Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID:

1. Contracting Activity: Department of Veterans Affairs, VISN 09, Tennessee Valley Healthcare System, Nashville Campus.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

The Tennessee Valley Healthcare System (TVHS), Nashville Medical Center has a requirement for a new free standing, self-contained 7-axis robotic milling system that can quickly carve both prosthetics and orthotics out of a variety of materials. Additional requirements for this procurement include installation (including hardware/software necessary to support device), configuration, and testing of the robotic milling unit as well as end-user training. To also include at least a one-year warranty for the new device.

The existing carving system is at its end-of-service life (cannot be repaired) and is well past its life expectancy.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

The Tennessee Valley Healthcare System (TVHS), Nashville Medical Center has a brand name only request to purchase a new free standing, self-contained 7-axis robotic milling system that can quickly carve both prosthetics and orthotics out of a variety of materials. Due to the custom options included with this system, the only vendor with the ability to offer the complete solution is Custom options required include being able to carve at least 15 custom pieces per day, carve foot orthotics, and cut trimlines required by patients within acceptable turn-around times. Thus, enabling the Nashville TVHS Prosthetics Service to complete more in-house services reducing the dependency on outside services to meet the needs of the patients.

has provided a proprietary statement that they are a small business, original equipment manufacturer (OEM) and are the only authorized distributors of this custom milling system.

Currently, s the only contractor compliant with the Enterprise Risk Assessment (ERA) system on file with the Veterans Health Administration allowing network connectivity required for the system software to function correctly.

4. Description of market research conducted and results or statement why it was not conducted:

A Notice of Intent to Sole Source was posted to Contract Opportunities on 01/04/2023 thru 01/10/2023, allowing the public to respond with capability statements if interested in the requirement. No responses were received.

VIP(VetBiz) search: utilizing search parameters, NAICS code 333515, key word prosthetics carver, no restrictions resulted in (0) SDVOSB/VOSB.

VIP(VetBiz) search: utilizing search parameters, NAICS code 333515, key word 7 axis milling, no restrictions resulted in (5) SDVOSB and (2) VOSB. However, only (2) SDVOSB contractors provided CNC machinery and NONE of the contractors were found to be capable to provide the item.

GSA eLibrary search: utilizing search parameters, NAICS code 333515 resulted in (4) contractors, however none were found capable to provide the item.

GSA Advantage search: utilizing search parameters, NAICS Code 333515, key word prosthetics carver, resulted in (1) small business that was for a prosthetics van and not capable to provide the item.

Reviewed Supply Chain Master Catalog (SCMC) utilizing key word “prosthetic carving” that resulted in (2) contracts. Contract No. 36C24423D0015 and Contract No. 36C26022A0026 however, neither contract indicated having the capability of producing the required product.

Search was conducted on Federal Procurement Data System-Next Generation (FPDS-NG) utilizing key words “axis carver” that returned (5) results of which (4) actions were found to be similar to the current procurement. All (4) of the similar actions were awarded directly to Epica Medical Innovations, LLC. dated from 2020 thru to 2022.

Search was conducted on SAM.GOV utilizing key words “7 axis carver” that returned (6) results of similar items dated from 2019 thru 2022. Of those actions (2) Sources Sought Notices were posted and (4) Intent to Sole Source Notices were posted for contractor

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
