United States Department of Agriculture (USDA) Limited Sources Justification

FAR 80405 Federal Supply Schedules Multiple Award Schedule Program

Control No. FY24-FPAC-Justification-178

1. Identification of the agency and the contracting activity.

Agency: USDA Natural Resources Conservation Service (NRCS) Nebraska State Office.

Contracting Activity: USDA Farm Production and Conservation (FPAC) Business Center (BC) Operations Branch, Acquisition Division, Central Section

2. Description of supplies or services required to meet the agency’s needs (including estimated value).

Topcon MAGNET Tools Service Plan, #1030075-01, and MAGNET Field Maintenance, #61155 software renewals are required to ensure access to version updates and technical support. Estimated value is $35,582.40.

3. Identification of the authority for limiting sources.

The following circumstance justifies limiting the source under FAR 8.405-6, specifically FAR 8.405-6(b) is the proposed authority.

4. Supporting rationale demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.

NRCS Nebraska has utilized Topcon MAGNET software (both field and office versions) brand for mapping-grade and survey-grade GPS surveying equipment and software since 2013. MAGNET software is used in 88 GPS systems located in over 50 field offices statewide with approximately 85 users. All field and office process guides and workflows are specific to MAGNET software, and significant time and training has been dedicated to its use with the goal of interchangeability across users and county borders. Any other product would not be compatible with the hardware/firmware currently in use, resulting in procurement costs for new equipment, extensive training, and loss of interchangeability among users.

5. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

Market research consisted of review of product availability on the GSA supply schedule identifying two (2) sources capable of providing maintenance renewals required. Market research did not identify any product which would be compatible with the existing hardware/firmware currently in use.

6. Recommended source(s).

Caron East, Inc. Topcon Positioning Systems, Inc.
