About this file
This sole source justification document proposes a one-year bridge contract with Artisan Dental Laboratory to provide fixed and removable dental prosthetics to two VA medical centers in Portland, Oregon. The vendor has specialized capabilities in restorative dentistry, cosmetic dentistry, prosthodontics, and implantology and is the only source able to provide same-day pickup of orders placed by noon. Approximately 20% of the VA's monthly dental cases require this timely service. The vendor has agreed to offer the same pricing as the previous year's contract. The justification cites 41 USC 3304(a)(1) as the authority for the noncompetitive procurement as only this vendor can meet the agency's needs without delay.

DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID: 36C260-20-AP-4887

3. Description of Supplies/Services Required to Meet the Agency’s Needs: The vendor shall provide fixed and removable dental prosthetics to the Portland and Vancouver Dental Clinics of the VA Portland Health Care System.
4. Statutory Authority Permitting Other than Full and Open Competition:
( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;
( ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2;
( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3;

( ) (6) National Security per 41 USC §3304(a)(6) as implemented by FAR 6.302-6;
( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7;
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition
Requires the Use of the Authority Cited Above (applicability of authority): Artisan Dental Laboratory has the highly specialized technical capabilities of providing restorative dentistry, cosmetic dentistry, prosthodontics, and implantology. It has been provided fixed dental prosthetic services to VA Portland Health Care System since 2013. Accordingly, Artisan is the only firm capable of providing the supplies and services described in Section III above without the Veterans’ Health Administration experiencing unacceptable delays in fulfilling its requirements.
6. Only One Responsible Source (FAR 6.302-1): This is a follow on one year bridge contract for the continued highly specialized provision of restorative dentistry, cosmetic dentistry, prosthodontics and implantology. Artisan Dental Laboratory, Inc. is the only vendor available within Oregon to provide same day pick up of prescriptions/specifications and impressions, with orders placed no later than 12:00 noon. The dental management staff at the Portland VA Health Care System analyzed previous veteran dental utilization data and found that approximately 20% of its total monthly cases between its two dental clinic sites (20 cases) rely on same day pick up. It is
OFOC SOP Revision 10 Page 2 of 3 Original Date: 03/22/11 Revision 10 Date: 09/10/2020 paramount that this bridge contract be continued with this vendor in order to not disrupt this same day service.
Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Artisan Dental Laboratory, Inc. has agreed to offer the same individual item price schedule as used in last year’s dental task order 36C26020N0084. Going out for competitive bid m y delay and/or disrupt the continuation of dental prosthetic services to veterans in the Portland region, and could end up costing more to achieve the same level of specialized and same day pick up services.
Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The Individual Item Pricing Schedule and Estimated Quantities List (Schedule D) included in the previously awarded dental task order 36C26019D0001 36C26020N0084 was determined to be fair and reasonable. Artisan Dental Laboratory, Inc. has agreed to offer the same individual item price schedule to be included in the 12-month bridge contract.
Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Used VA’s VIP database to identify verified capable SDVOSBs and VOSBs.
A search on Vetbiz.gov was conducted using NAICS code 339116- Dental Laboratories. The search revealed 67 SDVOSB/VOSBs registered under this NAICS code. Green Apple Dental Management, LLC was the only vendor registered under this NAICS code is based in St. Paul, Oregon. This service is unable to be sole sourced to this vendor because one of the requirements for this contract is same day pick up of prescriptions/specifications and impressions, with orders placed no later than 12:00 noon. It is not likely that this vendor would provide the needed pick-up service for VA facilities located outside Oregon (e.g., Alaska, Idaho, Eastern Washington, etc.). Additionally, per FAR Part 19.1405(b)(1), as only 1 SDVOSB has been found in Oregon, this requirement cannot set-aside for SDVOSBs.
