About this file
This document is a Justification and Approval (J&A) for a sole source contract award to a Service-Disabled Veteran-Owned Small Business (SDVOSB) under Veterans Affairs acquisition authority.
The Department of Veterans Affairs, through its Veterans Health Administration Regional Procurement Office West, Network Contracting Office 20, is awarding a new contract to Global Engineering Services (GES), an SBA-certified SDVOSB, for flooring removal and installation work at the Boise VA Medical Center's Building 54 (Education Building). The scope includes removal and disposal of existing carpet, wall base, and associated materials; subfloor preparation; installation of new underlayment; installation of new vinyl flooring; and installation of a new 4-inch rubber wall base. The acquisition is justified as a sole source award under VAAR 819.7008 and 38 U.S.C. § 8127(c) based on GES's current adjacent work that reduces mobilization costs, demonstrated past performance on similar VA contracts (specifically contract 36C26026N0104), and the critical operational need to complete the work quickly to maintain building accessibility and safe operations. The Contracting Officer conducted outreach to four Idaho-based SDVOSB vendors, all of whom expressed interest, but determined that proceeding with full competitive procedures would cause unnecessary delays and operational impacts. Fair and reasonable pricing will be verified through comparison with the Independent Government Estimate and prior similar project pricing. The contract is identified by Acquisition Plan Action ID 36C260-26-AP-2617 and JOFOC Tracking# FY26-NCO20-1118.

VHAPG Part 819.7008/7009 Sole Source Awards to SDVOSB/VOSB Page 1 of 3 Revision: 03 Effective Date: 06/15/2024
DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition
Acquisition Plan Action ID:_ 36C260-26-AP-2617 JOFOC Tracking#:: FY26-NCO20-1118
1. Contracting Activity: Department of Veterans Affairs (VA), Veterans Health Administration, Regional
Procurement Office West, Network Contracting Office 20, in support of the Veterans Integrated Service Network 20, Boise VA Medical Center.
2. Nature and/or Description of the Action Being Approved: This is a new contract for the removal and disposal of existing carpet, wall base, and associated materials; preparation of the subfloor; installation of new underlayment as required due to the age and condition of the building; installation of new vinyl flooring; and installation of a new 4" rubber wall base. The vendor, Global Engineering Services (GES) has indicated an interest to perform the work.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: GES, an SBA certified SDVOSB vendor presently performing work in an area adjacent to the B. 54 Education building thereby reducing its costs to mobilize for this project of the flooring to be removed and vinyl flooring installed. In addition to the present contract awarded to GES they have successfully completed other awarded contracts demonstrating their capability and understanding of previous contract work. Based on the above information and the need to ensure safety and safe operations at the Education Building, a sole source SDVOSB award to GES under VAAR 819.7008 has been found to be in the government’s best interest.
4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S. Code §
8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 (DEVIATION) or VAAR 819.7009 (DEVIATION) up to . Check the specific VAAR clause used below:
(X) 819.7008 Sole source awards to a certified service-disabled veteran-owned small business; or ( ) 819.7009 Sole source awards to a certified veteran-owned small business
5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): GES has demonstrated in its previous contracts, specifically 36C26026N0104, that it can successfully perform the removal of flooring at a fair and reasonable price. This requirement is necessary to be performed as soon as possible, in order to maintain the accessibility of Bldg. 54 Education Building. Given these factors and the need to ensure continued operations at the medical center, the VA is exercising its statutory authority to award non‑competitive contracts to SDVOSBs under . Therefore, a sole source SDVOSB award to GES under VAAR
819.7008 has been determined to be in the Government’s best interest.
This SDVOSB award will be based on 38 U.S.C. 8127(c) and the SDVOSB in concern, GES has been determined to be a responsible source with respect to performance. Additionally, the CO has determined the vendor meets eligibility requirements outlined in 819.7003(DEVIATION).

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by FAR Subpart
5.2 and, if not, which exception under FAR 5.202 applies: Upon receipt of this requirements package, the Contract Specialist conducted outreach to known Service-Disabled Veteran-Owned Small Business (SDVOSB) vendors to assess interest in the requirement. Four SDVOSB vendors located in Idaho were identified, and all four expressed interest in the requirement.
Given the need to complete the flooring removal and installation to maintain accessibility and safe operations within Building 54 (Education Building), the Contracting Officer determined that proceeding with full solicitation procedures – including public notice, the receipt of quotes and evaluation panel review would result in avoidable delays and potential operational impacts. Furthermore, this reduces labor hours within the NCO to allow for personnel to work on Market Research from prior award 36C26026N0104 for similar flooring removal work was reviewed and supports the conclusion that a sole source award to GES is in the Government’s best interest. While additional SDVOSBs, small business and large business vendors may be capable of performing this requirement, GES IS uniquely positioned to respond quickly due to ongoing work in the adjacent area and a record of strong past performance on similar VA contracts. Based on these factors, this SDVOSB award will be based on 38 U.S.C. 8127(c) and the SDVOSB in concern, GES has been determined to be a responsible source with respect to performance. Additionally, the CO has determined the vendor meets eligibility requirements outlined in 819.7003(DEVIATION)
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The Contracting Officer will ensure the final contract price is fair and reasonable by reviewing the Independent Government Estimate (IGE) and comparing it to pricing from previously awarded contracts of similar scope, size, and technical complexity. Based on previous project pricing, GES is known to provide fair and reasonable pricing. There is every expectation that the price quoted will be fair and reasonable.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research, conducted through a Sources Sought notice posted on SAM.gov, confirmed the presence of capable SDVOSB firms. Based on this market research, the Contracting Officer has determined that proceeding with a direct SDVOSB award is justified under 38 U.S.C. 8127(c).
Awarding this requirement as a direct SDVOSB sole source supports operational efficiency, reduces administrative burden, and enables the VA to expedite necessary flooring repairs while preserving workforce capacity for higher priority acquisitions. The intended awardee, GES, is an eligible SDVOSB certified in SBA Cert. Based on the limited timeframe to get this requirement awarded, minimal market research was conducted. GES has provided adequate documentation on previous requirements demonstrating technical capability to meet the VA need, positive past performance information (to include contract 36C26026C0014), and the CO anticipates receiving fair and reasonable pricing. This is a critical requirement necessary to be performed as soon as possible, in order to ensure no unnecessary delays for the completion of this work which would cause an undue hardship on the Education building and its accessibility to individuals. Through this process GES was identified and verified capable of meeting the VA needs.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: No other authorities utilized, this award will be under VAAR 819.7008 (DEVIATION) as authorized by 38 USC 8127(c).

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: As stated above, the CO has relied on market research conducted under AP 36C260-26-AP-0856.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to
Competition before Making subsequent acquisitions for the supplies or services required: This is to support a critical acquisition to remove carpeting and replace with vinyl flooring. It is not anticipated to have any follow-on work that would need to be competed.
