About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition (JOFOC) for a sole source award to a Service-Disabled Veteran-Owned Small Business (SDVOSB) for the rental of a bioGO Rx Compounding Pharmacy Trailer.
The Department of Veterans Affairs, Network Contracting Office 19 (NCO 19), has a requirement for a follow-on contract for the rental of a bioGO Rx Compounding Pharmacy Trailer due to ongoing construction delays at the Oklahoma City VA Healthcare System facility. The trailer is a critical temporary facility needed to ensure pharmacy services continue during the renovations. The estimated total value is $356,000 for a one-month base period plus five one-month option periods. The acquisition will be awarded sole source to Stripes Global Inc., an SDVOSB, under the statutory authority of 41 USC 3304(a)(5) and 38 U.S.C. 8127(c). Market research determined Stripes Global Inc. is the only distributor capable of meeting the required timeframe with the already modified trailer. The cost is deemed fair and reasonable based on comparison to a recent similar lease.

VHAPG Part 819.7008/7009 Sole Source Awards to SDVOSB/VOSB Revision: 02 Effective Date: 04/15/2023
4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S.
Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 (DEVIATION) or VAAR
819.7009 (DEVIATION) up to $5,000,000. Check the specific VAAR clause used below:
(X) 819.7008 Sole source awards to a certified service-disabled veteran-owned small business; or ( ) 819.7009 Sole source awards to a certified veteran-owned small business
5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): VAAR 819.7007 allows sole source awards to a SDVOSB based on 38 U.S.C. 8127(c). The SDVOSB concern (Stripes Global Inc.) has been determined to be a responsible source with respect to performance. The SDVOSB meets the eligibility requirements outlined in 819.7003.
The trailer that is currently supplied for lease by Stripes Global Inc., is on location and already outfitted with the modifications that were necessary to allow the staff and patients to conduct pharmacy functions within this temporary facility. The cost of the modifications exceeded $100,000.00. These modifications would have to re-occur if a new trailer was leased or purchased. Furthermore, a review of lease vs. buy determination was conducted and found that it would take an additional six months to refit a new trailer with the equipment needed to perform the functions of the pharmacy and is estimated to cost the government $1.7 million in ownership costs.
Additionally, once construction renovations are completed, the VA will return all actions taking place in this trailer to the main hospital and the trailer will no longer be required. Therefore, it is most advantageous to the government to continue the lease of the altered trailer until construction is completed and an award be made to Stripes Global Inc. (SDVOSB) IAW FAR PART 13 as a follow-on contract.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies: Stripes Global Inc. was contracted to see if they had any other distributors of their already altered trailer and cost to purchase vs. lease the trailer. It was noted that it would take six months to build a new trailer for rent or purchase, exceeding the required need date for this contract to be completed because the current contract 36C25923P0839 expires June 15, 2024. A notice of intent to sole source will be published to Contract Opportunities IAW FAR 5.201(b).
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Price analysis will be conducted at time of award using FPDS and IGCE. The cost of the rental is found to be fair and reasonable based on review of recent mobile pharmacy trailer rentals.
Contract 36C26220P1439 with a five-month lease extension costing $475,000.00 compared with this base month plus five additional option months estimated total cost of $327,000.00.
Stripes Global Inc. has met the eligibility criteria outlined in VAAR 819.7003, they are verified with the SBA Veteran Small Business Certification, and the action is below the $5M threshold.
