About this file
This is a Sole Source Justification document for a Federal Supply Schedule (FSS) procurement by the Department of Veterans Affairs, VISN 02 Contracting Office in Albany, New York.
The acquisition seeks to procure a Caterpillar Front Loader (920 14A Wheel Loader) valued at $156,590.73 from Federal Contracts LLC, located at 12918 N Nebraska Ave, Tampa, FL 33612, under FSS Contract Number GS-03F-113DA. The sole source justification is based on GSAM/R 538.7104-4, citing that the item must be a Caterpillar to facilitate a trade-in of the government's current Caterpillar 420 Front Loader, thereby reducing costs to the government. Market research conducted through GSA schedules, ADDSUP, DSBS, and SAM FPDS identified multiple Caterpillar results but found no other SDVOSB (Service-Disabled Veteran-Owned Small Business) contractors capable of both selling the equipment and accepting a trade-in. The justification notes that Federal Contracts LLC, while initially appearing as an SDVOSB on GSA, lost that status on June 27, 2024. The contracting officer determined this procurement represents best value by allowing the government to leverage the trade-in option while utilizing an FSS contract vehicle. Eric Adams, the requestor's supervisor, and Corey Swinton, the Contracting Officer, digitally signed the certification on September 15-16, 2026, confirming the accuracy and completeness of the justification as a bona fide need of the Department of Veterans Affairs.

GSA was searched for 920 14A Wheel Loader and there was one result and shows the company as an SDVOSB but further research shows they lost their SDVOSB status on 6/27/2024– Federal Contracts
LLC
ADDSUP was searched for Caterpillar Front Loader and there are multiple results.
DSBS was searched for NAICS code 333120 and there were 2,145 results. It was also searched for NAICS code 333120 and key word “Front Loader” and there were 0 results. It was also searched for UEI - TK67EL9NPMD9 and Federal Contracts LLC is a small business but not an SDVOSB
DSBS was filtered for SDVOSB’s was searched for NAICS code 333120 and there were 228 results. It was also searched for NAICS code 333112 and key word “Front Loader” and there were 0 results.
SAM FPDS was searched for Front Loader and there were multiple results that helped define the NAICS code and fair and reasonable pricing.
7. Any Other Facts Supporting the Justification: The government needs to trade-in their current Front
Loader that will lessen the financial impact to the government.
8. A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made:
There are no actions the government could take to overcome barriers to the restriction except possibly finding 2 SDVOSB open market contractors that would not only be able to sell the item in question but would also have to be capable of taking a trade-in.
9. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide
Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this sole source justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by GSAM/R 538.71 as directed by RFO 8.4.
