4. Authority:
FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.
5. Reasons for Authority Cited:
Services can only be provided from the original source as this is a follow-on requirement for the continued provision of highly specialized services. The previously identified items are needed to maintain an essential capability for engineering or developmental work calling provided by a non-profit institution.
Society of Hispanic Professionals and Engineers (SHPE) is the sole source for this type of event and is an integral part of the strategic plans for U.S. Army Test and Evaluation Command (ATEC). It is an opportunity to generate interest in the Army and ATEC along with increase awareness about the Army’s education, career, high-technology, and leadership opportunities through a synchronized and coordinated ATEC-wide effort. In addition, this event is mission critical for Army recruiting and advertising mission; if the requirement is disapproval or delayed, it will adversely affect the mission of the Army. Without the ability to attend events where prospects and influencers are located, such as the SHPE, the Army will be unable to fill critical STEM vacancies in order to grow and diversify our future STEM workforce. The absence of ATEC at the SHPE Career Fair and College Expo Conference will hinder the organization’s Equal Opportunity Outreach and recruitment mission. SHPE Career Fair and College Expo contributes to increasing diversity in the ATEC’s workplace through outreach and program, particularly in the STEM career fields.
If U.S. Army Test and Evaluation Command (ATEC) does not receive the previously identified request on time, it will lead to a failure in support of a diverse workforce. The Department of the Army (DA) established the Army Diversity Roadmap to set a clear and concise direction that will better position Army to recruit, develop, and retain the most gifted people our nation has to offer.
SHPE is the sole event sponsor and organizer. The inability of ATEC to award a contract to SHPE will negatively impact the ability to recruit and retain and diverse workforce.
6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 do not apply due to the threshold exception at 5.202(a)(13), “Is for an amount not expected to exceed the simplified acquisition threshold”.
7. Market Research: Market research was conducted by Christina Bryant utilizing web searches for the proposed acquisition. It’s determined that only one responsible source, SHPE, can satisfy
ATEC’s requirement. The agency shall continue to conduct market research on an ongoing basis to determine if any new sources capable of satisfying the agency’s requirement exist.
8. Procurement History: This order is a new requirement.
9. Technical/Requirements Certification: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.
10. Contracting Officer Certification/Approval:
I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable based upon cost analysis of each item being procured.
I certify that this justification is accurate and complete to the best of my knowledge and belief, and that completing this purchase as a sole source is in the best interest of the Government. Additionally, I approve this justification to limit competition subject to the availability of funds and provided that the services or supplies herein described have otherwise been authorized for acquisition.
