41 USC §3304(a)(5), 38 U.S. Code § 8127(c), as implemented by RFO 6.103-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 (DEVIATION) or VAAR 819.7009 (DEVIATION)- up to $5,000,000. Check the specific VAAR clause used below:
(X ) 819.7008 Sole source awards to a certified service-disabled veteran-owned small business; or ( ) 819.7009 Sole source awards to a certified veteran-owned small business
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the
Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
It has been determined under the authority 38 U.S.C. 8127 (c) that the SDVOSB concerns has been determined to be a responsible source with respect to performance. In this case, the selected vendor, Sergent Construction Inc. is a verified Service-Disabled Veteran Owned Small Business (SDVOSB) and has been identified as the only responsible source capable of delivering the required solution within the required timeframe. Attempting to pursue a full and open competition of alternate procurement s strategy would create unacceptable delays an jeopardize the VA’s ability to execute on its promised outcome.
Sergeant Construction, has EHRM JSA- FDS expertise and has extensive knowledge of the AVAHCS. Sergeant Construction meets the eligibility criteria outlined in VAAR 819.7003 (DEVIATION) for award. They are a verified SDVOSB, and have a history of responsible performance and pricing that is consistently found fair and reasonable. Their leadership team is responsive to requests and timely in the delivery of information, and as such it is determined that they are the preferred contractor to be selected for this requirement.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by RFO 6.301 and, if not, which exemption under RFO 5.101(b)(1) applies:
Given the urgency to make the award within 30 days, the CO has determined that a sole source Vets First award to a Service-Disabled Veteran Owned Small Business (SDVOSB), in accordance with VAAR 819.7008 to be legally permissible and operationally necessary. Although there are multiple potential sources available, the need for expedited award justifies this approach. This contractor is mobilized and this work is needed to support the EHRM project as a whole. This Justification and Approval (JA) shall be published on SAM.gov within 14 days of the award and will remain posted for a minimum of 30 days.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
It is anticipated that Sergeant Construction Inc. will submit pricing that is able to be determined fair and reasonable to perform the work mentioned above. This anticipation is based on historical pricing data from Sergeant Construction Inc. In order to determine the price is fair and reasonable, the CO will perform price analysis by comparing the proposed pricing to the IGCE and may also enter into price negotiation (RFO 6.104-1(7)) to ensure fair and reasonable pricing is obtained.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
There are 19 VOSB/SDVOSB contractors were identified for NAICS code 236220.
Due to the timeframe for award, it has been determined that this requirement is best met with a sole-source award to a verified SDVOSB. Many of those 19 firms do general construction, but few specialize in mission-critical VA IT electrical power upgrades. Sergeant Construction meets the eligibility criteria outlined in VAAR
819.7003 for award.
