About this file

This document is a Sole Source Justification under FAR 13.5 Simplified Procedures for Certain Commercial Items. It describes a procurement by the Department of Veterans Affairs, VISN 1, West Haven VA Medical Center for the continued monthly lease of a Siemens Horizon 16-slice mobile PET/CT system. The mobile unit is required for a 5-month period from 10/02/2024 to 02/01/2025 while the medical center undergoes construction and HVAC work. The justification cites only one responsible source, RAYUS Radiology, which currently has the mobile PET/CT unit on site under a prior contract. Full and open competition is not feasible due to the short timeline and need for seamless transition of services. The estimated total cost for the 5-month lease is provided. This is a sole source procurement under FAR 13.5 procedures.

The related Federal Contract Opportunity is a Special Notice announcing the VA's intent to sole source the requirement to RAYUS Radiology. The notice provides the opportunity for other interested parties to respond by September 27, 2024, but states this is not a request for competitive proposals.

Acquisition ID#: 36C241 24 AP 4379 on SBA DSBS using NAICS 621512 along with keyword “Siemens” which yielded 1 small business profiles for MEDICAL DATA INFORMATION SERVICES, INC. whose capability statement states they are a leader in the service of nuclear imaging equipment by providing planned maintenance and emergency service on Siemens equipment throughout the United States, however West Haven VAMC is not seeking servicing nor maintenance services for this Siemens Horizon Mobile PET/CT System. Full and open competition would cause undue delays and costs which will impact West Haven VAMC Radiology Department’s ability to provide PET/CT imaging which would cause patient safety issues and abysmal patient care. An intent to sole source notice will be published to Contract Opportunities under solicitation ID 36C24124Q0932.West Haven VAMC will continue their lease of

(1) Siemens Horizon 16 slice mobile PET/CT for another 150 days, currently onsite under contract number 36C24123P0763.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: West Haven VA Medical Center is already leasing this Siemens Horizon PET/CT provided by RAYUS Radiology that is currently onsite under contract 36C24123P0763. If West Haven VAMC was to lose this scanner, they wouldn't be able to continue PET CT scans until a new vendor is found who could provide the same type of PET CT scanner. There is no time for applications and software training on a newer system as the project is really near completion.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: RAYUS Radiology, 5775 Wayzata Blvd., 400 St. Louis Park. MN 55416. In order to continue radiology services at normal operations this is the only potential source.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: No actions will be taken to overcome barriers. West Haven VA Medical Center is already leasing this Siemens Horizon PET/CT provided by RAYUS Radiology that is currently onsite under contract 36C24123P0763.

12.
