4. Statutory Authority Permitting Other Than Full and Open Competition.
FAR 13.106-1(b) (41. U.S.C. 1901(e)) only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization) (Commercial Items)
5. Rationale Justifying Use of Cited Statutory Authority.
HYPACK, a division of PureHM U.S. Inc, is the only known source that can meet this requirement. HYPACK is the sole developer of HYPACK Hydrographic Survey software and has proprietary rights to its OEM source codes. HYPACK Maintenance Plan services, which include technical support and program updates, are provided exclusively through HYPACK. The OEM source codes are not available to enable maintenance by a third party or to enable Government development of meaningful specifications and/or statements of work. HYPACK is the only know source that can meet this requirement.
HYPACK is the most widely used hydrographic software package in the world. have used the tools that the software provides for many years to capture, display, and process all of its hydrographic data. Due to the significant investment that has already made with the initial procurement of this software, continued maintenance support is needed resulting from years of product use, continuity of resources and processes, and familiarization. Replacing this software with another software brand will cause significant impact to the mission.
Currently, all of the sonar systems on board the ships use HYPACK for data collection. There currently is no other software package that can interface with all the systems in house for data collection and provide both survey planning, data collection and safe navigation of survey vessel with electronic charting. If another software is used there would be a significant reduction in the ability to collect, transmit, perform analysis, or use of the current or future sonar data required for mission capability. If a different software was purchased, it is estimated that the replacement costs would result in approximately in additional Government costs for the purchases of another software with equivalent capability. Additionally, there will be additional cost to perform re-configuration of resources and processes, including installation and integration of the replacement software to ensure full compatibility with the current environment. There will also be cost to train personnel on the replacement software. Finally, system downtime combined with the risk of potential compatability issues would be required during the transition to replace software creating additional disruption to mission capabilities on behalf of . This transition would not be cost advantageous to the Government. Production and mission support would be adversely impacted immesurably.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
A sources sought/Request for Information # N6230622PR00ONV was posted on SAM.GOV on 20 January 2022 and closed on 30 January 2022 to determine whether there were additional sources who could provide the requested software.
No responses were received.
Market Research was also conducted using internet searches. These searches have revealed no additional sources for this software maintenance support requirement, indicating that HYPACK, a division of PureHM U.S. Inc, is the single-source provider of the requested HYPACK maintenance services.
7. Determination of Fair and Reasonable Cost.
Before making an award, the Contracting Officer will determine that the proposed price is fair and reasonable based on one of the techniques identified in Federal Acquisition Regulation (FAR) 13.106-3(a)(2).
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, has no plans at this time to compete future contacts for the types of supplies/services covered by this document. Prior to the award of future contracts, market research will be completed to determine if potential sources have emerged that will allow for competition.
