About this file
This single source justification document proposes awarding a firm fixed price purchase order to Ardiem Medical, Inc., a small business distributor, for a retractor system. The Department of Veterans Affairs Network Contracting Office intends to procure the retractor system for an estimated $30,129.33 with a required delivery date of 180 days after receipt of order. The justification cites Ardiem Medical's exclusive manufacturing of the implantable devices and components due to years of collaboration developing the technology and meeting specialized needs, claiming no other source can provide the items and transferring the production elsewhere would be costly and potentially risky. Market research found no potential equals to Ardiem Medical through various government databases and contract vehicles. The contracting officer certified the justification as accurate based on FAR 13.106-1(b) for single source awards over the micro-purchase threshold.

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT
Retractor System 541‐23‐3‐703‐3484
Last Updated: 02/01/22 Page 1 of 4
DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106‐1 For
Over Micro‐Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C250‐23‐AP‐4125
1. Contracting Activity: The Department of Veterans Affairs, Veterans Integrated Service
Network (VISN) 10, Louis Stokes Cleveland VAMC (CLE VAMC) Network Contracting Office
(NCO) 10.
Transaction: 541‐23‐4‐2312‐1040
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
Network Contracting Office (NCO) 10 intends to award a new, firm fixed price, brand name, purchase order to Ardiem, a small business distributor for Deringer‐Ney, via Open Market.
This request is for a retractor system.
ESTIMATED DOLLAR VALUE: $30,129.33
REQUIRED DELIVERY DATE: 180 Days ARO
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Per FAR 11.105 Items peculiar to one manufacturer and 12.4‐Unique Requirements Regarding Terms and Conditions for Commercial Items, Integra Life Sciences, is uniquely qualified to provide the retractor system:
The Advanced Platform Technology Center, in collaboration with Ardiem Medical, Inc., has pioneered the design, development, and prototyping of the unique implantable devices required for our research and development efforts. These devices, due to their complexity and the specific expertise required for their production, necessitate a very specific set of capabilities that limit their availability to just one source: Ardiem Medical, Inc.
The center lacks both the manpower and facilities necessary for large‐scale manufacturing of these highly specialized electrodes, leading us to engage Ardiem Medical, Inc., a full‐ service medical device design and manufacturing company, as our contracted manufacturer since the early 2000s. Ardiem Medical's ability to produce these specific electrodes according to our stringent specifications demonstrates a unique collaboration and transfer of our specific manufacturing processes that is unmatched elsewhere in the market.
Last Updated: 02/01/22 Page 2 of 4
Notably, Ardiem Medical is the exclusive manufacturer of these implantable devices and several other key components of our systems. This exclusivity is grounded in the company's in‐depth understanding of our technical specifications, refined over years of collaboration, and their distinctive ability to meet our specialized needs.
Engaging with another contract manufacturer would not only be costly but would also necessitate transferring our intricate technology and hard‐earned expertise to a new manufacturer, a process that would be both time‐consuming and potentially risky in terms of quality control and adherence to specifications.
As such, the cost of procuring devices from Ardiem Medical, Inc. is significantly less than the associated cost of producing these devices at the Advanced Platform Technology Center or transferring the requisite technology and experience to another manufacturer.
Consequently, Ardiem Medical, Inc. remains the singular viable source for these unique implantable devices.
