About this file

This document is a Justification for Other Than Full and Open Competition (JOFOC) for a sole source contract award. The Department of Veterans Affairs (VA) is awarding a one-year contract to an unknown vendor for kidney transplant logistics services for the Pittsburgh VA Healthcare System. The total estimated value of the contract is unknown.

The VA is using the "Unusual and Compelling Urgency" exception under FAR 6.302-2 to award this sole source contract. The services are critical to monitoring antibody levels and matching kidney transplant candidates with deceased donor kidneys. Without these monthly samples, there is an imminent threat to kidney transplant candidates who will no longer be eligible for organ offers. The VA plans to conduct further market research and encourage competition for any future requirements under non-urgent conditions.

4. Statutory Authority Permitting Other than Full and Open Competition:

( X ) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by

FAR 6.302-2;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition

Requires the Use of the Authority Cited Above (applicability of authority):

This is an urgent and compelling request for a 1 year contract. If the emergency contract isn’t awarded immediately, it will cause imminent threat to all kidney transplant candidates at VAPHS. These patients will no longer be eligible for organ offers. These monthly samples are critical as they are used to monitor the antibody levels in the blood, and they are the final test for compatibility used to match listed patients with deceased donor kidneys. If a monthly sample is not available, it leads to a missed opportunity to be cross-matched for a kidney.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

Should this requirement be needed again and under non-urgent conditions, the Contracting

Officer will conduct further market research and encourage competition after exclusion of sources if it is found there are other vendors who can meet this requirement. This requirement was not synopsized prior to award as it met the exception found in FAR 5.202(a)(2).

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

The anticipated price is considered fair and reasonable, based on the historical contract pricing ).

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

Should this requirement be needed again and under non-urgent conditions, the Contracting Officer will conduct further market research and encourage competition after exclusion of sources if it is found there are other vendors who could perform the services.
