About this file

This document is a Single Source Justification form for a sole source procurement by the Department of Veterans Affairs (VA), specifically for the Buffalo VA Medical Center (VAMC). The VA intends to purchase one Siemens MAX wi-D radiographic fluoroscopy (RF) detector for $140,188.80 to replace a broken detector in their existing Luminos Agile Max fluoroscopy and radiography system. The procurement is justified because the system requires Siemens-manufactured components, and Siemens is the original equipment manufacturer with no authorized distributors.

Market research was conducted in June 2025, including searches on VetCert, SBA's DSBS, and FPDS, which revealed 98 results for the NAICS code, 1 small business vendor, and 11 previous contract actions (9 awarded to Siemens Medical Solutions USA, Inc.). The VA has determined that Siemens is the only viable source for this specialized medical equipment, and the procurement is necessary to maintain full operational capacity in the Radiology department and prevent potential delays in patient x-ray services. The solicitation is not a competitive bid but a notice of intent to sole source, with interested vendors able to submit capability statements by 12:00 PM EST on June 23, 2025.

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Single Source Justification for SAP under the SAT

Revision: 01 Effective Date: 11/15/2024 Page 1 of 2 Acquisition ID#

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C242-25-AP-3184

1. Contracting Activity: Department of Veterans Affairs, VISN 02, Buffalo VA Medical

Center. Purchase request number 528-25-304803-0859.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: One (1) Siemens MAX wi-D radiographic fluoroscopy (RF) detector for the Buffalo VA Medical Center (VAMC). This is to replace the broken Siemens MAX wi-D RF detector in use at the Buffalo VAMC. The MAX wi-D is a wireless flat panel detector used in digital radiography systems, specifically within the Luminos Agile Max fluoroscopy and radiography system manufactured by Siemens used by the Buffalo VAMC. Estimated amount is $140,188.80.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The Buffalo VAMC currently uses a Luminos Agile Max fluoroscopy and radiography system manufactured by Siemens, of which the required RF detector is a part of. This system is composed entirely of components manufactuered by Siemens and any replacement parts must also be manufactured by Siemens. Siemens is the original equipment manufacturer (OEM) of the system and the RF detector and have no authorized distributors for this part.

The Luminos Agile Max fluoroscopy and radiography system is not fully operational until a replacement RF dectector is obtained. Without a fully operational fluoroscopy and radiography system the Radiology department at Buffalo VAMC is not operating at full capacity which could lead to delays in performing x-rays on patients.

4. Description of market research conducted and results or statement why it was not conducted:

Market research was conducted in June of 2025.

A search of VetCert using NAICS code 334517 returned 98 results.

A search of SBA’s DSBS using NAICS code 334517 and keyword “detector” returned 1 relevant small business vendor and 0 SD/VOSB vendors.

A search of FPDS using keywords “Max wi-d” returned 11 contract actions awarded by the VA. 9 of these actions were awarded to Siemens Medical Solutions USA, Inc.

The requirements package submitted by the program office included a quote from Siemens Medical Solutions USA, Inc. A representative from Siemens confirmed to this office that they have no authorized distributors for this equipment. Siemens is a large business.

5. Contracting Officer's Certification: Purchase is approved in accordance with

FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
