DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
VHAPM Part 813.106 Page 1 of 1 Original Date: 08/30/17 Revision 02 Eff Date: 03/31/2020
Acquisition Plan Action ID: 36C249-21-AP-0690
1. Contracting Activity: Department of Veterans Affairs, VISN 09, Memphis Medical Center [Facility]
NCO9; PR 614-21-1-031-0268
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
Qty: 350 vials, VEKLURY (REMDESIVIR) 100MG VIA, used to treat COVID-19 patients.
Estimated Value/Amount: $136,237.50
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Facility submitted their attachment 13 – Drug Checklist where the NAC contractor, Gilead, does not directly handle orders and delivery for the items in paragraph 2. ASD Specialty Healthcare handles logistics and distribution for Gilead. Thus, all ordering and delivery is through ASD Specialty Healthcare who doesn’t have a NAC Contract but passes Gilead’s NAC Contract prices on to its customers.
4. Description of market research conducted and results or statement why it was not conducted:
Market research confirmed no SD/VOSBs can meet this requirement as this procurement is both urgent and for an item peculiar to one manufacturer, Gilead.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
