Over Micro Purchase Threshold but Not Exceeding the SAT ($250K)

1. Contracting Activity: The Department of Veterans Affairs, Veterans Integrated Service Network (VISN) 10, Louis Stokes Cleveland Veterans Affairs Medical Center (CLE VAMC) Network Contracting Office (NCO) 10.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

Network Contract Office (NCO) 10 intends to award a new, firm fixed price, purchase order to Dynex Technologies, Inc. for a electrophoresis analyzer.

(a) DESCRIPTION OF SUPPLIES: The DSX Dynex is a current backup model for Agility analyzer. and both perform: QFT, CMV and Anti cardiolipin for the Laboratory that meet test menu. the QFT is require for the new employee’s onboard process. The analyzer is user friendly, and the staff is already training.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Dynex Technologies, Inc., is uniquely qualified to provide the electrophoresis system:

The Dynex systems are fully automated ELISA systems that run on an open platform and are compatible with most ELISA assays regardless of who the vendor is. The competitive systems are on a closed platform which require you to run only their assays which will restrict your abilities to add assays from other vendors.

4. Description of market research conducted and results or statement why it was not conducted:

Market research was conducted by the Contracting Officer and the service to identify available sources to meet the requirements as follows:

VetCert, DSBS, SAM.gov, OEM, National Contracts, Interagency Contract Directory, GSA, FPDS, DLA Troop Support, BIC, FDA, were reviewed with the following results:

VetCert was queried, as required, using NAICS 334516. The search provided 226 results.

A search was conducted in the Medical Surgical Prime Vendor (MSPV) Contracts:

Equipment Home (dla.mil) using key words “Electrophoresis Analyzer” which resulted in no results.

A search was conducted in Small Business Administration (SBA) Dynamic Small Business Search (DSBS) SBA SBA Search Results under NAICS CODE 334516 and key words “Electrophoresis Analyzer” which resulted with no results.

A search was conducted on SAM SAM.gov | Search under key words “robotic arm system” which resulted with no results.

The OEM, Dynex Technologies, Inc., was contacted to receive a list of authorized distributors, with a concentration on SDVOSB and VOSB authorized distributors. The OEM contact, Karol Ford, stated that they have no distributors for this product.

A search was conducted on DLA Troop Support Medical Chain dla.mil with key words “ Electrophoresis Analyzer” with no results.

A search was conducted on the Interagency Contract Directory Interagency Contract Directory Portal with key words “Electrophoresis Analyzer” which resulted in no results.

A search was conducted on GSA eLibrary Product Detail (gsaadvantage.gov) with key words “Electrophoresis Analyzer” which resulted in no results.

A search was conducted in Federal Procurement Data System (FPDS) FPDS NG ezSearch with key words “Electrophoresis Analyzer” with several results: FPDS NG ezSearch

IAW OMB MemorandumM 19 13 Category Management: Making Smarter Use of Common Contract Solutions and Practices, this requirement cannot be satisfied through Best in Class contracting (BIC).

A search was conducted in The U.S. Food & Drug Administration (FDA) Search | FDA with key words “Electrophoresis Analyzer” which resulted in no results.

The NMR does apply to NAICS 334516, and SBA has provided a class waiver for NAICS 334516.

Based on the market research conducted, no two or more VetCert verified and capable SDVOSBs or VOSBs or DSBS verified and capable small business were identified and appeared capable of performing the requirement. The VA Rule of Two cannot be met.

The SBA Rule of two cannot be met.

FITARA is not needed, it is not IT related.

There are no BAA/TAA issues, the Electrophoresis Analyzer is made in America.

Dynex Technologies, Inc., is a small business and has no distributors for this equipment.

The VA and SBA rule of two cannot be met.
