About this file

This document is a single source justification for a sole source contract award. The Department of Veterans Affairs, Veterans Healthcare Administration, Regional Procurement Office West, Network Contracting Office 20 plans to award a firm fixed price contract valued at $144,820 to Sun Nuclear Corporation for a software upgrade. The upgrade is for the SunCHECK Patient QA software, which integrates with the VA Puget Sound Health Care System's existing Sun Nuclear ArcCHECK machine used for patient-specific quality assurance for IMRT and VMAT treatment plan delivery verification. The upgrade provides additional features such as per fraction dose monitoring and independent dose calculation compared to treatment planning. A search of federal contracting databases and a sources sought notice produced no alternative sources. As the sole owner of the proprietary software and ArcCHECK device, Sun Nuclear Corporation is determined to be the only responsible source able to provide the required upgrade, support, and regulatory compliance.

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT

Last Updated: 02/01/22 Page 1 of 2

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C260-23-AP-1997

1. Contracting Activity: Department of Veterans Affairs, Veterans Healthcare Administration, Regional

Procurement Office West, Network Contracting Office 20, 1601 East Fourth Plain Boulevard, Vancouver, WA 98661 on behalf of Veterans Integrated Service Network 20, VA Puget Sound Health Care System (VAPSHCS), Logistics (90), 2237: 663-23-2-9961-0026.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

VAPSHCS has a requirement for a firm fixed priced contract for a software upgrade. The new software, SunCHECK Patient QA, is an upgrade to their existing SunCHECK Patient Software, which works with the measuring device ArcCHECK® (VAPSHCS Inventory: EE #125298) used for Patient Specific QA for treatment plan delivery verification for all IMRT and VMAT plans. The software integrates Plan Checks, Secondary Calculations, Pre-Treatment QA and In-Vivo Monitoring into a single workflow, on the same platform as our Machine QA, and includes the following features:

a. PER FRACTION: Verifies and tracks Patient Dose through the Treatment Course. This Dose Monitoring on daily basis helps detect patient positioning errors, or changes in the tumor size. Therefore, adapt the treatment plan according to the anatomical changes. This will improve the accuracy of the dose delivered to the tumor and minimizes the dose to the surrounding healthy tissues.

b. DOSE CHECK: Independent performs Dose Calculation compared to the Treatment Planning.

Provides a more comprehensive 3D Clinical Analysis than our existing 2D RadCalc software, as required AAPM Medical Physics Practice Guideline 5.b (1)

c. PLAN CHECK: Automatically loads patient treatment plan and performs plan checks to assist the physicist in ensuring a safe and accurate treatment delivery, in accordance with AAPM Task Group 100 (2), AAPM Task Group 275 (3), and AAPM Medical Physics Practice Guideline 11a (4) to be in compliance with our accrediting institution ACR/APEx (5).

The total estimated value is: $144,820.00

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

SunCHECK Patient is the only software compatible with the existing Sun Nuclear ArcCHECK® Machine. Sun Nuclear Corporation owns the proprietary copyrights and is the sole source provider of Sun Nuclear software and the products it manufactures. Sun Nuclear Corporation is the only company that can provide repairs, software license renewal, phone and web-based support, service loaners, and regular updates to the Sun Nuclear products, including software upgrades for the measuring device ArcCHECK®. Therefore, IAW FAR 13.106-1(b)(1)(i), the Contracting Officer has determined that the circumstances of this contract action deem only one source reasonably available.

4. Description of market research conducted and results or statement why it was not conducted:

A search of SBA’s VetCert database using NAICS code 334519, populated 162 results. A dynamic small business search using NAICS code 334519 with key word “software” resulting in 140 results. A sources sought was posted on 05/03/2023, closing on 05/12/2023 produced zero (0) responses. The end user conducted extensive market research prior to the purchase of the existing Sun Nuclear ArcCHECK® Machine. This requirement is for a software upgrade to this machine. Sun Nuclear Corporation owns the proprietary copyrights and is the sole source provider of Sun Nuclear software and the products it manufactures.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
