Over Micro-Purchase Threshold but Not Exceeding the Simplified Acquisition Threshold

1. Contracting Activity: Department of Veterans Affairs, VISN 22, in Albuquerque Medical
Center, seeks to procure the supplies / services listed in purchase request 501-26-2-119-0061 for the VA Albuquerque Healthcare System.
2. Brief Description of Supplies/ Services required and the intended use/Estimated

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
VA Albuquerque Healthcare System utilizes Spectralis OCT for ophthalmic imaging throughout its network. This proprietary Heidelberg Engineering platform is exclusively compatible with Heidelberg’s own Heyex ophthalmologic data management software for diagnostics, reports, and maps. The current version of Heyex in place at VA Loma Linda is end-of-life per the vendor and can no longer receive updates to its servers and PCs, compromising the systems compliance with VA cybersecurity standards. The purpose of this contract is to upgrade the Heyex system to Heyex 2, allowing the decommissioning of all non-compliant components without preventing clinical needs to be met as well as providing the latest technology.
The Spectralis OCT system is not compatible with any other patient data management system and per the vendor, “Heidelberg Engineering, Inc., its wholly owned subsidiary, is the only source for this equipment and service in the United States. L1 Enterprises is the only authorized distributor of the Heidelberg Engineering products and services for U.S.
government accounts.”
4. Description of market research conducted and results or statement why it was not conducted:
Market research was conducted to find other ophthalmology patient data management systems compatible with the Spectralis OCTs, but it was confirmed Heyex 2 is the only capable system. Also, it was confirmed no other vendor other than L1 Enterprises can provide the needed products and services.

Results of SBA Dynamic database query by applicable NAICS code 339115 identified 193 SDVOSB / VOSB vendors. Due to exclusive licensing agreements of proprietary software / technology, the contracting officer determined circumstances of contract action deem only one source reasonably available due exclusive licensing agreements of proprietary software / technology, urgency, time constraints, and no other supplies or services will meet agency need. CO recommends VAAR 819.7008 - sole source award to verified service-disabled veteran-owned small businesses IAW FAR Part 13.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR 13.106-
1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief, and the price offered is determined to be fair and reasonable.
