DEPARTMENT OF VETERANS AFFAIRS

SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL

ITEMS IN ACCORDANCE WITH FAR 13.5

Acquisition Plan Action ID: 36C246-23-AP-2636

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office (NCO) 6 on behalf of Durham VA Medical Center (VAMC); 2237 # 558-23-3-2037-0038.

2. Nature and/or Description of the Action Being Processed: This is a new requirement for the de-installation Getinge that has past its useful life and the installation of a new Getinge brand cart washer for Durham VAMC Sterile Processing Services (SPS). The de-installation will be for a Getinge cart washer model 9128 and the procurement and installation is for a Getinge cart washer model 9128E.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: Durham VAMC requires a SPS cart washer that is able to clean up to 24 containers or 30 instrument trays in an 8 hour period.

Additionally the cart washer is required to fit in a custom cut out area within the SPS shop, and utilize existing connections for exhaust, water and drainage. The estimated value is $287,942.03.

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Durham VAMC SPS has no additional funds for construction in order to accommodate another vendors cart washer. The custom cut out where the old cart washer system is housed is customized for a Getinge model 9128 cart washer. Another brands cart washer would require site customization to house another brands equipment. This would cause delays in install and additional funds for the construction which the service does not have available. Getinge is the only brand that offers a cart washer that would be able to fit in the custom cut out and be able to utilize all pre-existing connections. Any other brands would require the Government to construct new exhaust connections and or new drainage and water line connections.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The Durham VAMC vetted Skytrons cart washer Sterling C2000 and Getinge 9128E cart washer. VA engineering reviewed the systems both equipments electrical, plumbing, Effective Date: 02/01/2022 Page 2 of 3

HVAC requirements for new installation. Skytron’s Sterling C2000 cart washwer is built with all HVAC/utility connections on the opposite side from existing facility hookups. To accommodate the Sterling C2000 cart washer, a facility construction project would be required to re-route all electrical, plumbing and HVAC connections. A sources sought synopsis was not issued for this requirement.

Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The Contracting Officer will determine price reasonableness based on a comparison of the proposed quote to the Independent Government Cost Estimate (IGCE).

Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Veterans Affairs mandatory supply sources were searched.

The results of which found no products for this requirement through VA inventories, excess from other agencies, Federal Prison Industries, AbilityOne, and wholesale supply sources. Contracts internal to Veterans Affairs National Acquisition Center (NAC) and Strategic Acquisition Center (SAC) awards database was searched and found no products available for this requirement. GSA Advantage yielded no products available for this requirement. Telephonic conversation with Getinge regional sales representative identified Trillamed as the sole Service Disabled Veteran Owned Small Business authorized Original Equipment Manufacturer distributor.

Any Other Facts Supporting the Use of Other than Full and Open Competition: None

Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None

A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: NCO 6 will continue to conduct market research to ascertain if there are changes in the marketplace that would enable competition for future actions.
