VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT

Last Updated: 02/01/22 Page 1 of 2

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C260-23-AP-1650

1. Contracting Activity: Department of Veterans Affairs, Regional Procurement Office West, Network

Contracting Office 20 on behalf of Grann-Mannstaff VA Medical Center. 2237: 668-23-2-9961-0058

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

Midmark Exam Chairs

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

Limited as per FAR 13.106-1(b)(1)(i) Brand Name. The facility currently uses the Midmark Exam Chairs. Staff is trained on the operation, disassembly, and cleaning of these chairs, and the facility needs continuity between exam areas, as well as the ability to move chairs if needed. Consistency in the functionalities of the exam chair from one exam area to the next avoids confusion between the use of these functionalities. A foot pedal in a different location, or stir-ups that extend and retract differently increases the amount of time it takes staff to examine patients. Proper patient positioning and seat height are needed for accurate blood pressure measurement. Incorrect seat height can lead to inaccurate measurement and lead to overmedication for hypertension. The Midmark s sturdy arm rests help patients safely onto the the chair. The chair s 650 pounds weight capacity allows for a broad range of patients to be treated, and consistency from one room to another allows staff to place patients in an exam room without the need for staff to ensure that one room is suitable where another may not be, avoiding mistakes which could lead to patient injury.

Consistency of the overall footprint of the chair from one room to another also allows for the design of the exam rooms to be consistent. Consistency from one exam area to another results in an overall savings of time and money, and reduces the chance of injury. For these reasons, it is the decision of the Contracting Officer that limiting this procurement to one source is in the best interest of the government.

4. Description of market research conducted and results or statement why it was not conducted:

FPDS and gsaelibrary.gsa.gov were searched. FPDS results show awards made to Midmark under contracts 36C25222F0257, 36C24922N0219, and 36C24722N0094. A Sources Sought Notice was posted on February 21, 2023, which closed February 28, 2023, revealing several SDVOSB and SB with authorized distributor letters, interested in, and capable of, fulfilling this requirement. In addition, several responses were received that stated interest in the requirement but provided no specific items, nor a courtesy quote, and, among the remaining 3 responses, 2 similar products were offered. However, the products lacked key features of the requirement. One has a weight rating of only 450 pounds. This is a significant difference, and as explained above, the continuity of weight capacity for the chairs between one exam area and another is important to patient sately. The

It does not adjust as low as the Midmark chair, thereby making it more difficult for patients with limited mobility to get onto the chair, and more difficult for staff in assisting a patient, in a wheel chair for example, to get on the chair. Patients with limited mobility can be difficult for the staff to move. The low height of the chair is needed to help staff avoid injury to themselves and the patient. The Midmark s patient support rails also appears to be more stable/sturdy compared to the product literature that was offered with the responses. The overall footprint of these two chairs is also different, and neither of these chairs came with any pricing for comparison. FPDS was searched to establish price reasonableness of the Midmark courtesy quotes, and the courtesy quotes submitted along with the Sources Sought responses were competitive among each other. Based on the NMR, this cannot be set aside for SDVOSB. Pursuant to 13 C.F.R. 121.406(c), the limitations on subcontracting and the nonmanufacturer rule do not apply to small business set aside acquisitions with an estimated value between the micro-purchase threshold and the simplified acquisition threshold. In the interest of promoting competition, it is therefore, in the best interest of the Government to fulfill this requirement by soliciting as a total small business set aside via SAM.gov.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.

Price reasonableness is documented on the S19 Open Market FAR 13 award documentation.
