This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

This solicitation is issued as a Request for Quote (RFQ). Submit written quotes referencing document number P16PS00855 in accordance with the instructions in this announcement

This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-79.

This solicitation is being issued as a Total Small Business Set-Aside. The associated NAICS code is 111940. The small business size standard is $750,000.

Description: Summer feed for Eastside District (ESD) and Colorado River District (CRD) stock of Rocky Mountain National Park. 11 bales a day are fed for approximately 6 months out of the year when needed.

Item: Certified Weed-Free Hay; Grass/Alfalfa mix (approx. 50/50)

Specifications:

1. Certified Weed-Free Hay; Grass/Alfalfa mix (approx. 50/50)

2. Hay should be baled at 12-15% moisture content.

3. Small square bales (approximately 70-75 lbs. average weight)

4. Protein content 12-14%

5. Quality: horse quality hay with less than 2% of bales with mold or other imperfections

6. Hay should be free of Timothy

7. Bales should be approximately 70-80 lbs with dimensions of 36”x18”x16”

8. A nutritional analysis of the hay shall be provided to determine the nutritional value of the hay which will help the park in determining if a nutritional supplement is needed.

Barn Locations: Hay will be delivered to 2 different locations for the park’s stock operations: Estes Park, CO (ESD or east side operations for RMNP) and Grand Lake, CO (CRD or west side operations of

RMNP).

1. ESD Barn – 863 Sundance Circle Drive, Estes Park, CO 80517

2. CRD Barn – 211 Country Rd 491, Grand Lake, CO 80447

Quantity: This is an indefinite delivery indefinite quantity (IDIQ) order, with a guaranteed minimum quantity to be purchased listed below:

- 1920 bales for the East Barn (anticipated delivery of August and September)

- 530 bales for the CRD Barn (anticipated delivery of June and September)

The maximum that may be purchased under this order is 3,000 bales with the following schedule:

- Additional 350 bales delivered to the ESD Barn

- Additional 200 bales delivered to the CRD Barn

All quantities ordered under this IDIQ shall be delivered at the original quoted price.

Delivery: Delivery should be made during regular operations periods and coordinated through the vendor and either the Lead Packer or Trails Program Supervisor.

Barn Operations:

Time: RMNP: 7:00-5:30 M-TH from May through October.

No deliveries outside of Barn Operations.

Quotation for Bid: Quotes shall be submitted as a firm fixed price per bale, all costs inclusive, including delivery.

Additional: References, proof of product and nutritional analysis may be required prior to award.

DOI Clauses

DOI ELECTRONIC INVOICING Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (April 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice: hard copy of the invoice.

The Contractor must use the IPP website to register, access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

52.209-2 Prohibition on Contracting with Inverted Domestic Corporations—Representation. (NOV 2015)

(a) Definitions. “Inverted domestic corporation” and “subsidiary” have the meaning given in the clause of this contract entitled Prohibition on Contracting with Inverted Domestic Corporations (52.209-10).

(b) Government agencies are not permitted to use appropriated (or otherwise made available) funds for contracts with either an inverted domestic corporation, or a subsidiary of an inverted domestic corporation, unless the exception at 9.108-2(b) applies or the requirement is waived in accordance with the procedures at 9.108-4.

(c) Representation. The offeror represents that—

52.209-10 Prohibition on Contracting with Inverted Domestic Corporations. (NOV 2015)

(a) Definitions. As used in this clause-- “Inverted domestic corporation” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

“Subsidiary” means an entity in which more than 50 percent of the entity is owned—

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation.

(b) If the contractor reorganizes as an inverted domestic corporation or becomes a subsidiary of an inverted domestic corporation at any time during the period of performance of this contract, the Government may be prohibited from paying for Contractor activities performed after the date when it becomes an inverted domestic corporation or subsidiary. The Government may seek any available remedies in the event the Contractor fails to perform in accordance with the terms and conditions of the contract as a result of Government action under this clause.

(c) Exceptions to this prohibition are located at 9.108-2.

(d) In the event the Contractor becomes either an inverted domestic corporation, or a subsidiary of an inverted domestic corporation during contract performance, the Contractor shall give written notice to the Contracting Officer within five business days from the date of the inversion event.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—
