About this file

This document is a Memorandum for Record (MFR) regarding a non-competitive award under FAR Part 13 Simplified Acquisition Procedures for Line of Sight (LoS) software and support services. The contract requires a software tool compatible with MicroStation and Autodesk Civil 3D engineering software, as well as help desk support and training. The incumbent contractor's software did not meet the expanded requirements, so a sources sought was issued. Poly Inc. was determined to be the only source reasonably available, as their RangeSight software is currently the only tool that operates independently of MicroStation and is integrated with ESRI's ArcMap program. The contracting officer determined it was in the government's best interest to award a firm-fixed price contract to Poly Inc. for $134,457.04 on September 29, 2024.

MEMORANDUM FOR RECORD

SUBJECT: Non-Competitive Action under FAR Part 13, Simplified Acquisition Procedures at or below the Simplified Acquisition Threshold, Line of Sight Software Tool and Support Services

1. Authority: FAR 13.106-1(b)(1).

Pursuant to FAR 13.104, the contracting officer must promote competition to the maximum extent practicable from the source whose offer is the most advantageous to the Government, considering the administrative cost of the purchase. However, in accordance with FAR 13.106-1 (b)(1), the contracting officer may solicit from one source if the determination is made that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization) for purchases not exceeding the Simplified Acquisition Threshold (SAT). This memorandum addresses the Contracting Officer’s determination to award a procurement action on a non-competitive basis utilizing FAR Subpart 13, Simplified Acquisition Procedures (SAP).

2. Description of Services & Background

This acquisition is for the purchase of Line of Sight (LoS) software support that includes delivery of a software tool that is compatible with terrain/surface and geometry data originated using MicroStation based engineering software (Bentley OpenRoads Designer CONNECT Edition) and Autodesk Civil 3D engineering software. Additional requirements include help desk support and training.

These services were previously acquired under contract number W912DY22C0039 however, under this contract there is no requirement for compatibility with Autodesk Civil 3D engineering software. The Range and Land Program (RTLP) Mandatory Center of Expertise (MCX) at the Huntsville Center now requires compatibility with Autodesk Civil 3D engineering software in order to meet its mission. For this reason, the Government determined it is in its best interest to resolicit for a software tool that is compatible with MicroStation engineering software and Autodesk Civil 3D engineering software.

3. Considerations & Solicitation

In accordance with FAR 13.106-1(b), the Contracting officer considered the following when selecting Poly Inc. for award. A sources sought notice was published to the GPE on July 1, 2024, with responses due no later than July 15, 2024. The RTLP MCX reviewed responses to the sources sought from 9 interested companies and there is no evidence to indicate any company other than Poly Inc. has a suitable product at this time that will meet the current needs of the Army. Poly Inc.’s RangeSight software is currently the only software tool that operates independently of MicroStation-based civil engineering software. Poly Inc’s software tool is integrated within ESRI’s ArcMap program, making it versatile and compatible with both MicroStation and AutoCAD environments. This flexibility allows civil designers to work in either software and seamlessly transfer derived data for the LoS analysis. Based upon this, the Contracting Officer determined that competing this requirement is not advantageous to the government.

4. Determination Based upon the foregoing, the Contracting Officer determined Poly Inc. is the only reasonably available source to meet the Army’s requirement and that it is in the Government’s best interest to solicit, negotiate if necessary, and award a purchase order to Poly Inc.
