5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
1-Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1:
PennDOT maintains a registry of veterans who have elected to include a veteran designation on their Pennsylvania driver’s license. The database compiles in a single location a current collection of potential VA clients across the VISN04 Pennsylvania service area. This information is proprietary, and PennDOT will not share it with external agencies or organizations to execute the printing or mailing component. As such, PennDOT is the only source for required services.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
Competition is not available for this requirement due to the proprietary nature of the PennDOT veterans’ database.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
The contracting officer will consider the proposed pricing in relation to the IGCE and comparable pricing for similar services prior to award.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
The program office identified the PennDOT database as an advantageous vehicle to increase veterans’ awareness of and access to VHA healthcare services in support of the larger VA mission.
The acquisition team confirmed in informational meetings with PennDOT that PennDOT’s database is proprietary, and PennDOT is capable of meeting the requirement in full.
The contracting officer posted a notice of intent to negotiate the requirement with PennDOT on a sole source basis. The notice was posted to the Contract Opportunities database from 12/09/2021 through 12/15/2021 (Notice 36C24422Q0192, NAICS 541860). The notice included a brief description of the requirement and the rationale for a sole source procurement. The notice invited interested vendors to provide any information pertinent to the government’s proposed sole source strategy to the contracting officer no later than 12/14/2021. No vendors responded to the notice.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
Not applicable.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
Only PennDOT has expressed an interest in this requirement.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
Competition is not anticipated for this requirement due to the proprietary nature of the PennDOT veterans’ database.
12.
