About this file
This document is a justification for a sole source award notice for providing offsite training space, meals, and related services to the Department of Veterans Affairs Law Enforcement Training Center. The University of Arkansas Pulaski Technical College will provide daily breakfast and lunch meals for up to 65 students, as well as training space, a driving track, and graduation hall. The period of performance is for one base year and one option year, with an anticipated total value of $627,800. The justification cites 41 U.S.C. 3304(a)(1) and FAR 6.302-1(b)(3) as the authority for the sole source award, indicating that as the only facility within a half mile of the student lodging that can meet all requirements, Pulaski Technical College is the only responsible source. The notice will be synopsized on SAM and the justification will be made publicly available 14 days after award. The Department of Veterans Affairs Strategic Acquisition Center Frederick will make the award.

JOFOC-UA-PTC Offsite Training Space and Meals
JUSTIFICATION FOR
OTHER THAN FULL AND OPEN COMPETITION
(6.302-1- Only One Responsible Source and No Other Supplies or Services Will
Satisfy Requirements)
1. Contracting Activity: This Justification and Approval (J&A) for Other Than Full and
Open Competition is executed by the Department of Veterans Affairs, Office of Procurement, Acquisition and Logistics Strategic Acquisition Center – Frederick on behalf of the Department of Veterans Affairs (VA) Law Enforcement Training Center
(LETC).
2. Nature and/or Description of the Action Being Approved: This justification is prepared and approved for Other Than Full and Open Competition for a firm-fixed-price contract with the University of Arkansas – Pulaski Technical College (UA-PTC) to provide daily meals, training space, driving track, and graduation hall for LETC’s students attending training at the University of Arkansas – Pulaski Technical College
(UA-PTC).
3. Description of Supplies/Services Required to Meet the Agency’s Needs: The proposed action is to provide daily meals (breakfast and lunch meals) for students from the Air Force Installations Missions Support Center attending training for the VA Law Enforcement Training Center (LETC) at the University of Arkansas – Pulaski Technical College (UA-PTC). The following courses are offered to the Air Force Installations Mission Support Center: Department of the Air Force Civilian Police Academy, Department of the Air Force Law Enforcement Academy, Department of the Air Force Supervisors Course, Department of the Air Force Leadership Course and Physical Fitness Appeals Tests. Students that attend training at UA-PTC are required to eat at the designated dining facility during their training period.
The contractor will provide breakfast and lunch meals for up to 65 students during the normal business week – Monday through Friday (to include holidays and weekends as necessary). The contractor must provide box lunches during periods of inclement weather that prevent students from leaving designated lodging facilities.
The vendor location shall be within an 10-mile radius of the UA-PTC facility. The vendor facility shall be a grill/buffet type of dining facility.
The anticipated total value of this requirement inclusive of the base period and one one-year option is $627,800.00.
4. Statutory Authority Permitting Other than Full and Open Competition: The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1), as implemented by FAR 6.302-1 (b)(3) “Only one responsible source and no other supplies or services will satisfy agency requirements”.
5. Demonstration of Contractor’s Unique Qualifications: UA-PTC is located within a half mile of the lodging facilities at the LETC campus. This close proximity allows
LETC to maximize the limited resources to a facility that has adequate resources for providing daily meals, training space, driving track, and graduation hall. This provides for better instructor coordination in the event of needing supplies or additional course material. Furthermore, having the course located at UA-PTC greatly reduces training space needs, logistical problems with travel, and lost training time. UA-PTC operates the campus dining facility. UA-PTC provides a full range of institutional food service capabilities. The University provides both on-site and off-site services for the UA- PTC campus. Because all of the students are in temporary duty (TDY) status, these LETC trainees do not have routine access to transportation. The courses being taught will be held at UA-Pulaski Technical College. UA PTC has its dining facility on campus and does not permit other entities to set up and provide food services on campus. The UA-PTC dining facility is the only facility meeting that requirement, and as such they are the only source that can fulfill the requirement.
6. Description of Efforts: The proposed action will be synopsized on System for Award Management (SAM) in accordance with FAR Section 5.203(a). It will be requested that interested parties provide evidence of their capabilities to fulfill the requirement within seven calendar days after the date of publication of the notice. As required by FAR 6.305(a) the agency shall make publicly available the justification 14 days after the contract award.
7. The determination that the Order Represents Best Value Consistent with Fair and Reasonable Pricing: No award shall be made until the Contracting Officer determines the price to the Government is fair and reasonable. This determination will be based on a comparison of current contract pricing in the market, the Independent Government Cost Estimate, or other information made available consistent with Federal Acquisition Regulation (FAR) 13. The Government anticipates commercial pricing consistent with (or better than) non-Government student pricing.
8. Description of Market Research Conducted: Government employees with intimate knowledge of the local area were contacted to provide a detailed analysis of viable options to fulfill the requirement. The Law Enforcement Training Center has multiple active contracts with vendors for similar requirements but none are capable of meeting all the requirements. Based on intricate knowledge of the logistical infrastructure of the immediate area, it has been determined that Pulaski University is the only entity capable of fulfilling the needs of the organization.
9. Any other facts supporting the use of other than full and open competition:

12. Technical and Requirements Certification: Pursuant to FAR 6.303-1(c), I certify that the requirement outlined in this justification is a bona fide need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
