About this file
This is a Single Source Justification document for a simplified acquisition procurement by the Department of Veterans Affairs. The contracting activity is VISN 12 at William S. Middleton Memorial Veterans Hospital in Madison, Wisconsin (Purchase Request 607-27-1-6023-0002, Acquisition ID 36C252-27-AP-0148). The procurement is for monthly maintenance and chemical additive processing services for a proprietary drain system at Madison VA Hospital, with the purchase value exceeding the Micro-Purchase Threshold but not exceeding the Simplified Acquisition Threshold.
The justification establishes that NCH Corporation (doing business as ChemSearch) is the sole source capable of providing the required services. Madison VA Hospital utilizes the Bio-Amp System, a patented technology developed exclusively by NCH Corporation that employs a "Free-Flow" biological treatment component containing specialized bacteria for wastewater system treatment. NCH Corporation is the only firm authorized to manufacture, distribute, and maintain this proprietary system and its biological additives. Market research conducted through multiple VA and Government databases identified no alternative vendors, including Small Business, Veteran-Owned Small Business (VOSB), or Service-Disabled Veteran-Owned Small Business (SDVOSB) firms capable of providing equivalent services. Additionally, a Special Notice posted to SAM.gov requesting capability statements from any other interested vendors yielded no responses. The Contracting Officer, Dustin Biermann, certified approval of the single-source award in accordance with FAR 13.106-1(b).

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for MPT up to SAT
Revision: 02 Effective Date: 12/30/2025 Page 1 of 1 Acquisition ID# 36C252-27-AP-0148
DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the Simplified Acquisition Threshold
Acquisition Plan Action ID: 36C252-27-AP-0148
1. Contracting Activity: Department of Veterans Affairs, VISN 12, William S.
Middleton Memorial Veterans Hospital (purchase request 607-27-1-6023-0002).
2. Brief Description of Supplies/Services required and the intended use/Estimated Amount:
Monthly maintenance and chemical additive processing of proprietary drain system at the Madison VA Hospital.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
The Madison VAH utilizes the Bio-Amp System in its drain system which is a unique technology developed and patented by NCH Corporation (DBA ChemSearch). This system uses a “Free-Flow” biological treatment component which contains certain bacteria which activates in the Bio-Amp system and dispenses into the wastewater system.
NCH Corporation is the proprietary vendor for this system and the biological additives and is the only firm authorized to manufacture, distribute, and maintain the system, which satisfies the requirements of FAR 13.106-1(b).
4. Description of market research conducted and results or statement why it was not conducted:
Market research used multiple VA/Government databases to attempt to identify any other firms (including SDVOSBs, VOSBs, and Small Business) which may be able to offer services to the Bio-Amp Free-Flow system, and none were identified.
Additionally, the Contracting Officer issued a Special Notice to SAM.gov which signaled the Government’s intent to issue a Single-Source award to NCH Corporation and requested any other vendors who believed they were capable to contact the CO with a capability statement. No vendors replied to the Special Notice.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR
13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
Dustin Biermann Contracting Officer
