Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Project: 523-25-003 Bulk Oxygen Corrections A/E
Acquisition Plan Action ID: 36C241-25-AP-0457
1. Contracting Activity: Department of Veterans Affairs, VISN 01, Jamaica Plain VA
Medical Center, 150 S Huntington Ave, Boston, MA 02130
2. Brief Description of Supplies/ Services required and the intended use/Estimated
Amount: A Firm Fixed Price contract to provide A/E Type A, B, and C Services for all three Boston VA Medical Centers (Brockton, Jamaica Plain, and West Roxbury) for project 523-25-003 Bulk Oxygen (O2) Corrections A/E. A/E Firm shall provide three separate document sets for each VAMC. The intent of the A/E is to provide Design, Documentation, and Construction Administrative Services to correct Bulk O2 NFPA deficiencies only as per William Pevear Architects, Inc. assessment dated August 20, 2024. Given the limited scope, the A/E shall provide an abridged design and documentation package from typical VA project services and deliverables.
The period of performance to complete this work is estimated to be 180 calendar days from contract award.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: William Pevear Architects, Inc. (WPA) is a VOSB who was contracted with the VA on three separate service contracts to perform a Bulk O2 NFPA Assessment for all three Boston VA Medical Centers. The VA received the assessment dated August 20, 2024 which included their findings and recommendations for addressing deficiencies. This assessment is critical to maintaining the safety of both patients and staff. WPA is the most qualified and the most knowledgeable firm for this requirement as they have already been on site, provided a detailed analysis of each bulk system, identified discrepancies and areas requiring improvement, and included recommendations for any necessary modifications or upgrades to align with NFP. Awarding a Firm Fixed Price contract for Type A, B, and C Services to WPA would be a benefit to the Government because this contractor has already performed the assessment and has first- hand knowledge and experience of the existing conditions and the level of effort needed to complete this work. It is likely the Government could receive a lesser quality product if another A/E firm was selected. Additionally, using WPA for this requirement would be a cost savings to the Government because having another firm would most likely require additional costs, more time, and research will need to be accounted for as they do not have knowledge of the existing conditions. Another firm would need to investigate and perform their own study resulting in duplication of effort and result in a higher cost. The Boston VA Medical Centers have had a number of projects designed by WPA and a history of fair and reasonable pricing, consistent compliance with the Brooks Act, qualified professional staff, and quality.
4. Description of market research conducted and results or statement why it was not conducted: Market research was conducted (see eCMS briefcase files for Market Research Report and SDVOSB/VOSB search results), however this requirement has an assessment conducted by WPA which would not be able to be modified by another A/E firm. By using the same A/E firm to maintain the knowledge, experience, and skill set working with the project from all stages is a benefit to the Government. This will help reduce any future delays, errors, and omissions since WPA maintains the past historical information with familiarity to support the Type A, B, and C Services needed for this project. It is in the best interest of the Government to utilize the same A/E firm who performed the assessment to not incur additional costs.

Contracting Officer's Certification: I certify that the requirement outlined in this justification is a bona fide need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
