VHAPM Part 808.405‐6 Limiting Sources Page 2 of 4 Original Date: 08/30/2017 Revision 02 Eff Date: 02/21/2020 original order must not have been previously issued under sole source or limited source procedures.
FAR 8.405‐6(b): Items peculiar to one manufacturer:
A patent, copyright or proprietary data limits competition. The proprietary data is:
The curriculum and the manuals for “Re‐Igniting the Spirit of Caring” copyright © 2003, 2009, 2016 workshop were created and developed by Creative Health Care Management (CHCM). CHCM owns the copyright for the Relationship‐Based Care© delivery model and the proprietary training and training materials of the supporting workshops. CHCM is only company that can provide licensing and training materials for Relationship‐Based Care supporting workshops such as: Re‐Igniting the Spirit of Caring. CHCM does not use a 3rd party vendor to provide training services or materials.
These are “direct replacements” parts/components for existing equipment.
The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing.
(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination:
Based on only one source reasonably available due to exclusive licensing agreements by Creative Health Care Management, Inc. (CHCM), it is recommended that this procurement be issued as a sole source firm‐fixed price award in accordance with FAR 8.403(b). Additionally, CHCM is offering a one percent (1%) discount on its services for the entire contract period (Base + Four (4) Option Years) from its GSA Schedule#47QSEA18D000A.
(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted.
A search in VIP was performed using Keyword: Creative Health Care and it did not identify any SDVOSBs and/or VOSBs. Another search was done in GSA e‐library (using Keyword: Creative Health Care Management) and it was found that CHCM has a GSA Schedule#47QSEA18D000A.
Upon a search in SAM, Creative Health Care Management, Inc. is a small business. Upon contacting Creative Health Care Management, Inc., they provided documentation that they are the only authorized vendor and have provided a proprietary lettering stating that they are the sole source authorized dealer in addition to stating that there are no other authorized resellers.
(7) Any Other Facts Supporting the Justification:
Re‐igniting the Spirit of Caring is a three‐day work shop (course) that is a licensed program from
Creative Healthcare Management (CHCM), a Nurse‐owned small US company started by Marie
Manthey, a pioneer in the human caring element of Nursing , renown Nurse theorist and founder of Primary Nursing, This is the only course of its kind, directly relates to keeping the patient at the center of care decisions and contributing to outcomes of a renewed intent to focus on self‐ care, to treat co‐workers with compassion, and to re‐commit to providing excellent patient care.
Many VAs are currently running the course on a monthly basis with staff facilitators, trained and mentored through CHCM. Palo Alto VA started the program last year and their Nurse Executive
VHAPM Part 808.405‐6 Limiting Sources Page 3 of 4 Original Date: 08/30/2017 Revision 02 Eff Date: 02/21/2020 stated that she saw an immediate change in the workplace and at the bedside after the first workshop. Our partner, University of California, Davis, runs their workshops monthly, gives presentations locally and nationally on the exceptional outcomes they have experienced such as markedly increased retention, therapeutic working environments, an increase in collegial relationships and tolerance in the work place plus exceptional staff/patient relationships and high satisfaction scores related to the patient‐staff experience. The company and the course have demonstrated expertise and consistently positive outcomes, respectively, through the provision of this course into the health care arena to staff throughout all levels of healthcare organizations.
It literally changes cultures. Based on these results, by initiating and maintaining this program, it would greatly increase STA612’s ability to meet VHA’s Strategic Priority 1 –Personalized, Proactive and Patient Centered Care program.
(8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made:
Due to the proprietary nature, Creative Health Care Management, Inc. (CHCM) is the only authorized company able to perform these training workshops in addition to providing the licensing fees to maintain this accreditation. They have the technical expertise to provide this service as well as the only company with access to its training materials for the workshop.
However, GSA and VetBiz were used to determine if there were any other vendors capable of providing the required training and workshops. It has been determined that CHCM is the only company capable of providing the required training and workshops to the agency.
(9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
