About this file
This document is a Justification and Approval (J&A) for a Sole Source Request from the Department of Veterans Affairs, specifically for the Lebanon VA Medical Center in VISN 04. The procurement is for a one-time, firm-fixed price contract to replace an existing GE CASE cardiopulmonary stress testing system, with a total of 11 specific equipment items to be purchased. The procurement will be made through Trillamed LLC, a verified Service-Disabled Veteran-Owned Small Business (SDVOSB), who is the sole authorized distributor for GE Healthcare. The justification emphasizes the unique requirement that GE Healthcare products are the only ones compatible with the VA-wide MUSE cardiology information system, and that the new equipment will improve patient care by replacing dated/malfunctioning equipment while ensuring seamless integration and minimal workflow disruption.

DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition
Acquisition Plan Action ID: VA-26-00026167
1. Contracting Activity: Department of Veterans Affairs, VISN 04, Lebanon VA Medical Center, 1700 Lincoln Avenue, Lebanon, PA 17042.
2. Nature and/or Description of the Action Being Approved: The Lebanon VA Medical Center’s Medicine department currently has a need to replace the existing GE CASE cardiopulmonary stress testing system. The existing equipment is used daily by our Cardiovascular department to assess for blockages in the heart and to predict risk of heart attacks. It has been identified by cardiology staff for replacement. This request is for a one-time, firm-fixed price contract.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: The Lebanon VA Medical Center recently purchased T2100 Stress Treadmill and the CASE cardiopulmonary stress system will replace the dated/malfunctioning equipment to improve patient care.
This equipment is networked to the MUSE which is a VA-wide mandate. Throughout VISN 4, the GE MUSE cardiology information system is utilized to store EKG studies. Whenever an EKG is taken, the study must be sent and stored within the MUSE. GE Healthcare products are the only ones that can communicate to the GE MUSE and successfully send studies. In order to continue the current required workflow, GE Healthcare solutions need to be procured. The installation would be seamless and limit downtime and reduce delays in patient care.

4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S.
Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 (DEVIATION) or VAAR
819.7009 (DEVIATION)- up to $5,000,000. Check the specific VAAR clause used below:
( X) 819.7008 Sole source awards to a certified service-disabled veteran-owned small business;
or ( ) 819.7009 Sole source awards to a certified veteran-owned small business
5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): GE Healthcare is the unique and the sole manufacture of this equipment. Trillamed LLC, verified SDVOSB from the SBA Search and FSS holder of Contract 36F79720D0041, is the Sole Distributor on behalf of GE Healthcare. Supporting documentation is attached to the AP, including a letter of authorization from the OEM stating Trillamed LLC as a sole authorized distributor. In accordance with 38 U.S.C 8127 (c) and VAAR 819.7008, the use of a sole source award is justified due to the vendor’s verified status, technical capability, and the lack of other responsible SDVOSB sources.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies: FSS Contract 36F79720D0041 has been identified through the sole SDVOSB distributor, Trillamed LLC. This procurement is being conducted as a sole-source award in accordance with VAAR 819.7008. No exemption from FAR Subpart 5.2 applies, so an intent to sole source and award notice will be posted to GPE.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The contracting officer has determined that the anticipated cost to the Government will be fair and reasonable based on a comparison of the offered price against independent Government cost estimates and price has already been determined fair and reasonable at the FSS contract level.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was limited due to the brand name requirement. FPDS, SAM, SCMC, and GSA Advantage were consulted and identified the sole FSS contract from Trillamed LLC. The OEM was also consulted to confirm that Trillamed was the sole SDVOSB authorized distributor, and FPDS revealed a similar requirement that was awarded to Trillamed LLC. No other SB was identified that could provide the brand name requirement.
GE Healthcare products are the only ones that can communicate to the GE MUSE and successfully send studies. GE Healthcare is unique and is the sole manufacture of this equipment.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None. This sole source award is authorized under 38 USC 8127(c), which permits the Department of Veterans Affairs to award contracts to SDVOSBs and VOSBs on a sole source basis when criteria are met.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Trillamed, LLC.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: This is a one-time purchase. In the future, if more SB/qualified distributors are identified, then future acquisitions may be competed among eligible distributors.
12. Approvals in accordance with the VHAPM Part 806.3 OFOC SOP:
