About this file

This document is a Single Source Justification (SSJ) for a simplified acquisition procedure to procure a Roche Ventana Benchmark ULTRA PLUS Immunohistochemical (IHC) Stainer for the VA Boston Medical Center, West Roxbury Campus.

The justification explains that the VA Boston laboratory has been using the Roche Benchmark staining systems for over 12 years and is familiar with the equipment, which will minimize training and operational challenges. Keeping the equipment consistent across the VISN 1 network will also ensure cohesive testing results. The IHC Stainer is needed to accurately analyze surgical specimens and tissues to aid in cancer diagnoses for veterans. The estimated cost for the stainer is $121,000. The contracting officer certifies this sole source procurement under FAR 13.106-1(b). The related federal contract opportunity is a special notice for the intent to award a sole source, firm-fixed price contract for a 1-year period to Roche Diagnostics for the Benchmark ULTRA PLUS IHC Stainer.

Acquisition Plan Action ID: 36C241-24-AP-2904

1. Contracting Activity: Department of Veterans Affairs, VISN 01, VA Boston Medical Center West

Roxbury Campus.

Contracting: 36C241-24-AP-2904 Temporary 2237: SEPG# 364889 (waiting for approval from Equipment Committee with updated 2237)

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

The purpose of this contract is to provide one ROCHE Ventana Benchmark ULTRA PLUS Immunohistochemical Stainer to VA Boston Medical Center, West Roxbury Campus.

The Roche Benchmark Plus Ultra IHC Stainer is an advanced IHC system that offers cutting-edge features for histopathology and immunohistochemistry testing. It offers precise and reliable staining results, enabling the histopathologists to accurately identify and characterize cancerous antigens in patient tissue samples.

Estimated cost $121,000.00

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

The AP Laboratory has been using Roche Benchmark staining systems for over 12 years. The lab trusts the quality and reliability of this equipment. Staff are familiar with this type of embedding station – this will allow for minimal staff training and will make it so there isn’t an unnecessary learning curve. Keeping this equipment consistent with what is placed throughout VISN 1 will allow for results to be cohesive. Consistent care is important.

The immunohistochemistry Stainer is used for the testing tissues obtained for cancers and care for the veterans. This acquisition maintains the highest possible standards of care insuring that surgical specimen, tissues, are properly analyzed and accurate diagnoses are made by the Pathologists. The immunohistochemistry Stainer functions accommodate a variety of tissue staining techniques concurrently to suit the different needs of the laboratory, therefore improving the efficiency of the Anatomic Pathology department.

The Stainer must have capability to communicate with other Ventana instrument we currently owned for the purpose of patient safety, this feature tracks tissues specimen during testing.

4. Description of market research conducted and results or statement why it was not conducted:

Worked with Histology supervisor and AP manager who applied their personal knowledge on the product. We also reviewed catalogs, literature published by manufacturers on the product, as well as online manufacturers websites.

FPDS was searched for “Benchmark Ultra Full System” and all instances are either Roche Diagnostics and Ventana which suggests that they do not allow their product to be sold by anyone but themselves.

The NAC was searched for Roche product number 0957697001 and the item does not appear on the NAC. It was also searched for “Benchmark Ultra” and yielded 0 results.

Roche Diagnostics provided a sole-source letter stating that they are the sole provider of their equipment and that no other businesses can provide their equipment.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
