minimum, the building number and name (TE -02) of the facility, systems inspected/PM checks, results of inspection/PM, status of systems (e.g. online, offline, inoperable, codes, etc.), recommended repairs, fixes, or upgrades to the systems or subcomponents that shall also include trending discrepancies or issues that remain unresolved from month to month to the assigned COR and Government stakeholders below.

Names and emails for stakeholders will be provided at the post-award conference or as personnel or requirements change.

4. Performance Requirements Summary (PRS) Matrix. The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success.

3.4 Troubleshooting

(TS)

At any time, the ALS system is not operating as intended, the technician shall be required to troubleshoot the systems in their entirety to discover causation.

Non-conforming services will result in Non- Conformance Reports issued to Contractor and potential negative CPARS report.

5. Deliverables Schedule Matrix. This matrix is provided as a tool to assist both the Contractor and Government personnel and stakeholders in creating and tracking product as required under this Contract and PWS. As such, it does not preclude any other requirements listed elsewhere in this document or Contract and therefore may not be complete. If a requirement for a deliverable product is listed elsewhere, the absence of such in this matrix does not excuse the Contractor from submitting that product accurately and completely within the period required.

Log’s, lists, and notes may be consolidated onto one device or consolidated into one deliverable and be all inclusive, each type of annotation must be made clear of its type, report, pm, troubleshooting etc.

7. Government Furnished Equipment. The Government will not issue any equipment to the Contractor for use under this Contract. The Main Post Group HVAC Shop may allow the Contractor to sign for Government Information Systems Laptops daily, at the discretion of the HVAC Section Supervisor for use on a daily basis as normal operating procedure.

7.1 Government Furnished Facilities. The Government will not issue or provide separate facilities or workspace for the Contractor’s sole use, however, each of the two (2) HVAC Sections; Main Post and MCC Group, may allow the Contractor physical space in their respective shops, or controlled spaces for the Contractor’s work as it relates to this Contract at the discretion of the individual HVAC Section Supervisor upon request of the Contractor.
