SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL

ITEMS IN ACCORDANCE WITH FAR 13.5

Acquisition Plan Action ID: 36C262-25-AP-2941

1. Contracting Activity: The Department of Veteran Affairs NCO 22 - Contracting Office proposes a new contract for the VISN 22, Northern Arizona VA Healthcare System, located at 500 N. State Route 89, Prescott Arizona 86313. The Contracting Office proposes a standalone Firm-Fixed Price Contract with contractor LiveView Technology.

2. Nature and/or Description of the Action Being Processed: This is a requirement for a firm-fixed price contract that can only be provided by LiveView Technologies due to licensing, patents and proprietary rights. The sole source justification is in accordance with Simplified Procedures for Certain Commercial Items, specifically for a proposed contract exceeding $250,000, FAR 13.501(a)(2)(ii). Information from special documentation requirements in accordance with FAR6.303-2 is met below. The value of the contract is $384,312.40.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: This is a firm-fixed price contract to provide all necessary parts, labor, transportation, system updates and upgrades, and services required for Mobile Camera Trailers for physical security for Northern Arizona VA Healthcare System. The contract number is 36C26225C0210.

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

(X) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): LiveView Technologies holds the proprietary and patented technologies need to integrate with the system. The Live View Technology D3 security system works with and is partner with existing AXON body worn cameras that are used and contracted by VHA. No other similar systems are appropriate for the VAPD use as the LVT and AXON partnership ensures evidence tracking and accountability.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Market research was performed and revealed there are no SDVOSB/VOSB vendors capable of providing the requested services due the proprietary rights held by the OEM. The equipment contains proprietary licensing/software required for the effective integration and operability of the system; therefore, only LiveView can provide services for the Equipment.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: LiveView provided a proposal for $384,312.40 for a base year plus four options that addresses the requirement. The cost is considered fair and reasonable based on the market research and the Independent Government Cost Estimate.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted: LiveView Technologies holds technologies with proprietary software to enhance public safety through a unified system for law enforcement. LiveView is the sole contractor that can provide the service.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A

No other action performed. Market research will continue; Another requirement is necessary after the current period of performance of 06/01/2025 to 05/31/2026.

Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
