VHAPM Part 813.5 Simplified Acquisition Procedures for Certain Commercial Items Request for Sole Source Justification Template >SAT $7.5M under FAR13.5
36C247 22 AP 1696
PM Part 813.5 SAP for Certain Commercial Items Page 2 of 5 Original Date: 08/30/17 Revision 03 Date: 02/11/2021
4. Statutory Authority Permitting Restricted Competition:
Federal Acquisition Regulations (FAR) 13.5 Simplified Procedures for Certain Commercial Items.
The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 USC § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:
(X) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements – BRAND NAME ONLY – HILL-ROM PROGRESSA ICU BED
( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert
Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest
5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition
Requires the Use of the Authority Cited Above (applicability of authority: In an effort to standardize ICU beds within the Columbia VA Medical Center, the Hill-Rom Progressa ICU bed is the only acceptable brand. The Progressa bed is currently in use at the facility, and a portion of the beds are identified as needing an end-of-life replacement. The facility already has a pre-existing pool of replacement parts and accessories for maintenance and repair on hand. Using any other brands would cause substantial duplication in cost for parts needed, and any other brand bed would not be covered under our current service contracts for the ICU beds. New Progressa beds have recently been procured under contract # 36C24720P1129. Familiarity with the bed type under this brand ensures interoperability with other services throughout the facility. This reduces the requirement to move patients from bed to bed, which is a patient safety concern.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Market research was conducted, details of which are in the market research section of this document. This effort yielded service-disabled veteran-owned small businesses that can provide this requirement. Furthermore, all identified sources have provided this equipment in the past and are authorized distributors of Hill-Rom. This requirement will be competed on the Government Point of Entry (GPE), SAM.gov, and the brand name only justification will be provided with the solicitation.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The Contracting Officer (CO) anticipates the Government will be provided a fair & reasonable price. The CO will compare new pricing to the prices received under contract 36C24720P1129 and the Hill-Rom listed pricing under their Federal Supply Schedule contract 36F79721D0160. Furthermore, the CO anticipates multiple quotes from the solicitation and will compare the competitive pricing received.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted: The following Market Research techniques identified in FAR 10.002(b)(2) were used to conduct market research: Search of General Services Administration (GSA) eLibrary and Advantage, a search of the Vendor Information Pages (VIP), a search of National Acquisition Center (NAC) catalog, and check of mandatory sources. Furthermore, the service line conducted its own market research.
