About this file

This document is a Justification for Other Than Full and Open Competition (JOFOC) for a sole-source contract with National Investment Center for Seniors Housing – NIC MAP Vision. The U.S. Department of Housing and Urban Development (HUD) seeks to procure a data subscription service for Senior Housing, Nursing Home Care, and Hospital forecast data. The contract is valued at $185,523.55, with a base period and four one-year option periods from October 1, 2025, through September 30, 2030.

The sole-source justification is based on NIC MAP Vision's unique proprietary database and specialized knowledge in senior housing market data. The subscription provides comprehensive access to detailed market information, including property-level characteristics, demographic data, market fundamentals, and economic forecasts. HUD requires this data for critical functions such as analyzing FHA insurance program risks, mortgage default rates, and supporting strategic planning for housing and healthcare facilities. Market research conducted in June 2024 found no other vendors capable of meeting HUD's specific requirements for this specialized data service.

(6) A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR 13.501(a)(1)

ORMRA in collaboration with Housing’s Procurement Management Division and OCPO’s CO will ensure that all efforts will be made to comply with FAR Part 41 USC 3304 (a)(1) (see FAR 6.302-1).

More specifically, a Notice of Intent to Sole Source will be issued for the purpose of obtaining information from interested firms and their capability to perform the requirement. This requirement has been synopsized in sam.gov. with a Sources Sought Notices in June 2024, prescribed under FAR Part 41 USC 3304 (a)(1) (see FAR 6.302-1). Lastly this requirement is already listed in HUD’s Office of Small

(7) A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

Prior to the issuance of any contract award, the Contracting Officer will conduct a price analysis utilizing the Independent Government Cost Estimate and historical pricing from the previous contract in which similar services were acquired to sufficiently determine that the overall price represents a fair and reasonable price to meet the Government's needs.

(8) A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.

Market research was conducted and documented in the Market Research report. It is anticipated that this service will be procured as a sole source award. The list of vendors shown below was analyzed based on capabilities listed on their websites and capabilities statements received from the Sources Sought issued June 2024, which yielded six (6) responses from SAM.gov. While many of these vendors offer data subscription services, the driving factor for ORMRA is specialized knowledge and expertise of COTS online data subscription services, best practices, strategies, and risk reporting provided by National Investment Center for Seniors Housing.

The results of the analysis are shown in the table below.

Market Intelligence The government’s requirements are widely available in the commercial market. The demand for this service is high as ORM is the risk mitigator across the Office of Housing Program Offices, identifying, measuring, and managing credit and operational risks of each Program Office. From the market research conducted, it was determined that there are no sources within the small businesses socioeconomic sector that appear capable to perform the requested services and/or team with a larger business to increase capability to meet the Government’s requirements. Fair and reasonable market pricing is available within the industry and pricing data and ranges were available on the GSA Schedules and GSA CALC pricing tool. The pricing structure is based on online data subscription services listed in section five of the SOW. The SOW lists all applicable standards, regulations and process guides required for service. There are no known environmental or safety regulations that affect the service being provided.

Conclusions and Recommendations Due to the need to continue the data subscription services produced under the existing National Investment Center for Seniors Housing – NIC MAP Vision contract, this requirement will be procured as an Sole Source Award to the incumbent contractor with a base period and four (4) option periods. The period of performance for the anticipated award is October 1, 2025, through September 30, 2030.

Since 2019, National Investment Center for Seniors Housing – NIC MAP Vision, has provided the deliverables necessary to assist the Department in providing Senior Housing and Nursing Home Care Data Subscription services. National Investment Center for Seniors Housing – NIC MAP Vision has served as the contractor at an acceptable level. National Investment Center for Seniors Housing – NIC MAP Vision has demonstrated a unique and comprehensive knowledge and understanding that HUD requires as a provider of a commercially available database that provides access to many up-to-date Senior Housing and Nursing Home Care Data Subscription services data for Senior Housing, Nursing Home Care, and Hospital Facilities price forecast, demand and supply for healthcare facilities, economic data, and mapping capabilities. Housing uses the data to help comply with statutory requirements regarding Capital Ratios, Budget Re-estimates, and Credit Reform

The SME, PM COR, CS, CO, OCPO will conduct reviews to ensure the quality and thoroughness of the government’s technical performance documents and configuration control data.

Relevant risks were considered and evaluated and are noted in the acquisition plan. Specific contract terms and conditions will be incorporated into the solicitation and final contract award documents.

There are no exceptions within this requirement and the awardee should be 508 Compliant per the SOW.

Market Research Techniques Used Various methods were used to arrive at market research findings and sources. The sources are listed below.

GSA E-buy and SAM.gov Sources Sought notice to the industry.

Contacted knowledgeable individuals in Industry about market capabilities to meet the requirements.

Viewed potential vendors websites.

Observed five demos from potential suppliers.

(9) Any other facts supporting the use of other than full and open competition, such as:

The incumbent, National Investment Center for Seniors Housing – NIC MAP Vision, has demonstrated a thorough understanding of the requirement, and the database supplied by National Investment Center for Seniors Housing – NIC MAP Vision provides access up-to-date Senior Housing and Nursing Home Care Data Subscription services data for Senior Housing, Nursing Home Care, and Hospital Facilities price forecast, demand and supply for healthcare facilities, economic data, and mapping capabilities.

The National Investment Center for Seniors Housing – NIC MAP Vision subscription service provides data that is essential to completing the short turnaround tasks and analyses required by the Department. This data meets the Departments objectives of being available in a variety of forms and are needed to successfully continue to perform the work requirement.

Presently, this requirement is being performed under contract 86543G19P00002/P00006 with National Investment Center for Seniors Housing – NIC MAP Vision. The contract is due to expire on September 30, 2025. The sole source award is needed to avoid increasing vacancy levels above desired levels in the market to reduce the risk to financial viability of existing rental projects, some of whose mortgages HUD insures.

The circumstances of the requirement deem only one source reasonably available because the subscription to access multifamily project occupancy, rent and sales data has not been competed in the past as there is no competition for the level of detail required by FHA. As a result, no other quotes were obtained from other vendors because the known vendors in the industry did not meet the minimum requirements of FHA. Specifically, only National Investment Center for Seniors Housing – NIC MAP Vision meets the scope and comprehensive data required.

If the subscription service provided by National Investment Center for Seniors Housing – NIC MAP Vision is not met, HUD will not be able to accomplish several critical objectives.

To avoid financing projects in markets where it is anticipated there will be an excess supply of rental units by the time the project is completed, thereby reducing the risk of default for the proposed project.

To avoid increasing vacancy levels above desired levels in the market to reduce the risk to financial viability of existing rental projects, some of whose mortgages HUD may have insured.

The FHA Credit Committee, which relies heavily on National Investment Center for Seniors Housing – NIC MAP Vision data, will be unable to address or monitor significant threats to the commercial portfolio presented to FHA senior management without National Investment Center for Seniors Housing – NIC MAP Vision data.

Additionally, Risk could not inform senior management of significant macroeconomic and regional financial trends such as vacancy rates and rent asking rates enabling FHA management to consider countermeasures or inform OMB of potential threats to the portfolio. Monitoring and measuring surging risks to the commercial loan portfolio is important because the risks threaten the President’s Budget from the escalation of insurance claim payments.

Additional critical information provided by National Investment Center for Seniors Housing – NIC MAP Vision:

1. Search capabilities by address, city, county, state, zip code or latitude/longitude.

2. Radius and polygon search functionality

3. Inventory of existing stock within a targeted search location

4. Construction pipeline reporting across all phases – from planned to under construction.

5. Property-level characteristics, inclusive of unit mix.

6. Demographic data around properties or addresses.

7. Aggregated asking rate and occupancy data for your selected peer group.

8. Property-level sales transactions.

9. Hospitals by location.

10. 10+ years of market fundamentals data for primary metro markets

11. 9+ years for secondary metro markets

12. Historical time series data at the national, regional, metro and county levels.

13. Data cuts using property or community type classifications.

14. Visual depictions of market performance through exportable graphs and charts.

15. Metro market rankings by key indicators.

National Investment Center for Seniors Housing – NIC MAP Vision data is critical for the ORM-Commercial Group work, and their results would suffer immensely if we did not have access to the National Investment Center for Seniors Housing – NIC MAP Vision data.

The services are required to be obtained from the source listed above because the known vendors in the industry did not meet the minimum requirements of FHA. Specifically, only National

Investment Center for Seniors Housing – NIC MAP Vision meets the scope and comprehensive data required.

(10) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

A Sources Sought Notice (SSN) was issued on SAM.gov, in June 2024 which yielded six (6) interested vendor. The vendor was found not capable.
