P03 Single Source Justification 36C262-23-AP-5156
Last Updated: 02/01/22 Page 1 of 2
DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C262-23-AP-5156
1. Contracting Activity: Department of Veterans Affairs, VISN 22, Greater Los Angeles VA
Healthcare System, multiple locations. 2237# 691-23-3-5091-0166.
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
The Government requires the immediate issuance of a bridge contract for three (3) months to continue maintenance and repair of medical air, medical vacuum systems, oxygen systems, vacuum systems, and dental vacuum systems located within multiple locations at the Greater Los Angeles VA Healthcare System. This bridge contract shall contain a period of performance of 04/01/2023 – 06/30/2023. The total estimated amount of this contract is $42,765.00.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
The Department of Veterans Affairs, Network Contracting Office failed to exercise option year 3 of contract 36C26221C0065. In which, the services requested under acquisition plan 36C262-23-AP- 5156 were previously covered. Contract 36C26221C0065 expired on 03/30/2023 and is unable to be exercised any further. The maintenance services previously covered under contract 36C26221C0065 are still required. The services are patient critical and would cause an extreme safety hazard and injury to patients, and potential loss of medical licensure to the Greater Los Angeles VA Healthcare System if services lapsed. This classifies the requirement as an emergency acquisition IAW FAR 6.302-2 Unusual and Compelling Urgency.
Due to emergency circumstances, the Government intends to award a sole source award to Certified Medical Sales, LLC. (the incumbent contractor) IAW FAR 13.106-3(b) and FAR 6.302-2 Unusual and Compelling Urgency.
4. Description of market research conducted and results or statement why it was not conducted:
Market research was conducted through the search and query of documentation for previous awards, SBA’s vetcert query, and FPDS.
This requirement was previously awarded to Certified Medical Sales, LLC under contract 36C26221C0065. This requirement was originally solicited as a small business set-aside. Certified Medical Sales, LLC was the only respondent to solicitation 36C26221Q0396. Contract 36C26221C0065 was awarded to Certified Medical Sales, LLC on 03/24/2023 for a 1 year base period and 4 one-year option periods. The total contract value for 36C26221C0065 was $857,241.00.
