About this file

This document is a sole source justification for a six-month contract to provide ambulance services for the Department of Veterans Affairs Veterans Health Administration Veterans Integrated Service Network 5. The contract is estimated at $500,000 and would cover the period from October 1, 2023 to March 31, 2024 to ensure uninterrupted service when the current contract expires on September 30, 2023. The justification cites unusual and compelling urgency due to the need to transport non-ambulatory veterans to medical appointments. The sole source is the incumbent contractor, Med-Care Transportation LLC, which offered the same rates as the current contract. A competitive acquisition for future ambulance services is planned for award on April 1, 2024 following additional market research.

VHAPG Part 813.5 Simplified Acquisition Procedures for Certain Commercial Items 36C245-23-AP-3758: Sole Source Justification > SAT-$7.5M under FAR13.5

DEPARTMENT OF VETERANS AFFAIRS

SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN

COMMERCIAL ITEMS IN ACCORDANCE WITH FAR 13.5

Acquisition Plan Action ID: 36C245-23-AP-3758

1. Contracting Activity:

Department of Veterans Affairs VISN 05, Baltimore VA Medical Center Medical Administration Service (MAS) 10 North Greene Street Baltimore, MD 21201 Purchase Request/2237#: 512-24-1-825-0005

2. Nature and/or Description of the Action Being Processed:

This procurement is for services to provide special mode ambulance transportation for beneficiary eligible Veterans to and from scheduled and unscheduled VA, Veterans Choice, and dialysis appointments.

After reviewing the action, this will be awarded as a new 6-month, firm fixed price contract.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

This 6-month contract to provide special mode ambulance transportation for Veterans is estimated to cost about $500,000.00. Period of performance will be from 10/1/23 to 3/31/24.

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

( ) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

(x) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority)

The estimated dollar value for a base plus four option years is over the $7.5 million threshold, it requires detailed market research, reviews, and solicitation. It will take up to 6 months to have the new contract in place. However, the current ambulance contract ends on 9/30/23. If the new contract is not in place by 10/1/23 will significantly impact direct patient care, crippling the VA ability to transport our most vulnerable Veteran population to and from their appointments.

Unusual and Compelling Urgency - Awarding a 6 month contract to the incumbent by 10/1/23 will guarantee Veterans continue receiving the ambulance transportation needed for their doctor’s appointment. Our non-ambulatory Veterans are totally dependent on this service to get them to and from appointments and other medically necessary services i.e., dialysis etc.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

This purpose of this 6-month contract is to allow ample time to perform detail market research to understand the current market and maximize the competition for the new base plus four option years contract.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

The current contract was competed, and the incumbent was considered technically acceptable, and its pricing was considered fair and reasonable. With the new 6-month contract, the incumbent offered the same rate as it was on the current contract 36C24518D0168 and considered fair and reasonable compared to the IGCE. This would minimize the administrative costs for both the Government and industry.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

As described in Section 6 above, market research, in accordance with FAR 13.5, was conducted by requesting quote from the incumbent to minimize burden and administrative costs for both the Government and industry.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

FAR 13.5

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

Med-Care Transportation, LLC

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

A competitive acquisition for the ambulance services is planned to be awarded on 4/1/24.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
