About this file
This document includes a sole source justification and award notice for an emergency contract. The Department of Veterans Affairs Veterans Health Administration Veterans Integrated Service Network 23 required an immediate upgrade to the medical gas and vacuum system at the VA Nebraska-Western Iowa Health Care System to accommodate a potential surge of 134 COVID-19 patients. The scope included additional medical air and vacuum equipment, installation, training and verification by an American Society of Sanitary Engineering certified contractor. Only one vendor, Healthcare Compliance Testing LLC, was solicited due to the urgent need and the vendor's recent experience and familiarity with the system. The contract was awarded to Healthcare Compliance Testing LLC for $388,763.27 on May 19, 2020.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): On March 13, 2020, the President of the United States issued a proclamation declaring a national state of emergency concerning the COVID 19 outbreak. This emergency requires that all VA facilities be prepared to meet the possible surge of patients with the virus. Therefore, it is essential that the medical gas capacity and associated components of the NWI VA HCS be increased immediately to accommodate 134 patients at any given time to preclude impairment of Veterans receiving care at these facilities. The Veterans Health Administration (VHA) requires that all medical gas work meet requirements as stated in the Healthcare Facilities Code (NFPA) 99 for design, installation, operation, and maintenance. NFPA requires that installers have an American Society of Sanitary Engineering (ASSE) 6000 series verification prior to completing any medical gas work on a VA facility. As indicated on the National Inspection, Testing, and Certification website, https://nationalitc.net/certification/lookup, there are currently only 6 ASSE verifiers listed in the state of Nebraska. Due to the urgent and compelling nature of this requirement, Healthcare Compliance Testing, LLC which employs two of the six verifiers in the state, was contacted to provide a quote for the work. This small business vendor has completed medical gas repair work for the VA NWI HCS within the past year and has the

OFOC SOP Revision 09 Page 3 of 4 Original Date: 03/22/11 Revision 09 Date: 04/17/2020 knowledge, skills, and capacity to complete this work immediately as the installers are already familiar with the location of the system and associated components, reducing the amount of time necessary to provide a quote, order equipment, and to complete the work.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
Market research was completed that identified only six individuals with current ASSE verifier certifications for the state of Nebraska. Due to the urgent nature of this requirement, only one vendor was contacted to provide a quote due to the urgency of the requirement as this company’s installers have recently completed work on the medical gas system. No other vendors have completed medical gas repair work for the VA NWI HCS within the last six months. This vendor is readily available to provide a quote and has affirmed that the installation will be expedited, only limited by the time needed to deliver the equipment from the manufacturer and the availability of the work space.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The pricing will be determined fair and reasonable by the contracting officer prior to award based on a comparison to the Independent Government Cost Estimate (IGCE).
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A nationwide search was conducted on the Vendor Information Pages (VIP) using the NAICS of 811310 and the key word search of ASSE which resulted in 24 vendors being found. However, due to the urgency of this requirement and the national travel restrictions currently enacted in various states, the search parameters were changed to limit the vendor location to the state of Nebraska. This search resulted in zero SDVOSB or VOSB vendors being found. Next, a search was conducted on the National Inspections, Testing, and Certification website (https://nationalitc.net/certification/lookup) for all individuals that are ASSE verified within Nebraska. This search resulted in six individuals being found that are qualified to complete this work. The employer of the first individual listed, Healthcare Compliance Testing, LLC was contacted to provide a quote. This company is able to provide a quote immediately as their installers are already familiar with the system, having recently completed work on the system. A DUNS search on Beta.SAM.gov of this company categorized it as a small business under NAICS 811310. No other research was required due to the urgent nature of this acquisition.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: NCO 23 is predicting that there will be a surge in COVID 19 cases in early summer. Although the medical gas system will not be completely installed by this time, some system components may become available sooner, helping the VA NWI HCS provide care to more patients without the risk of a medical gas system failure.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None. Due to the urgent and compelling nature of this requirement, no other vendors were contacted to provide a quote.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to
Competition before Making subsequent acquisitions for the supplies or services required: Due to
